ආණ්ඩුක්රම ව්යවස්ථාවේ 22 වැනි සංශෝධනය හරහා වත්මන් ජනාධිපතිවරයාගේ ධුර කාලය මෙන්ම පාර්ලිමේන්තුවේ නිල කාලය ද දීර්ඝ කර ගැනීමේ පැහැදිලි අවදානමක් පවතින බව මහාචාර්ය ජී. එල්. පීරිස් මහතා පවසයි.
කොළඹ, මල් පාරේ පිහිටි දේශපාලන කාර්යාලයේ අද (10) පැවැති මාධ්ය හමුවකට එක්වෙමින් ඔහු මේ බව සඳහන් කළේය.
යෝජිත මෙම ව්යවස්ථා සංශෝධනය හුදෙක් පාර්ලිමේන්තුවේ තුනෙන් දෙකක බහුතර බලයකින් පමණක් සම්මත කර ගැනීම ප්රමාණවත් නොවන බවත්, ඒ සඳහා අනිවාර්යයෙන්ම ජනමත විචාරණයක් පැවැත්විය යුතු බවත් ඔහු මෙහිදී අවධාරණය කළේය.
මෙම සංශෝධනය සම්මත වුවහොත් රටේ පවතින ප්රජාතන්ත්රවාදී සංස්කෘතිය විනාශ වී අධිකරණයේ ස්වාධීනත්වයට ද දැඩි බලපෑම් එල්ල වනු ඇති බව මහාචාර්ය ජී. එල්. පීරිස් මහතා වැඩිදුරටත් පෙන්වා දුන්නේය.
"22 වෙනි සංශෝධනය ගැසට් කරලා තියෙනවා. අපි දිවි හිමියෙන් ප්රජාතන්ත්රවාදී නීත්යානුකූල රාමුවක් තුළ එම සංශෝධනය පරාජය කිරීමට කරන්න පුළුවන් සෑම දෙයක්ම කරනවා.
ඒකට හේතුව තමයි මෙය අතිශයින් භයානක සංශෝධනයක්. එහි ප්රතිවිපාක තක්සේරු කරන්න බැරි තරම් උග්රයි.
මේ රටේ මානව හිමිකම්, විපක්ෂයේ නීත්යානුකූල කාර්යභාරය බාධාවකින් තොරව කරගෙන යාමට ඇති හැකියාව, අවසානයේ ජනාධිපති ධූර කාලය දීර්ඝ කිරීම, පාර්ලිමේන්තුවේ ධූර කාලය දීර්ඝ කිරම වැනි මේ සියල්ලක් සම්බන්ධයෙන් බොහොම පැහැදිලි අවදානමක් ඉස්මතු වෙනවා මේ සංශෝධනය ක්රියාත්මක කිරීම තුළ.
මෙය විනිශ්චයකාරවරුන්ගේ වයස අවුරුදු දෙකකින් වැඩි කිරීමට සීමා වුණු සංශෝධනයක් නෙමෙයි, එයින් හුඟක් ඔබ්බට ගොස් මේ රටේ ප්රජාතන්ත්රවාදී සංස්කෘතිය, අපි සියලු දෙනා චිරාත් කාලයක් ආරක්ෂා කරගත් ආයතනවලට සෘජුවම පහරක් එල්ල වෙනවා මේ සංශෝධනය තුළින්.
අපිට පසුගිය සතියේ පුළුවන් වුණා මල්වත්තේ සහ අස්ගිරි මහානායක හිමිවරුන් බැහැදැක මේ සම්බන්ධයෙන් කරුණු සාකච්ඡා කරන්න. උන්වහන්සේලා අපිට ඉතාමත් පැහැදිලිව ප්රකාශ කළා ගරු ජනාධිපතිතුමාට සන්දේශයක් යැව්ව බව.
නමුත් මහානායක ස්වාමීන් වහන්සේලාගේ ලිපිය ලැබුණු බවවත් තවම දන්වලා නැහැ. ඒ සඳහා කිසිම ප්රතිචාරයක් නැහැ. සම්පූර්ණ නිහඬතාවයක්.
ශ්රී ලංකා ආණ්ඩුක්රම ව්යවස්ථාවේ 9 වැනි වගන්තියේ සඳහන් වෙනවා බුද්ධ ශාසනයට ප්රමුඛස්ථානය දෙනවායි කියලා. ඉතින් ඒක කොළ කෑල්ලකට සීමා කරන්න බැහැ. මෙහෙමද සලකන්නේ මල්වතු, අස්ගිරි මහානායක ස්වාමීන් වහන්සේලාට?
ඒ සාකච්ඡාවෙන් පස්සේ අපේ සිතේ කිසිම සැකයක්, දෙගිඩියාවක් තිබුණේ නැහැ. මහානායක ස්වාමීන් වහන්සේලා ඉදිරිපත් කරපු මතය තමයි ඒක කරන්න එපා, ඒ සඳහා තම අසතුට ප්රකාශ කළ බව අපිට බොහොම පැහැදිලිව ඒත්තු ගැන්නුවා ඒ සාකච්ඡාවේදී.
මේ තොරතුරු ලබාගන්න, තොරතුරු දැනගැනීමේ පනත පාවිච්චි කිරීමට මේ රටේ ජනතාවට සිදුවෙලා තිබෙනවා. ඇයි මේක හංගන්නේ? කෝ විනිවිදභාවය? මහානායක ස්වාමීන් වහන්සේලා ලිපියක් යවලා තියෙනවා නම් ඒ පිළිබඳ ඒකෙ අන්තර්ගතය ගැන තොරතුරු ජනතාවට හෙළිදරව් කළ යුතුයි. ඇයි ඒක නොකරන්නේ? මොකක්ද තිබෙන ප්රශ්නය?
ඒ වගේම මේ රටේ නීතිඥයන් 26,000ක් නිල වශයෙන් නියෝජනය කරන නීතිඥ සංගමය අධිකරණ ඇමතිවරයා හරහා ඉල්ලලා තිබෙනවා අවස්ථාවක් ජනාධිපතිතුමා හමුවීමට. හමුවෙලා නීතිඥ සංගමයේ ස්ථාවරය ඉදිරිපත් කිරීමට, නමුත් මේ වනතුරු ඒකට අවස්ථාව ලැබිලා නැහැ.
ඒ විතරක් නෙමෙයි, නීතිඥ සංගමය ඉල්ලලා තිබුණා අධිකරණ ඇමති හර්ෂණ නානායක්කාර මහතා හමුවීමටත්. ඒ අවස්ථාව ලැබුණේ කැබිනට් මණ්ඩලයේ මේ පිළිබඳ තීරණයක් ගැනීමෙන් පසුවයි.
ඒ කියන්නේ මොවුන් සංවාදයකට කැමති නැහැ. කිසිම කතිකාවතක් සමාජයේ ඇති කිරීමට කැමති නැහැ. තමන්ට ඕන දේ හිතුමනාපෙට රහසිගතව, කිසිම විවාදයකින් තොරව ලහි ලහියේ කිරීම තමයි රජයේ දැඩි අධිෂ්ටානය වෙලා තියෙන්නේ. මොකක්ද ඒකට හේතුව? ඇයි බය?
රජය හොඳහැටි දන්නවා මේ ඉදිරිපත් කරන සාධක කිසිම වලංගුභාවයකින් තොර සාධක කියලා. මොකක්ද රජයේ මූලික තර්කය? ඇයි මේක කරන්නේ? ආණ්ඩුව කියන්නේ මේක කරන්නේ මේ ගොඩගැහිලා තියෙන නඩු ඉක්මනට විභාග කරලා අවසන් කරන්න කියලා.
මේ හේතුව සම්පූර්ණ අසත්ය හේතුවක්.
මේකෙන් කොහොමද ගොඩගැහිලා තියෙන නඩු අහලා ඉක්මනට ඉවර කරන්නේ? කිසිසේත් මේකෙන් ප්රයෝජනයක් නැහැ.
ඒ විතරක් නෙමෙයි, ඒ නඩු අහන පිළිවෙළ, සිවිල් නඩු විධාන සංග්රහයේ වගන්ති වෙනස් කරන්න ඕනේ. අද ශ්රේෂ්ඨාධිකරණයේ, අභියාචනාධිකරණයේ පමණක් නෙමෙයි, අනිත් උසාවි හැම එකේම කෙරෙන හුඟක් වැඩකටයුතු පරිපාලන මට්ටමෙන් කරන්න පුළුවන්නේ, උසාවියේ කාලය ඉතිරි කරගන්නත් පුළුවන්නේ.
නඩු ඉක්මනට අහන්න මේ දැන් ඉන්න විනිශ්චයකාරවරුන්ට තව අවුරුදු දෙකක් දීලා මොකක්ද ප්රයෝජනය? ඒ විනිශ්චයකාරවරයාට අවුරුදු දෙකක් දුන්නහාම දැන් කරන වැඩ ප්රමාණයට වඩා දෙගුණයක් කරනවාද? ඒක සම්පූර්ණයෙන් ශූන්ය, හිස් තර්කයක්.
නඩු ඉක්මන් කරනවා නම් වෙන හුඟක් ආයතන ශක්තිමත් කරන්න ඕනේ. නීතිපති දෙපාර්තමේන්තුව, රස පරීක්ෂක දෙපාර්තමේන්තුව, අපරාධ විමර්ශන දෙපාර්තමේන්තුව, මේ කිසිවක් නොකර ඒවා ඒ විදිහටම තියාගනිමින් ශ්රේෂ්ඨාධිකරණයේ හා අභියාචනාධිකරණයේ දැන් සිටින විනිශ්චයකාරවරුන්ගේ කාලය තව අවුරුදු දෙකක් වැඩි කිරීමෙන් කිසිම ප්රයෝජනයක් වෙන්නේ නැහැ
ඒක නෙවෙයි නියම අරමුණ. ප්රශ්නයක් තියෙනවා, හැබැයි තියෙන ප්රශ්නයයි යෝජිත විසඳුමයි අතර කිසිම සම්බන්ධයක් නැහැ. ඒක කාටත් වඩා හොඳින් දන්නේ ආණ්ඩුව. ආණ්ඩුව හොඳහැටි දන්නවා මේ ඉදිරිපත් කරන්නේ ව්යාජ තර්කයක්, කිසිම අවංකභාවයකින් තොර තර්කයක්.
දැන් සංවාදයක් ඇති වුණොත්, මහානායක ස්වාමීන් වහන්සේලා හම්බවුණොත්, නීතිඥ සංගමය හම්බවුණොත්, සිවිල් සමාජය හම්බවුණොත්, එතකොට රජය ඉදිරිපත් කරන මේ තර්ක සම්පූර්ණයෙන් අසත්ය තර්ක බව සක්සුදක් සේ පැහැදිලි වෙනවා. ඒ නිසා තමයි කිසිම සංවාදයකට අකමැති. ඒකට ඉඩක් නොදෙන්නේ මෙන්න මේ හේතුව නිසා.
දැන් වර්තමාන රජය අවුරුදු දෙකකට ඉස්සෙල්ලා බලය ඉල්ලමින් ජනතාව ඉස්සරහට ගියාම, මොනවාද කිව්වේ? මේවා ගැන වචනයක් සඳහන් කළේ නැහැ. “මෙහෙම ලොකු ප්රශ්නයක් අධිකරණ ක්ෂේත්රයේ තියෙනවා, ඒක විසඳීම සඳහා අපි මෙන්න මේ පියවර ගන්නවා” කියලා එක වචනයක්වත් සඳහන් කළේ නැහැ. වෙන දේවල් බොහොම අවධාරණාත්මකව සඳහන් කළා.
විධායක ජනාධිපති ධූරය අහෝසි කරනවා, ඒ සඳහා ආණ්ඩුක්රම ව්යවස්ථා සංශෝධනයක් ගේනවා. මැතිවරණ ක්රමය අතිශයින් අසතුටුදායකයි, දැන් ඒ නිසා අවුරුදු 12කට පළාත් සභා මැතිවරණ පවත්වීමට බැරි තත්ත්වයක් ඇතිවෙලා තියෙනවා. මේවා තමයි තියෙන ප්රශ්න කියලා ඔවුන් කිව්වේ.
ඉතින් මේවා විසඳීම සඳහා අංගසම්පූර්ණ අලුත් ආණ්ඩුක්රම ව්යවස්ථාවක් ගේනවා කියලා පැහැදිලි ප්රතිඥාවක් මේ රටේ ජනතාවට දුන්නා. ඒ අනුව තමයි මේ විදිහේ තුනෙන් දෙකක බහුතරයක් පාර්ලිමේන්තුවේ ලබාගත්තේ. දැන් ඒවා ගැන කිසි කතාවක් නැහැ.
දැන් අපි බලාපොරොත්තු වෙනවා නිසැකයෙන්ම ඒ අවස්ථාවෙන් ප්රයෝජන අරන් ශ්රේෂ්ඨාධිකරණයට යන්න. අපි ශ්රේෂ්ඨාධිකරණය හමුවේ තර්ක කරනවා මේ යෝජිත සංශෝධනය කිසිසේත් ජනමත විචාරණයකින් තොරව කරන්න බැහැ කියලා. පාර්ලිමේන්තුවේ තුනෙන් දෙකක බහුතරයක් ප්රමාණවත් වන්නේ නැහැ, මේක අනිවාර්යයෙන් ඊට වඩා ඉහළ අධිකරණයක් වන ජනතා අධිකරණයට යොමු කළ යුතුයි ජනමත විචාරණයක් හරහා.
ඒක කරන්නම ඕනේ. නොකර බැහැ. නොකර මේක නීතිගත කිරීමට අපේ ආණ්ඩුක්රම ව්යවස්ථාව යටතේ කිසිසේත් පුළුවන්කමක් නැහැ. එතකොට අපි ඒ තර්කය ශ්රේෂ්ඨාධිකරණයට ඉදිරිපත් කරනවා, අපි ඒක කරනවා.
අපි ඉල්ලීමකුත් කරනවා ශ්රේෂ්ඨාධිකරණයේ සියලුම විනිශ්චයකාරවරුන් මේ නඩුව අහන්න ඕනේ කියලා. දැනට ශ්රේෂ්ඨාධිකරණයේ විනිශ්චයකාරවරුන් 17 දෙනෙක් සිටිය යුතුයි අපේ නීතිය යටතේ. ඒකෙන් පුරප්පාඩු හතරක් තියෙනවා. එතකොට අද වනවිට ශ්රේෂ්ඨාධිකරණයේ වැඩකටයුතු කරගෙන යන විනිශ්චයකාරවරුන් 13 දෙනෙක් ඉන්නවා. තව විනිශ්චයකාරතුමෙක් සැප්තැම්බර් 2 වෙනිදා විශ්රාම ගැනීමට නියමිතයි. ඉතිරි වෙන්නේ ශ්රේෂ්ඨාධිකරණයේ විනිශ්චයකාරවරුන් 12 දෙනයි.
එතකොට අපි ශ්රේෂ්ඨාධිකරණයට ගිහිල්ලා අපේ තර්ක ඉදිරිපත් කරනකොට, “මේක කරන්න බැහැ, ජනමත විචාරණයක් පැවැත්වීම අනිවාර්යයි” කියලා ඒ තර්කය ඉදිරිපත් කරනකොට, අපි ශ්රේෂ්ඨාධිකරණයෙන් ගෞරවයෙන් ඉල්ලා සිටිනවා ඒ විනිශ්චයකාරවරුන් 12 දෙනාගෙන්ම සමන්විත පූර්ණ විනිශ්චය මණ්ඩලයක් ඉදිරියේ තබලා මේ තර්ක ඉදිරිපත් කරලා නිගමනයකට එළඹීමට පුළුවන්කම ලැබෙන්න ඕනේ.
තෝරලා බේරලා විනිශ්චයකාරවරුන් පත් කරලා, ඒ විනිශ්චයකාරවරුන් සුළු පිරිසකට මේ භාරදූර කර්තව්යය, මේ රටේ අනාගතයට සෘජුවම බලපාන මේ කර්තව්යය එහෙම සුළු, කුඩා විනිශ්චය මණ්ඩලයකට භාරදීම කිසිසේත් සාධාරණ වන්නේ නැහැ, යුක්තිසහගත වන්නේ නැහැ. ඒ නිසා පූර්ණ විනිශ්චය මණ්ඩලයක් ඉදිරියේ මේ නඩුව ඇසිය යුතුයි කියන තර්කය අපි ඉතාමත් ගෞරවාන්විතව ශ්රේෂ්ඨාධිකරණයට ඉදිරිපත් කරනවා.
Concerns Raised Over Proposed Constitutional Amendment by G.L. Peiris
A significant risk of extending the current President's term and the official duration of Parliament through the 22nd Amendment to the Constitution has been underscored by Professor G.L. Peiris. He made this assertion during a media briefing held today (October 10) at his political office on Malwatta Road, Colombo.
Peiris pointed out that merely securing a two-thirds majority in Parliament for the proposed amendment would not suffice; it must be subject to a public referendum. He emphasized that if this amendment is passed, it could lead to the destruction of the existing democratic culture and pose serious threats to the independence of the judiciary.
"The 22nd Amendment has been gazetted, and we are committed to resisting this change within the democratic legal framework, employing every possible means," he remarked, describing the amendment as profoundly dangerous and unpredictable in its implications.
Concerns were voiced over the potential impacts on human rights, the functioning of the opposition without hindrance, and the overall democratic process in Sri Lanka, all presumably jeopardized by the amendments to extend the terms of both the presidency and Parliament.
This proposed change is not a mere two-year extension of judges' tenures, Peiris asserted. Instead, it threatens the very institutions that sustain our democracy, directly undermining them.
Last week, discussions were held with the Chief Monks of the Malwathu and Asgiriya chapters regarding this issue. The monks communicated a message to the President concerning their apprehensions about the amendment, though no acknowledgment or response has yet been provided, leaving the matter shrouded in silence.
According to the 9th clause of the Sri Lankan Constitution, Buddhism is given priority, and Peiris questioned whether this principle should be dismissed or treated lightly by the likes of the Malwathu and Asgiriya Chief Monks.
After those discussions, there were no lingering doubts on whether the Chief Monks expressed their discontent regarding the amendment; it was made abundantly clear during deliberations.
The public has utilized the Right to Information Act to acquire details regarding this issue, leading Peiris to question why the government is concealing information. “What is the lack of transparency? If the Chief Monks have sent a letter, its contents should be revealed to the public,” he insisted, demanding clarity over the government’s silence.
Moreover, the country's official Bar Association, representing approximately 26,000 lawyers, had requested a meeting with the President through the Attorney General to present their position. However, no opportunities for a meeting have been granted to date.
Additionally, the Bar Association's request for a meeting with Attorney General Harshana Nanayakkara has only been entertained after the Cabinet made a decision on this matter.
This indicates a reluctance on the part of the government to engage in discourse or foster any public dialogue. There is a visible reluctance, leading to covert and unchallenged governance, an alarming trend that begs the question: what is the cause for this fear?
The government is acutely aware that the evidence presented holds no substantial validity. What is the fundamental argument? Why is this being pursued? The government claims the rapid resolution of pending cases as the rationale behind this amendment.
However, Peiris dismissed this reasoning as entirely baseless.
He argued that merely extending the tenure of judges by two more years does not lead to quicker resolutions of pending cases. This assertion fails to add any genuine value.
The solution lies not in extending judges’ times but rather in strengthening various institutions, including the Attorney General’s Department, the Department of Forensic Medicine, and the Criminal Investigation Department, instead of merely increasing the time for judges currently functioning in higher courts.
This is not the fundamental aim. There is an evident problem, but the proposed solution lacks any relation to the issue at hand. The government knows very well that the arguments being presented are misleading and devoid of sincerity.
If discussions were held, with the Chief Monks and the Bar Association coming together, the fallacy of the government's argument would become glaringly apparent. This underpins their refusal to entertain any dialogue.
In a prior bid for power before the public, the current government did not once mention these significant judicial issues nor proposed any steps to address them. They failed to acknowledge a pressing problem within the judicial sphere or discuss solutions transparently.
They spoke about abolishing the executive presidential office, citing unconstitutional amendments within their framework. They pointed to pervasive discontent with the electoral system, resulting in a scenario where Provincial Council elections have remained unheld for 12 years. These topics they deem problematic, yet no comprehensive plan for addressing these issues was shared with the public.
We now firmly expect that we will take full advantage of the ensuing court opportunity. Our argument is crystal clear: the proposed amendment cannot be legitimized without a public referendum. A two-thirds majority in Parliament does not suffice; it must be directed to a higher court by the people through a referendum process.
This must be done without exception. Our Constitution mandates that this cannot be accomplished without proper procedure. Therefore, we will present these arguments to the Supreme Court.
We also request that all judges at the Supreme Court consider this case. There should be 17 judges serving under our laws; however, currently, only 13 are functioning, with one anticipated to retire on September 2, leaving just 12 judges remaining.
As we approach the Supreme Court to present our arguments, we respectfully request a full bench comprised of these 12 judges to deliberate on this argument and arrive at a conclusion.
It is unjust and unreasonable to delegate such a critical charge, which directly affects the future of the nation, to a small, selected panel of judges when the future of the nation hangs in the balance. Therefore, we sincerely emphasize that this case must be heard in front of a full bench of justices.
