ඇඟලුම්වලට ඇති GSP+ සහන අවදානම්


ලංකාවට මීළඟ අදියරේදී මුහුණදීමට සිදුවන්නේ දැඩි කොන්දේසි සහිත ජී.එස්.පී.ප්ලස් නව ක්‍රමයකට බැවින්, නව රෙගුලාසි යටතේ සහනය තවදුරටත් ලබාගැනීමට ශ්‍රී ලංකාව විධිමත් ලෙස නැවත අයැදුම් කළ යුතු බවත්, එසේ නොවුණහොත් 2029 වසරේ මැද භාගයේ සිට අපනයන සඳහා සාමාන්‍ය එම්.එෆ්.එන්. තීරුබදු අදාළ වීමේ අවදානමක් මතුවිය හැකි බවත් ශ්‍රී ලංකා ඒකාබද්ධ ඇඟලුම් සංගම් සංසදය (JAAF) සඳහන් කරයි.

ජී.එස්.පී. ප්ලස් සහන ලබන ශ්‍රී ලංකාව ඇතුළු රටවල්, දැනට පවතින කොන්දේසිවලට අමතරව වඩා පුළුල් ජාත්‍යන්තර වගකීම් මාලාවකට ලබන වසරේ (2027) ජනවාරි මස පළමුවැනිදා සිට අනුකූල විය යුතු බවද එම සංසදය පවසයි.

යුරෝපා වෙළෙඳපොළ තුළ ශ්‍රී ලංකාවට තරගකාරීව රැඳී සිටීමට අවශ්‍ය මූලික ප්‍රතිපත්තිමය ආරක්ෂාවක් ලෙස ජී.එස්.පී.ප්ලස් සහනය සැලකිය හැකි නමුත්, වරණීය වෙළෙඳ සහන ලබාදීම සහ මානව හිමිකම්, කම්කරු අයිතිවාසිකම්, පරිසර ආරක්ෂාව සහ යහපාලනය පිළිබඳ අනුකූලතාව අතර සම්බන්ධතාව තවදුරටත් දැඩි කරන සංශෝධිත ජී.එස්.පී. රෙගුලාසියක් යුරෝපා සංගම් කවුන්සිලය විසින් ඉකුත් මැයි මස 22 වැනිදා අනුමත කිරීමට කටයුතු කළේය.

මේ අනුව, ලබන වසරේ (2027) ජනවාරි මස පළමුවැනිදා සිට ජී.එස්.පී. ප්ලස් සහන ලබන රටවල්, දැනට පවතින කොන්දේසිවලට අමතරව වඩා පුළුල් ජාත්‍යන්තර වගකීම් මාලාවකට අනුකූල විය යුතුය. ආබාධ සහිත පුද්ගලයන්ගේ අයිතිවාසිකම්, සන්නද්ධ ගැටුම්වලදී ළමා ආරක්ෂාව, කම්කරු පරීක්ෂණ ක්‍රමවේද ශක්තිමත් කිරීම, පැරිස් දේශගුණ ගිවිසුම ක්‍රියාත්මක කිරීම සහ සංවිධානාත්මක අපරාධ මර්දනය එම නව වගකීම් අතරට ඇතුළත් වේ. නව ක්‍රමය යටතේ නීති ක්‍රියාත්මක කිරීමේ යාන්ත්‍රණයද දැඩි කර ඇති අතර, බරපතළ හෝ හදිසි අනුකූලතා බිඳවැටීමකදී වෙළෙඳ සහන ඉක්මනින් ඉවත් කිරීමට හැකි “හදිසි සහන ඉවත් කිරීමේ” ක්‍රමවේදයක් හඳුන්වා දීමට ද නියමිතය.

මෙහිදී සහනය ලබන රටවල ප්‍රගතිය පිළිබඳ සමාලෝචන චක්‍රය වසර දෙකේ සිට වසර තුන දක්වා දීර්ඝ කිරීමට නියමිත බවත්, එහි ප්‍රතිඵලයක් ලෙස අනුකූලතා ගැටලුවක් මතුවුවහොත්, එය කඩිනමින් හඳුනාගෙන නිවැරැදි කිරීමට හෝ ප්‍රතිපත්තිමය මාර්ගය වෙනස් කිරීමට රටවලට ලැබෙන අවස්ථා අඩුවිය හැකි බවත්, ශ්‍රී ලංකාවට දැනට හිමි ජී.එස්.පී. ප්ලස් වෙළෙඳ සහන 2028 වසර අවසානය දක්වා ක්‍රියාත්මක වුවද, එම සහන ඉන්පසුව ස්වයංක්‍රීයව අලුත් නොවන බවත් එම සංගමය පවසන්නේය.

පසුගිය වසර කිහිපය තුළ ශ්‍රී ලංකාවේ ජී.එස්.පී. ප්ලස් සහන භාවිත අනුපාතය, එනම් සහනයට සුදුසුකම් ලබන අපනයන අතරින් සැබෑ ලෙස එම ප්‍රතිලාභය ලබාගන්නා කොටස, සියයට 49ත් 59ත් අතර මට්ටමක පවතින බවට වාර්තා වන බවත්, ඒ අනුව ශ්‍රී ලංකාවට ලබාදී ඇති වෙළෙඳ වාසියෙන් අඩකට ආසන්න ප්‍රමාණයක් භාවිතයට නොගෙන අහිමි කරගනිමින් සිටින බවත්, මෙයට ප්‍රධාන හේතුවක් වන්නේ යුරෝපා සංගමයේ මූලාරම්භ නීති යටතේ, ඇඟලුම් නිෂ්පාදනය නූල් නිෂ්පාදන අදියරේ සිටම සුදුසුකම් ලබන රට තුළ සිදුකළ යුතු වීම වුවත් ශ්‍රී ලංකාවේ දේශීය රෙදිපිළි නිෂ්පාදන පදනම එම අවශ්‍යතාව සම්පූර්ණ කිරීමට තවමත් ප්‍රමාණවත් නොවන බවත් ඒකාබද්ධ ඇඟලුම් සංගම් සංසදය පවසන්නේය.

ශ්‍රී ලංකාව අඛණ්ඩව වසර තුනක් ඉහළ මධ්‍යම ආදායම් තත්ත්වය පවත්වාගෙන ගියහොත්, ජී.එස්.පී. ප්ලස් සහන ක්‍රමයෙන් ඉවත් වීමට සිදුවිය හැකි බැවින් නව ක්‍රමය සඳහා අයැදුම්පත ඉදිරිපත් කරන කාලය තීරණාත්මක බවද එම සංගමය පවසන්නේය.

2027 වසරේ මුල් භාගයේදී අයැදුම් කිරීමෙන් ශ්‍රී ලංකාවට ජී.එස්.පී. ප්ලස් ප්‍රතිලාභ තවදුරටත් පවත්වාගෙන යාම සඳහා මාර්ගයක් මෙන්ම, අවශ්‍ය සංක්‍රාන්ති කාලසීමාවක්ද ලබාගැනීමට හැකි විය හැකි වූවත්, 2028 වසරේ අග භාගය දක්වා එය ප්‍රමාද කළහොත්, සහනය අලුත් නොකෙරෙන අවස්ථාවක 2029 වසරේ මැද භාගයේ සිට ශ්‍රී ලංකා අපනයන සඳහා සාමාන්‍ය එම්.එෆ්.එන්. තීරුබදු අදාළ වීමේ අවදානමක් මතුවිය හැකි බවද එම සංගමය සඳහන් කරයි.

යුරෝපා සංගමය හමුවේ ශ්‍රී ලංකාව තවදුරටත් විශ්වාසනීයත්වයේ හිඟයකට මුහුණ දී සිටින බැවින් මීළඟ ජී.එස්.පී. ප්ලස් අයැදුම්පත රජය ලබාදෙන පොරොන්දු, ප්‍රතිපත්ති ප්‍රකාශ හෝ ක්‍රියාකාරී සැලසුම් මත පමණක් තීරණය නොවනු ඇති බවත්, යුරෝපා සංගමය මතුකර ඇති මූලික ගැටලු සම්බන්ධයෙන් රජය සැබෑ, මැනිය හැකි සහ සාක්ෂි මගින් තහවුරු කළ හැකි ක්‍රියාමාර්ග ගෙන තිබේද යන්න එහිදී ප්‍රධාන වශයෙන් සලකා බැලෙනු ඇති බවත් ශ්‍රී ලංකා ඒකාබද්ධ ඇඟලුම් සංගම් සංසදය (JAAF) කියා සිටී.

මෙහිදී, ජාත්‍යන්තර ප්‍රමිතීන්ට අනුකූල වන ආකාරයෙන් ත්‍රස්තවාදය වැළැක්වීමේ පනත අහෝසි කර, ඒ වෙනුවට සුදුසු නව නීතිමය රාමුවක් හඳුන්වා දීම, මානව හිමිකම්, කම්කරු අයිතිවාසිකම්, පරිසර ආරක්ෂාව, දේශගුණික වගකීම් සහ යහපාලනය සම්බන්ධයෙන් යුරෝපා සංගමය මතුකර ඇති ගැටලු විසඳීමද අත්‍යවශ්‍ය බවත්, නීතිවිරෝධී මත්ද්‍රව්‍ය ජාවාරම් පාලනය ශක්තිමත් කිරීම සහ නීතිවිරෝධී වාර්තා නොකළ සහ නියාමනය නොකළ ධීවර කටයුතු වැළැක්වීමද එම ප්‍රමුඛතා අතරට ඇතුළත් බවත් ශ්‍රී ලංකා ඒකාබද්ධ ඇඟලුම් සංගම් සංසදය (JAAF) පෙන්වා දෙන්නේය.

New GSP Plus Conditions Require Sri Lanka to Reinstate Applications by 2027

Sri Lanka faces a critical juncture as the nation navigates stringent new conditions under the Generalized System of Preferences (GSP) Plus framework. The Joint Apparel Associations Forum (JAAF) has indicated that to continue benefiting from trade concessions, Sri Lanka must formally reapply under the new regulations; failure to do so could result in the reintroduction of standard Most Favored Nation (MFN) tariffs for exports starting mid-2029.

Countries like Sri Lanka, which are currently beneficiaries of GSP Plus, will need to comply with an expanded set of international commitments starting January 1, 2027, in addition to existing conditions. This adjustment was communicated by JAAF, emphasizing the seriousness of adhering to the new regulations.

Although the GSP Plus remains a vital element for maintaining Sri Lanka's competitiveness in European markets, the revised framework places a stronger emphasis on compliance with international standards concerning human rights, labor rights, environmental protection, and governance. These amendments were officially approved by the European Council on May 22.

Under these new provisions, nations receiving GSP Plus benefits must adhere to additional international obligations. Key areas include the rights of persons with disabilities, child protection during armed conflicts, enhancement of labor inspection systems, the implementation of the Paris Agreement, and the fight against organized crime. The legislation enforcement mechanisms have been made more robust, including provisions for rapid withdrawal of trade benefits in cases of serious non-compliance.

Furthermore, the review cycle for the progress of beneficiary countries is set to extend from two to three years. This extended timeline may hinder the prompt identification and rectification of compliance issues, limiting the countries' opportunities to remedy potential problems. While Sri Lanka's current GSP Plus trade benefits will remain effective until the end of 2028, JAAF warns that these benefits will not automatically be renewed afterward.

Reports indicate that Sri Lanka's utilization rates for GSP Plus benefits have hovered between 49% and 59% over the past few years, suggesting a significant portion of the trade advantages provided are not being fully capitalized on. The primary obstacle stems from European Union regulations requiring garment production to occur in qualifying countries, which Sri Lanka's local textile manufacturing capacity currently fails to meet satisfactorily.

The pressure on Sri Lanka is compounded by the necessity to maintain a high middle-income status over the next three years to avoid losing the GSP Plus benefits. The timing for submitting applications under the new framework is thus critical, according to JAAF.

Submitting the application early in 2027 could help secure a pathway for Sri Lanka to retain its GSP Plus advantages and manage transition deadlines effectively. However, delays until the latter half of 2028 could risk automatically forfeiting these benefits starting mid-2029, bringing about the imposition of standard MFN tariffs on Sri Lankan exports.

Amid ongoing concerns about credibility, the forthcoming GSP Plus application will not solely depend on commitments, policy statements, or action plans put forth by the government. Instead, tangible, measurable actions supported by evidence will be closely scrutinized by the European Union regarding the issues it has raised.

The JAAF underscores that addressing concerns surrounding compliance is essential. This includes repealing the current anti-terrorism legislation in favor of a suitable legal framework, ensuring respect for human rights, labor rights, environmental protections, and climatic responsibilities, as well as strengthening regulation against illegal drug trafficking and unreported fishing activities.
