කොළඹ නීතීඥ සංගමය විරෝධය ජනපතිට දන්වයි..

ශ්‍රේෂ්ඨාධිකරණයේ සහ අභියාචනාධිකරණයේ විනිසුරුවරුන්ගේ විශ්‍රාම ගැන්වීමේ වයස දීර්ඝ කිරීම සඳහා වන ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනය ඉදිරියට ගෙන නොයන ලෙස කොළඹ නීතිඥ සංගමය ජනාධිපති අනුර කුමාර දිසානායක මහතාගෙන් ඉල්ලා සිටියි.

මෙවැනි පියවරක් මගින් අධිකරණයේ ස්වාධීනත්වය පිළිබඳව මහජනතාව තුළ පවතින විශ්වාසය බිඳ වැටිය හැකි බව එම සංගමය අනතුරු අඟවයි.

2026 ජූලි මස 02 වැනිදා ජනාධිපතිවරයා වෙත ලිපියක් යොමු කරමින් එම සංගමය සඳහන් කර ඇත්තේ, සිය විධායක කමිටුව ඒකමතිකව මෙම තීරණයට එළඹි බවයි.

මේ සම්බන්ධයෙන් ශ්‍රී ලංකා නීතිඥ සංගමය මීට පෙර ගත් ස්ථාවරයට ද කොළඹ නීති සංගමය සිය පූර්ණ සහය පළ කර තිබේ.

1978 ආණ්ඩුක්‍රම ව්‍යවස්ථාව හඳුන්වා දීමෙන් පසු ඉහළ අධිකරණ විනිසුරුවරුන්ගේ විශ්‍රාම වයස මෙතෙක් වෙනස් වී නොමැති බව කොළඹ නීති සංගමය පෙන්වා දෙයි.

විශේෂයෙන්ම දැනට සේවයේ නියුතු විනිසුරුවරුන් ඉලක්ක කරගනිමින් විශ්‍රාම වයස සංශෝධනය කිරීම, අධිකරණයේ අපක්ෂපාතීත්වය පිළිබඳව සමාජය තුළ සැකයක් මතු කිරීමට හේතු විය හැකි බව එම ලිපිය මගින් අවධාරණය කර ඇත.

2020 වසරේ සිදුකළ ව්‍යවස්ථා සංශෝධන මගින් ඉහළ අධිකරණ දෙකෙහිම විනිසුරුවරුන් සංඛ්‍යාව දැනටමත් ඉහළ නංවා ඇති බව සංගමය සිහිපත් කරයි.

එවැනි පසුබිමක, වත්මන් අදියරේදී විශ්‍රාම වයස තවදුරටත් දීර්ඝ කිරීමේ අත්‍යවශ්‍ය ආයතනික අවශ්‍යතාවයක් පවතින්නේද යන්න පිළිබඳව ද ඔවුහු ප්‍රශ්න කර සිටිති.

අධිකරණයේ ස්වාධීනත්වය යනු නීතියේ ආධිපත්‍යයේ සහ ප්‍රජාතන්ත්‍රවාදී පාලනයේ මූලික පදනම බව පෙන්වා දෙන කොළඹ නීති සංගමය, මෙවැනි තීරණාත්මක වෙනසක් සිදුකිරීමට පෙර අදාළ සියලු පාර්ශවයන් සමඟ පුළුල් ලෙස සාකච්ඡා කළ යුතු බව අවධාරණය කරයි.

මෙම ලිපියේ පිටපත් අග්‍රාමාත්‍ය හරිනි අමරසූරිය, අධිකරණ අමාත්‍ය හර්ෂණ නානායක්කාර සහ ශ්‍රී ලංකා නීතිඥ සංගමයේ සභාපති රජීව් අමරසූරිය යන මහත්ම මහත්මීන් වෙත ද යොමු කර තිබේ.

Colombo Lawyers' Association Urges President to Halt Constitutional Amendment on Judges' Retirement Age

The Colombo Lawyers' Association has requested President Anura Kumara Dissanayake to refrain from moving forward with the constitutional amendment aimed at extending the retirement age for judges of the Supreme Court and the Court of Appeal.

The association warns that such a move could undermine public trust in the independence of the judiciary.

In a letter addressed to the President dated July 2, 2026, the association stated that its executive committee unanimously reached this decision.

Regarding this matter, the Sri Lanka Bar Association has previously expressed its full support for the position taken by the Colombo Lawyers' Association.

The Colombo Lawyers' Association points out that since the introduction of the 1978 Constitution, the retirement age for judges of the higher courts has not changed.

The letter emphasizes that targeting currently serving judges for extension of retirement age could raise concerns about judicial impartiality within society.

The association also reminds that amendments made to the constitution in 2020 have already increased the number of judges in both higher courts.

In light of this context, they question whether there is an essential institutional need to further extend the retirement age at this stage.

The Colombo Lawyers' Association highlights that the independence of the judiciary is a fundamental principle of the rule of law and democratic governance, stressing the importance of comprehensive discussions with all relevant parties before making such a significant change.

Copies of this letter have also been sent to Prime Minister Harini Amarasuriya, Minister of Justice Harshana Nanayakkara, and Rajiv Amarasuriya, the President of the Sri Lanka Bar Association.
