රජය විසින් ඉදිරිපත් කර ඇති දූෂණ විරෝධී නව සංශෝධන පනත් කෙටුම්පත මගින් තොරතුරු දැනගැනීමට සහ එම තොරතුරු භාවිත කිරීමට ජනතාවට ඇති අයිතිය බරපතල ලෙස සීමා වන බව පවසමින් නිදහස් හා සාධාරණ මැතිවරණයක් සඳහා වූ ජනතා ක්රියාකාරීත්වය ජනාධිපති අනුර කුමාර දිසානායක මහතා වෙත ලිපියක් යොමු කර තිබේ.
2024 ජූලි 24 වන දින ගැසට් පත්රයේ පළ කර ඇති මෙම සංශෝධන මගින්, තොරතුරු දැනගැනීමේ අයිතිය යටතේ ලබාගන්නා තොරතුරු වෙනත් කාර්යයක් සඳහා භාවිත කිරීම දඬුවම් ලැබිය හැකි අපරාධ වරදක් ලෙස අර්ථකථනය කර ඇති බව පැෆරල් සංවිධානය පෙන්වා දෙයි.
මෙය "මහජනයාගේ බලය පාවිච්චි කරන තැනැත්තන් මහජනයාගේ නිරීක්ෂණයට විවෘත විය යුතුය" යන මූලික ප්රජාතන්ත්රවාදී මූලධර්මයට පටහැනි බව එම සංවිධානය අවධාරණය කරයි.
විශේෂයෙන්ම වත්කම් හා බැරකම් ප්රකාශ සම්බන්ධයෙන් පවතින විනිවිදභාවය මෙමගින් අහිමි වන බව එම ලිපියේ සඳහන් වේ.
2023 අංක 09 දරන දූෂණ විරෝධී පනතේ 88 වන වගන්තියට ගෙන ඒමට යෝජිත සංශෝධන මගින්, වත්කම් ප්රකාශවල සංස්කරණය කළ පිටපත් ලබාගැනීම සහ ඒවා ප්රසිද්ධ කිරීම සීමා කිරීමට උත්සාහ දරා ඇත.
මෙලෙස තොරතුරු ප්රවාහය සීමා කිරීම දූෂණය අවම කිරීමට බාධාවක් වන අතර, දූෂිතයන් නීතියෙන් බේරී යාමට ඇති ඉඩකඩ වැඩි කරන බව පැෆරල් සංවිධානය පවසයි.
මහජන දේපළ හා මහජන බලය ක්රියාත්මක කරන පුද්ගලයන් ඒ හරහා අයථා ලාභයක් ලබන්නේද යන්න සොයා බැලීමට ජනතාවට ඇති අයිතිය කිසිසේත්ම සීමා නොකළ යුතු බව එම ලිපිය මගින් වැඩිදුරටත් අවධාරණය කර ඇත.
එබැවින්, තොරතුරු දැනගැනීමේ අයිතිය සහ විනිවිදභාවය තහවුරු වන පරිදි මෙම සංශෝධන පිළිබඳව නැවත සලකා බලන ලෙස පැෆරල් සංවිධානය ජනාධිපතිවරයාගෙන් ඉල්ලා සිටියි.
Public Right to Information at Risk from Proposed Anti-Corruption Amendments
The recently proposed anti-corruption amendment bill by the government is raising concerns over serious restrictions on the public's right to access and utilize information. This sentiment was expressed in a letter sent to President Anura Kumara Dissanayake by the Citizens' Collective for Free and Fair Elections.
Published in the gazette on July 24, 2024, the proposed amendments interpret the misuse of information acquired under the right to information as a punishable offense, according to the organization. This alarming development contradicts the fundamental democratic principle that those wielding public power should be open to public scrutiny.
The letter emphasizes that the transparency surrounding asset declarations and liabilities would be significantly undermined by these changes.
Efforts to amend Article 88 of the Prevention of Corruption Act No. 09 of 2023 appear to restrict access to edited copies of asset declarations, threatening the accountability of public office holders.
Limiting the flow of information hinders efforts to combat corruption and potentially creates more avenues for wrongdoers to evade justice, as highlighted by the organization.
The letter further stresses that the public's right to investigate whether officials are misusing public assets or authority should never be curtailed.
In light of these developments, the Citizens' Collective has urged the President to reconsider the amendments to ensure that the right to information and transparency are upheld.

පැෆ්රල් සංවිධානය චන්ද ගැන දන්නවා වුනාට සමාජවාදී ආණ්ඩු ගැන දන්නෙ නැහැ. ඒ සදහා ජොර්ජ් ඕවෙල් විසින් ලියපු ඇනිමල් ෆාර්ම් කථාව කියවන්න. එකෙ තියෙන්නෙ all animals are equal but some animals are more equal than others. එතකොට මෙම more equal some animals ගැන තමයි දුෂණ විරෝධී සංශොධිත පණතින් ආවරණය වෙන්නෙ. ජොර්ජ් ඕවෙල් ඔවුන්ට some animals කිව්වට අපෙ රටෙ කියන්නෙ සමාජවාදී සිටුවරු කියලා.
ReplyDeleteThey law itself says the information can be used for legal purposes. So if anyone have any problems, they can act legally and seek penalties , which is the correct way. This change is a good move to protect the privacy of people in a country like Sri Lanka.
