22 වන ආණ්ඩුක්රම ව්යවස්ථා සංශෝධනය පිළිබඳ ශ්රේෂ්ඨාධිකරණයේ ව්යවස්ථාමය පරීක්ෂාව සිදු කිරීමට ප්රථම, එහි පවතින පුරප්පාඩු වහාම පුරවා අධිකරණයේ සංයුතිය තහවුරු කරන ලෙස 'දිනන දකුණ' සාමූහිකය ජනාධිපතිවරයාගෙන් ඉල්ලා සිටී.
එම සංවිධානය විසින් නිකුත් කරන ලද විශේෂ මාධ්ය නිවේදනයක මේ බව සඳහන් වේ.
ආණ්ඩුක්රම ව්යවස්ථාවේ 120 වන වගන්තිය ප්රකාරව පනත් කෙටුම්පතක ව්යවස්ථානුකූලභාවය තීරණය කිරීමේ පරම බලය ශ්රේෂ්ඨාධිකරණය සතු වන අතර, 22 වන සංශෝධනය මගින් විනිසුරුවරුන්ගේ විශ්රාම යන වයස දීර්ඝ කිරීමට යෝජනා කර තිබීම මෙහිදී විශේෂ අවධානයට ලක්විය යුතු කරුණක් බව එම සාමූහිකය පෙන්වා දෙයි.
තමන්ටම බලපාන කරුණක් සම්බන්ධයෙන් තමන්ම විනිසුරුවරයෙකු නොවිය යුතුය (Nemo judex in causa sua) යන ස්වභාවික යුක්ති මූලධර්මය මෙහිදී අභියෝගයට ලක්විය හැකි බවත්, පුරප්පාඩු නොපිරවීම හේතුවෙන් පසුව "අවශ්යතාවය පිළිබඳ න්යාය" (Doctrine of Necessity) පදනම් කරගෙන තීරණ ගැනීමට සිදුවීම බරපතල ව්යවස්ථාමය ගැටලුවක් බවත් එම නිවේදනයේ දැක්වේ.
විනිසුරුවරුන් පත් කරනු ලබන්නේ විනිසුරුවරුන් වෙනුවෙන් නොව පුරවැසියන්ගේ යුක්තිය වෙනුවෙන් බවත්, අධිකරණයේ ස්වාධීනත්වය සහ මහජන විශ්වාසය ආරක්ෂා කිරීම වෙනුවෙන් ජනාධිපතිවරයා සිය වගකීම කඩිනමින් ඉටු කළ යුතු බවත් එම නිවේදනය මගින් වැඩිදුරටත් අවධාරණය කර තිබේ.
Supreme Court to Review Constitutional Amendments Amid Calls for Immediate Judicial Appointments
The 'Southern Collective' has called on the President to urgently address existing vacancies within the judiciary before the Supreme Court conducts a constitutional review of the amendments. This demand was made in a special media statement released by the organization.
Highlighting the significance of this matter, the statement underscored that the ultimate authority to determine the constitutionality of legislation lies with the Supreme Court according to Article 120 of the Constitution. Moreover, it drew attention to concerns that the proposed 22nd amendment seeks to extend the retirement age of judges—a point that merits considerable scrutiny.
Furthermore, the principle of 'nemo judex in causa sua'—which posits that no one should be a judge in their own case—may come into play as the absence of appointments could lead to judicial decisions grounded in the 'Doctrine of Necessity'. This highlights a serious constitutional issue, as noted in the announcement.
The statement also reiterated that judges are appointed not on their own behalf but in service to the rights of citizens. It emphasized the importance of judicial independence and public trust, urging the President to fulfill his responsibilities promptly to ensure the integrity of the judicial system.
