Former President Mahinda Rajapaksa Hospitalized; Son Seeks Bail Amid Serious Charges

In a troubling turn of events, former President Mahinda Rajapaksa is currently receiving treatment in hospital due to escalating high blood pressure and severe depression. His wife, Shiranthi Rajapaksa, is scheduled for a life-threatening open-heart surgery, which was disclosed by Presidential Attorney Ali Sabry during proceedings at the Colombo Chief Magistrate's Court on October 27.

The court case surrounding the alleged embezzlement of 70 million rupees linked to a deal with a dairy company brought Namal Rajapaksa, the son of the former president, into the spotlight today. His attorney presented a bail application, citing special circumstances to secure his release.

Sabry highlighted the critical need for Namal Rajapaksa to be present to care for his ailing father, who is in a vulnerable state due to health complications. Previously, Namal's mother, Shiranthi, played a crucial role in his father's care; however, she too has been hospitalized due to severe cardiac issues.

Doctors have recommended two surgical procedures for Shiranthi Rajapaksa, as the main artery supplying blood to her heart is blocked. One surgery has already been performed, and she is currently relying on a cardiac monitor. The second, highly risky open-heart surgery, is slated for the afternoon, leaving her medical team uncertain about her survival afterward, according to the attorney's statements to the court.

"The accused is the eldest son of Mahinda Rajapaksa and Shiranthi Rajapaksa. They have lived under one roof together. If bail is granted today, he may have a chance to see his mother, possibly for the last time. According to the Constitution, a suspect is presumed innocent until proven guilty. Thus, detention should not be the default punishment. We are requesting bail under reasonable conditions," Sabry appealed further to the court.

Meanwhile, Tanusha Bandara, an assistant legal director representing the Commission to Investigate Allegations of Bribery or Corruption, informed the court that she was unaware of the bail application. Under Section 149 of the Anti-Corruption Act, she stated that the suspect should remain in custody until the investigations conclude, emphasizing that bail could not be granted without substantial grounds.

Considering the arguments presented, Chief Magistrate Asanga S. Bodaragama noted that the new facts had not been included in earlier bail applications and that the court possessed the authority to assess whether these facts constitute special circumstances. However, since the stance of the involved parties must be formally communicated to the court, he ordered the Commission to submit their position by the 28th, indicating that a ruling on the bail petition will be made on that date.

In addition, Namal Rajapaksa faces 24 serious charges linked to a separate incident involving the alleged acceptance of 100 million rupees in bribes related to an airbus transaction. The Chief Magistrate ordered that court proceedings on this matter be concluded and that the accused remain in custody until the 28th.
