ලොකු නීති අවුලක්.. කතානායක ඉල්ලා අස්වෙයි..?

 කතානායක වෛද්‍ය ජගත් වික්‍රමරත්න මහතා ලබන මස මුල් සතියේ ටැන්සානියාවේ පැවැත්වෙන අන්තර් පාර්ලිමේන්තු කමිටු රැස්වීමට සහභාගී වීමෙන් අනතුරුව සිය ධුරයෙන් ඉල්ලා අස්වීමට ඉඩ ඇති බව සමාජ මාධ්‍ය  වාර්තා පලවෙමින් ඇත.

වාර්තාවන්හි අන්දමට ඔහුට එරෙහිව උද්ගතව ඇති බරපතළ නීතිමය ගැටලුවක් හේතුවෙන් තවදුරටත් කතානායක ධුරයේ කටයුතු කිරීමේ නෛතික බාධා මතු වී තිබේ.

මෙම අර්බුදයට මූලික හේතුව වී ඇත්තේ අල්ලස් හෝ දූෂණ විමර්ශන කොමිෂන් සභාවේ කොමසාරිස් ධුරයක  නිල කාලය එළඹෙන දෙසැම්බර් මාසයෙන් අවසන් වීමට නියමිතව තිබීමයි.

ඒ අනුව එම ධුරය සඳහා නව කොමසාරිස්වරයෙකු පත් කර ගැනීමට අයදුම්පත් කැඳවීමට ආණ්ඩුක්‍රම ව්‍යවස්ථා සභාව පසුගියදා තීරණය කර ඇත.

ආණ්ඩුක්‍රම ව්‍යවස්ථා සභාවේ සභාපතිත්වය නිල බලයෙන් හිමිවන්නේ කතානායකවරයාටය.

කෙසේ වෙතත්, කතානායක වෛද්‍ය ජගත් වික්‍රමරත්න මහතාට එරෙහිව මේ වන විටත් අල්ලස් හෝ දූෂණ විමර්ශන කොමිෂන් සභාව මඟින් විශේෂ පරීක්ෂණයක් පවත්වාගෙන යනු ලබයි.

තමන්ට එරෙහිව පරීක්ෂණයක් පවත්වන ආයතනයකට තීරණ ගන්නා කොමසාරිස්වරයෙකු පත් කිරීමේ ක්‍රියාවලියට කතානායකවරයා සම්බන්ධ වීම බරපතළ 'ලබැඳියාවන් අතර ගැටුමක්' (Conflict of Interest) නිර්මාණය කරවයි.

අල්ලස් හෝ දූෂණ විමර්ශන පනතේ 107 (1) සහ (2) යන වගන්තිවලට අනුව මෙවැනි ලබැඳියාවන් අතර ගැටුමක් පවතින අවස්ථාවක ඊට අදාළ නිල කටයුතුවලින් බැහැර විය යුතු අතර, එසේ නොවීම අධිකරණය හමුවේ දඬුවම් ලැබිය හැකි බරපතළ වරදකි.

යම් හෙයකින් එවැනි වරදක් සිදු කළහොත් අදාළ පුද්ගලයාට එරෙහිව මහාධිකරණය හමුවේ නඩු පැවරිය හැකි අතර, එහිදී වරදකරු වන තැනැත්තෙකුට වසර හතකට නොවැඩි සිරදඬුවමක්, රුපියල් ලක්ෂයක දඩයක් හෝ එම දඬුවම් දෙකම නියම කිරීමට මහාධිකරණයට නීතිමය බලය හිමි වේ.

මෙම නීතිමය සංකූලතාව හමුවේ කතානායක ධුරයේ තවදුරටත් රැඳී සිටීම නීතිමය වශයෙන් දැඩි අවදානම් සහගත තත්ත්වයක් බැවින්, ඉදිරි විදෙස් සංචාරය අවසන් වීමෙන් පසු ඒ මහතා ධුරයෙන් ඉල්ලා අස්වීමට බොහෝ දුරට ඉඩ ඇති බව අදාළ වාර්තා වැඩිදුරටත් අනාවරණය කරයි.

Speaker of Parliament Jagath Vikramarathne Faces Growing Legal Challenges Amidst Resignation Speculations

Medics and political circles are abuzz with reports of Speaker of Parliament Dr. Jagath Vikramarathne potentially resigning from his position following a forthcoming inter-parliamentary committee meeting in Tanzania scheduled for early next month. The anticipated move comes in the wake of emerging significant legal issues surrounding the speaker.

Speculation suggests that Dr. Vikramarathne may be hindered from continuing his duties as Speaker due to serious legal ramifications stemming from a corruption inquiry involving the Commission to Investigate Allegations of Bribery or Corruption. This investigation has reportedly triggered ethical concerns regarding his capacity to hold office.

Complicating matters, the term of the current commissioner within the corruption commission is set to conclude in December. As a result, the Constitutional Council has recently initiated a process to invite applications for a new commissioner.

Traditionally, the Speaker of Parliament holds official authority over the Constitutional Council, creating a tight web of obligations and potential conflicts of interest.

Currently, an investigation led by the Bribery Commission is active against Dr. Vikramarathne, raising concerns regarding his involvement in appointing a new commissioner to oversee the agency conducting the inquiry against him. Such involvement could lead to a severe conflict of interest.

According to provisions 107 (1) and (2) of the Prevention of Bribery Act, there are stringent regulations regarding such conflicts, which mandate that involved officials must abstain from related duties. Failure to comply may result in significant legal repercussions, including charges brought before the Supreme Court.

Should the Speaker engage in actions violating these laws, he could face prosecution, with the potential consequences being a maximum of seven years of imprisonment, a fine of one million rupees, or a combination of both penalties.

This complex legal situation poses serious risks to Dr. Vikramarathne's ability to remain in his position. Reports suggest that following his international engagement, he is increasingly likely to consider resignation to alleviate the pressure from rising legal challenges.
