විනිසුරුවරුන්ගේ විශ්‍රාම වයස දීර්ඝ කිරීම සම්බන්ධයෙන් සංකල්ප පත්‍රිකාවක් තමන් වෙත නොලැබුණු බවත්,එවැනි කැබිනට් පත්‍රිකාවක් තමන් සකස් නොකළ බවත් අධිකරණ සහ ජාතික ඒකාබද්ධතා අමාත්‍යාංශයේ ලේකම් ජනාධිපති නීතිඥ අයේෂා ජිනසේන මෙනවිය පසුගිය දිනක ජාතික පුවත්පතකට ප්‍රකාශයක් සිදුකර තිබිණි.

මෙම ප්‍රකාශය තුළ පැහැදිලි වන්නේ එවැනි කැබිනට් පත්‍රිකාවක් කැබිනට් මණ්ඩලය වෙත ඉදිරිපත් වූයේ අදාල රේඛීය අමාත්‍යාංශය මැදිහත්ව සකස් නොකර වෙනත් පාර්ශවයක් විසින් සකස් කරන ලද්දක් බවට දිනන දකුණ සාමූහිකයට සාධාරණ සැකයක් මතුවේ.

එම සැකය තවදුරටත් තීව්‍ර වනුයේ,ඊයේ දිනයේ ශ්‍රී ලංකා නීතිඥ සංගමයේ සභාපති නීතිඥ රජීව් අමරසූරිය මහතා මල්වතු පාර්ශවයේ මහානායක ස්වාමීන් වහන්සේ බැහැදැකීමෙන් අනතුරුව සිදු කරන ලද ප්‍රකාශය හේතුවෙන්.

මෙම ව්‍යවස්ථා සංශෝධනය සම්බන්ධයෙන් ත්‍රෛනිකායික මහානායක මාහිමිපාණන් වහන්සේලාගේ විරෝධය දක්වමින් ජනාධිපතිවරයා වෙත ලිපියක් යොමු කරන ලද බවට මල්වතු පාර්ශ්වයේ මහානායක මාහිමිපාණන් වහන්සේ විසින් දැනුම් දුන් බවයි.

නව ආණ්ඩුක්‍රම ව්‍යවස්ථාවක් හඳුන්වා දෙන බවට ජනතාවට පොරොන්දු වී,හදිසියේ ව්‍යවස්ථා සංශෝධනයක් සිදුකිරීමට ආණ්ඩුව දරන උත්සාහය දිනන දකුණ සාමූහිකය දැඩි පිළිකුලෙන් යුතුව හෙලා දකින්නෙමු.

ලොව පුරා විනිසුරුවරුන් නියෝජනය කරන ලෝකයේ පැරණිතම සහ විශාලතම ජාත්‍යන්තර සංවිධානය වන ජාත්‍යන්තර විනිසුරු සංගමය සිය කනස්සල්ල පළ කරමින් මේ වන විට නිවේදනයක් නිකුත් කර ඇත.

අධිකරණයේ  ස්වාධීනත්වය අඩපණ වන බැවින් යෝජිත නීති සම්පාදනය නැවත සලකා බලන ලෙස ශ්‍රී ලංකා රජයෙන් ගෞරාන්විතව ඉල්ලා සිටින බව ජාත්‍යන්තර විනිසුරු සංගමයද පවසා ඇත.

මෙම සියලු තත්වයන් සැළකිල්ලට ගැනීමේදී  විනිසුරුවරුන්ගේ විශ්‍රාම වයස දීර්ඝ කිරීම සම්බන්ධයෙන් වූ ව්‍යවස්ථා සංශෝධනයට පාර්ශ්ව රැසකින් එල්ල වී ඇති දැඩි විරෝධය කෙරෙහි ජනාධිපතිවරයාගේ කඩිනම් අවධානය යොමුකරන ලෙස අප සාමූහිකය අවධාරණය කරන්නෙමු.

Concerns Raised Over Possible Delay in Judiciary Retirement Age Amendment

The Dinasuna Southern Collective has issued a press statement addressing concerns regarding the proposed extension of the retirement age for judges. The Secretary of the Ministry of Justice and National Integration, presidential legal advisor Ayisha Jinadasa, disclosed that she had not received any draft cabinet memo on this matter and that no such document had been prepared under her guidance.

This statement suggests a lack of clarity regarding the origin of the cabinet proposal, raising suspicions that it may have been formulated by parties outside the relevant ministry. Observing the situation closely, the Dinasuna Southern Collective has highlighted the need for transparency in this legislative process.

Concerns intensified following remarks by Rajeev Amarasekera, the President of the Sri Lanka Bar Association, after a meeting with the Chief Prelate of the Malwathu Chapter. In this meeting, it was revealed that a letter protesting the constitutional amendment had been sent to the President by the Chief Prelates of the Tri-Nikaaya.

The government is under criticism for its abrupt move to amend the constitution despite having pledged to introduce a new constitution to the public, which has led to protests from various legal groups.

The International Legal Association, the oldest and largest organization representing judges worldwide, has also expressed its discontent through a statement. They have urged the Sri Lankan government to reconsider the proposed legal amendments, emphasizing that the changes could undermine the independence of the judiciary.

In light of the strong opposition from numerous parties regarding the proposed increase in judges' retirement age, the Dinasuna Southern Collective is calling for the President to urgently address these significant concerns.
