22 හොද වැඩක්.. අධිකරණ තීන්දුව පිලිගන්නවා..- රජය එක්සත් ජාතීන්ට කියයි..


 අධිකරණ විනිසුරුවරුන් විශ්‍රාම ගැන්වීමේ වයස ඉහළ නැංවීම සඳහා යෝජිත ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනය මගින් අධිකරණයේ ස්වාධීනත්වයට කිසිදු බලපෑමක් සිදු නොවන බව රජය එක්සත් ජාතීන්ගේ මානව හිමිකම් කොමිසම වෙත නිල වශයෙන් දැනුම් දී තිබේ.

විනිසුරුවරුන්ගේ සහ නීතිඥයන්ගේ ස්වාධීනත්වය පිළිබඳ එක්සත් ජාතීන්ගේ විශේෂ වාර්තාකාරිනී මාග්‍රට් සැටර්ත්වේට් මහත්මිය විසින් යොමු කරන ලද විමසීමකට පිළිතුරු දෙමින් ශ්‍රී ලංකා රජය මේ බව ප්‍රකාශ කර ඇත.

ජිනීවාහි ශ්‍රී ලංකා නිත්‍ය නියෝජිත කාර්යාලය හරහා පසුගිය 21 වැනිදා මෙම නිල ප්‍රතිචාරය යොමු කර තිබේ.

මෙම සංශෝධනයේ ප්‍රධාන අරමුණ අධිකරණ පද්ධතිය තුළ පවතින අධික නඩු ගොඩගැසීම සහ නඩු ප්‍රමාදය අවම කරමින්, ජනතාවට අධිකරණයට ප්‍රවේශ වීමේ අයිතිය තහවුරු කිරීම බව රජය පෙන්වා දෙයි.

යෝජිත නව සංශෝධනයට අනුව ශ්‍රේෂ්ඨාධිකරණ විනිසුරුවරුන්ගේ අනිවාර්ය විශ්‍රාම වයස අවුරුදු 65 සිට 67 දක්වා ඉහළ නැංවේ. අගවිනිසුරුවරයාගේ ධුර කාලය වසර 7ක් හෝ වයස අවුරුදු 67 සම්පූර්ණ වීම යන කරුණු දෙකෙන් පළමුව සිදුවන අවස්ථාවේදී අවසන් වන බවත් ඒහි දැක්වේ.

අභියාචනාධිකරණ විනිසුරැ විශ්‍රාම වයස අවුරුදු 63 සිට 65 දක්වා ඉහළ නැංවෙන අතර, ප්‍රාදේශීය වාර පැවැත්වීමේ පහසුව සඳහා විනිසුරුවරුන් සංඛ්‍යාව 19 සිට 24 දක්වා වැඩි කෙරේ.

මහාධිකරණ විනිසුරැ විශ්‍රාම වයස අවුරුදු 61 සිට 63 දක්වා ඉහළ නැංවෙන අතර, උපරිම විනිසුරු සංඛ්‍යාව 110 සිට 120 දක්වා වැඩි කිරීමට යෝජිතය.

අනෙකුත් සියලුම පහළ අධිකරණ විනිසුරුවරුන්ගේ සහ මහේස්ත්‍රාත්වරුන්ගේ අනිවාර්ය විශ්‍රාම වයස අවුරුදු 62 ලෙස ඒකාබද්ධ කෙරේ.

මෙම සංශෝධනය කිසිදු ලෙසකින් විධායකයේ බලපෑම මත හෝ දේශපාලන වාසි ලබාගැනීමේ අරමුණින් සකස් කර නොමැති බව රජය අවධාරණය කරයි. ජාත්‍යන්තර ප්‍රමිතීන්ට අනුව විශ්‍රාම වයස ඉහළ නැංවීම අධිකරණ ස්වාධීනත්වයට බාධාවක් නොවන බවත්, විධායකයට තමන්ට රුචි පරිදි තනි තනි විනිසුරුවරුන්ගේ සේවා කාලය දීර්ඝ කිරීමට මෙයින් ඉඩක් නොලැබෙන බවත් රජය පෙන්වා දී ඇත.

එසේම, මෙම පනත් කෙටුම්පතේ ව්‍යවස්ථානුකූලභාවය ශ්‍රේෂ්ඨාධිකරණය හමුවේ අභියෝගයට ලක් කර ඇති බැවින්, ඒ සම්බන්ධයෙන් ශ්‍රේෂ්ඨාධිකරණය ලබා දෙන නිල තීන්දුවට රජය පූර්ණ ලෙස ගරු කරන බව ද එම ලිපියේ වැඩිදුරටත් සඳහන් වේ.





Sri Lankan Government Ensures Proposed Retirement Age Increase for Judges Will Not Undermine Judicial Independence

The Sri Lankan government has assured the United Nations Human Rights Commission that a proposed constitutional amendment aimed at raising the retirement age for judges will not impact the independence of the judiciary. This commitment comes in response to inquiries from Margaret Satterthwaite, the UN's special rapporteur on the independence of judges and lawyers.

This formal reply was sent through Sri Lanka's permanent mission in Geneva on the 21st of last month, reinforcing the government’s stance on judicial appointments.

According to the government, the primary goal of this amendment is to reduce the backlog of cases within the judicial system and ensure the public's right to access justice is preserved.

Under the proposed changes, the mandatory retirement age for Supreme Court judges will be raised from 65 to 67 years. It is emphasized that the tenure of the Chief Justice will be concluded at either the completion of 67 years of age or after a term of 7 years—whichever comes first.

Additionally, the retirement age for Court of Appeal judges will increase from 63 to 65 years, and the number of judges required for local circuit sessions will expand from 19 to 24.

The retirement age for High Court judges will rise from 61 to 63 years, alongside a proposal to increase the maximum number of judges from 110 to 120.

Moreover, the mandatory retirement age for all other lower court judges and magistrates will be unified at 62 years.

The government stressed that this amendment is not influenced by the executive branch or intended to serve any political purpose. It is stated that raising the retirement age, in accordance with international standards, will not obstruct judicial independence. There is also an assurance that this change does not grant the executive the power to arbitrarily extend the service of individual judges.

The letter further notes that since the constitutionality of this legislation has been challenged in the Supreme Court, the government fully respects the official ruling that will be provided by the court on the matter.

  4. මාග්‍රට් සැටර්ත්වේට් මහත්මිය කියන්නෙ ලංකාවේ අධිකරණයේ සැක කාරියක් සහ ළඟදීම ඇතුලට යන්න ඉන්න කෙනෙක්. ඒකයි ඔය 22ට මෙච්චර විරුද්ධ වෙලා ඉන්නෙ. එහෙම නැතුව 22 නරක හන්දා නෙමේ හොඳේ.
