Judicial Minister: No Presidential Pardon for Galagodaatte Gnanasara Thera
The possibility of a presidential pardon for Galagodaatte Gnanasara Thera, the Secretary of the Bodu Bala Sena organization, remains absent under current legal provisions while he serves a prison sentence for contempt of court. This assertion comes from Justice Minister Harshan Nanayakkara.
The Justice Minister highlighted that the existing legal framework does not allow for a presidential pardon, especially when judicial determinations invoke a specific prison sentence. He emphasized the importance of adhering to the rule of law and constitutional procedures in light of executive powers, noting that there is no room for arbitrary decisions beyond the legal directives.
As a government committed to safeguarding constitutional integrity and judicial independence, the minister reiterated that no political decision will undermine judicial orders.
Gnanasara Thera was convicted in 2018, receiving a six-year sentence from the Appeals Court for contempt after he was found guilty of hindering court proceedings during the 2016 abduction case of journalist Prageeth Ekneligoda.
However, after serving approximately nine months of his sentence, he was granted a special presidential pardon by then-President Maithripala Sirisena in May 2019.
This pardon faced criticism, leading several parties, including Sandhya Ekneligoda, to file petitions at the Supreme Court, claiming it violated fundamental rights.
After reviewing these petitions, a three-member bench of the Supreme Court unanimously annulled the presidential pardon in September, declaring it arbitrary, unlawful, and a breach of public supremacy, thus reinstating the residual prison sentence for Gnanasara Thera.
Following his re-incarceration, a “Freedom March” commenced from the Mahanaayake Thera in Kandy to Colombo, protesting the removal of his saffron robe under prison regulations. This march soon transformed into a demonstration calling for Gnanasara Thera's release by presidential pardon. However, ahead of this, numerous senior government ministers had already made it clear that no actions contrary to judicial verdicts or the rule of law would be taken.
