මාතලේ දිස්ත්‍රික් රෝහල් භූමියෙන් හමු වූ සමූහ මිනීවලට අදාළව වසා දමා තිබූ නඩු ගොනුව යළි විවෘත කර විභාගයට ගන්නා ලෙස ඉදිරිපත් වූ ඉල්ලීම මාතලේ මහේස්ත්‍රාත් අධිකරණය විසින් (21) නිෂ්ප්‍රභ කරනු ලැබීය.

මාතලේ මහේස්ත්‍රාත් සහ දිසා විනිසුරු හර්ෂණ ධනුෂ්ක රත්නායක මහතා මෙම නියෝගය නිකුත් කරමින් සඳහන් කළේ, පූර්වගාමී විනිසුරුවරයෙකු විසින් ලබාදුන් තීන්දුවක් යළි එම අධිකරණයේදීම විභාගයට ගත නොහැකි බවයි.

ඒ අනුව, නීතිපති උපදෙස් මත මෙම නඩුව ඉහළ අධිකරණයක ගොනු කරන ලෙස විනිසුරුවරයා අදාළ පාර්ශවයන්ට දැනුම් දුන්නේය.

1988/89 කාලසීමාවේ අතුරුදන් වූවන්ගේ පවුල්වල එකමුතුව විසින් මෙම නඩුව යළි විභාගයට ගන්නා ලෙස ඉල්ලීමක් කර තිබුණි.

2015 වසරේදී මෙම නඩු ගොනුව කිසිදු අවසන් තීන්දුවකින් තොරව අධිකරණය මඟින් වසා දමා තිබීම විශේෂත්වයකි.

මාතලේ දිස්ත්‍රික් රෝහල් භූමියේ සිදුකළ කැණීමකදී මෙම සමූහ මිනීවල අනාවරණය වූ අතර, එහිදී සිරුරු 150කට අධික සංඛ්‍යාවක අස්ථි කොටස් සොයා ගැනුණි.

එම අස්ථි කොටස්වල කාල නිර්ණය සිදුකිරීම සඳහා ඇමරිකාවේ රසායනාගාරයක් වෙත ද යොමු කෙරුණු අතර, එම වාර්තා කැඳවීමෙන් අනතුරුව නඩුව වසා දැමීමට එවකට කටයුතු කර තිබුණි.

මෙම නඩු විභාගය ආරම්භ වීමට පෙර අතුරුදන් වූවන්ගේ පවුල්වල සාමාජිකයන් මාතලේ අධිකරණය ඉදිරිපිට සත්‍යග්‍රහයක ද නිරත වූහ.

Matale Magistrate's Court Declines to Reopen Case on Mass Graves

The Matale Magistrate's Court has denied a request to reopen the case concerning the mass graves discovered on the grounds of the Matale District General Hospital. This decision came after a submission for a judicial review was presented to the court.

Issuing the ruling, Magistrate and District Judge Harshana Dhanushka Ratnayake emphasized that a decision made by a prior judge cannot be re-examined by the same court.

Following the direction of the Attorney General, the Magistrate subsequently instructed the concerned parties to file the case with a higher court.

This case was brought forth by families of the disappeared persons from the 1988/89 period, who are seeking to have it reviewed once more.

Notably, the case was closed by the court in 2015 without any conclusive judgment, which has drawn significant attention.

The mass graves came to light during excavations conducted at the Matale District General Hospital site, where remains of over 150 individuals were discovered.

Samples from the bones were sent to a laboratory in the United States for dating, and following the receipt of those results, actions were taken at that time to close the case.

Before the case could proceed to trial, family members of the disappeared staged a truth-seeking demonstration outside the Matale court, reflecting the ongoing anguish and pursuit of justice surrounding this haunting issue.
