22 ගැන UN ලිපියට රජය බොරු ලියලා..

 22 වැනි ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනය සම්බන්ධයෙන් එක්සත් ජාතීන්ගේ සංවිධානය වෙත රජය ලබා දී ඇති පිළිතුරු සාවද්‍ය බවත්, එමගින් ශ්‍රී ලංකාව ජාත්‍යන්තරය හමුවේ දැඩි අපහසුතාවයට පත්වන බවත් ‘දිනන දකුණ’ සාමූහිකය පවසයි.

‘දිනන දකුණ’ සාමූහිකය විසින් නිකුත් කරන ලද විශේෂ මාධ්‍ය නිවේදනයක මේ බව සඳහන් වේ.

විනිසුරුවරුන්ගේ සහ නීතිඥයන්ගේ ස්වාධීනත්වය පිළිබඳ එක්සත් ජාතීන්ගේ විශේෂ නියෝජිතවරිය විසින් මතු කරන ලද ප්‍රශ්නවලට රජය ලබා දී ඇති පිළිතුරු හරහා මෙරට ප්‍රජාතන්ත්‍ර විරෝධී ස්වභාවය හෙළි වී ඇති බව එම සංගමය පෙන්වා දෙයි.

විශේෂයෙන්ම ශ්‍රේෂ්ඨාධිකරණ සහ අභියාචනාධිකරණ විනිසුරුවරුන්ගේ විශ්‍රාම වයස ඉහළ දැමීම "පුළුල් අධිකරණ ප්‍රතිසංස්කරණ ක්‍රියාවලියක" කොටසක් ලෙස රජය හැඳින්වුවද, ඒ සඳහා කිසිදු විධිමත් ප්‍රතිපත්තිමය ලේඛනයක් හෝ සැලසුමක් ඉදිරිපත් කිරීමට රජය අපොහොසත් වී ඇති බව එම නිවේදනයේ දැක්වේ.

නඩු ප්‍රමාදය වැළැක්වීම සඳහා මෙම සංශෝධනය ගෙන එන බව රජය ප්‍රකාශ කළද, සංඛ්‍යාලේඛන අනුව මෙරට නඩු ප්‍රමාදයෙන් 95%ක්ම පවතින්නේ මහේස්ත්‍රාත් සහ දිසා අධිකරණ මට්ටමින් බව ‘දිනන දකුණ’ සාමූහිකය අවධාරණය කරයි.

අධිකරණ පද්ධතියේ පවතින 1,000කට අධික සහායක කාර්ය මණ්ඩල පුරප්පාඩු සහ නීතිපති දෙපාර්තමේන්තුවේ පවතින හිඟයන් පිළිබඳව අවධානය යොමු නොකර, ඉහළ අධිකරණවල විනිසුරුවරුන්ගේ විශ්‍රාම වයස පමණක් ඉහළ දැමීම සැක සහිත බව ඔවුන් පෙන්වා දෙයි.

මෙම පියවර හරහා දැනට සේවයේ නියුතු විනිසුරුවරුන්ට ක්ෂණික වරප්‍රසාද ලබා දීම මගින් විධායකය සහ අධිකරණය අතර අනුචිත බැඳීමක් නිර්මාණය වන බවත්, එය සිවිල් හා දේශපාලන අයිතිවාසිකම් පිළිබඳ ජාත්‍යන්තර සම්මුතියේ (ICCPR) 14(1) වගන්තිය උල්ලංඝනය කිරීමක් බවත් එම සංගමය පවසයි.

රජය අධිකරණ පද්ධතිය දේශපාලනීකරණය කරමින් තමන්ගේ අනාගත දේශපාලන වාසි තකා කටයුතු කරන බවට ද එහිදී චෝදනා එල්ල වේ.

එබැවින්, පවතින විනිසුරු පුරප්පාඩු පිරවීම ඇතුළු ප්‍රායෝගික ක්‍රියාමාර්ග හරහා අධිකරණයේ ස්වාධීනත්වය තහවුරු කරන ලෙසත්, ජාත්‍යන්තර විශ්වාසය පළුදු වන ආකාරයේ මෙවැනි ක්‍රියාවලින් බැහැර වන ලෙසත් ‘දිනන දකුණ’ සාමූහිකය රජයට අවධාරණය කර සිටියි.

Concerns Raised Over Government's Responses to Constitutional Amendments

The UN has received dubious responses from the Sri Lankan government regarding the 22nd amendment to the Constitution, raising serious concerns that the nation may face significant international backlash, according to the ‘Dinana Dakkuna’ collective. In a special press release, the group highlighted the ramifications of these responses.

Reacting to questions raised by the UN's special rapporteur concerning the independence of judges and legal professionals, the collective asserted that the government’s answers revealed a troubling anti-democratic tendency within the country. The press release emphasized the potential threats to democratic governance in Sri Lanka.

While the government described raising the retirement age for Supreme Court and Appeal Court judges as part of a "comprehensive judicial reform process," the collective criticized it for failing to present any formal policy documents or plans to support this claim.

The government’s announcement indicated that this amendment was intended to address delays in the judicial process; however, the collective pointed out that statistics show 95% of these delays occur at the Magistrate and District Court levels.

Highlighting concerning vacancies within the judicial system, where over 1,000 positions remain unfilled alongside deficiencies within the Attorney General's department, the group argued that merely extending the retirement age for judges is insufficient and potentially questionable.

This measure, they warned, could create an inappropriate connection between the executive and the judiciary by providing immediate benefits to current serving judges. They also stated that such actions violate Article 14(1) of the International Covenant on Civil and Political Rights (ICCPR), which protects civil and political rights.

Additionally, there are accusations that the government is politicizing the judicial system to secure future political advantages. The ‘Dinana Dakkuna’ collective urged the administration to take practical steps to uphold the independence of the judiciary, particularly by filling existing judicial vacancies, to restore international confidence in Sri Lanka.
