අධිකරණයට අපහාස කිරීමේ පෙත්සමකට අදාළව අධිකරණය හමුවේ පෙනී නොසිටි පූජ්ය ගලගොඩඅත්තේ ඥානසාර හිමියන්ට අද දින අධිකරණය හමුවේ පෙනී සිටින ලෙස උපදෙස් දෙන ලෙස අභියාචනාධිකරණය උන්වහන්සේ වෙනුවෙන් පෙනී සිටි නීතිඥවරයාට නියෝග කළේය.
අභියාචනාධිකරණ ද්විපුද්ගල විනිසුරු මඩුල්ල ඉදිරියේ මෙම පෙත්සම සලකා බැලිණි.
එහිදී ඥානසාර හිමියන් වෙනුවෙන් පෙනී සිටි ජනාධිපති නීතිඥ අනුර මැද්දේගොඩ මහතා අධිකරණය හමුවේ ප්රකාශ කළේ, සිය සේවාදායකයා ශල්යකර්මයකට භාජනය වීමට නියමිතව ඇති බවයි.
කෙසේ වෙතත්, උන්වහන්සේගේ නොපැමිණීම සනාථ කිරීම සඳහා කිසිදු වෛද්ය වාර්තාවක් හෝ සහතිකයක් අධිකරණයට ඉදිරිපත් කිරීමට නීතිඥවරයා පියවර ගෙන නොතිබිණි.
නීතිපතිවරයා නියෝජනය කරමින් පෙනී සිටි රජයේ නීතිඥවරයා කරුණු දක්වමින් කියා සිටියේ, අධිකරණයට අපහාස කිරීමේ නඩු කටයුත්තකදී වගඋත්තරකරුගේ පෙනී සිටීම අනිවාර්ය සාධකයක් වන බවයි.
ඒ අනුව වගඋත්තරකාර හිමිනමට එරෙහිව වරෙන්තුවක් නිකුත් කරන ලෙස හෝ හැකිනම් අද දිනම අධිකරණය හමුවේ පෙනී සිටින ලෙසට නියෝගයක් නිකුත් කරන ලෙස රජයේ නීතිඥවරයා අධිකරණයෙන් ඉල්ලා සිටියේය.
දෙපාර්ශ්වයේම කරුණු දැක්වීම් සැලකිල්ලට ගත් අභියාචනාධිකරණය, වහාම අධිකරණය හමුවේ පෙනී සිටින ලෙස සිය සේවාදායකයාට උපදෙස් ලබාදෙන්නැයි ජනාධිපති නීතිඥ අනුර මැද්දේගොඩ මහතාට නියෝග කළේය.
Court Orders Radical Monk to Appear in Connection with Contempt Case
The Appeal Court has directed that Galagodaaththe Gnanasara Thero, who failed to appear before the court regarding a contempt petition, must now ensure his presence in future hearings. The order was given to his legal representative who appeared on his behalf.
This decision came during the proceedings held before a two-judge bench of the Appeal Court, where Gnanasara Thero was represented by President's Counsel Anura Madhdigoda.
Madhdigoda informed the court that his client was scheduled to undergo surgery, which might have contributed to his absence. However, he did not present any medical documentation or certificates to corroborate this statement.
In response, the government attorney who represented the Attorney General emphasized the necessity of the respondent's presence in such contempt proceedings, indicating that attendance is a crucial element of the process.
Consequently, the government attorney requested the court to either issue a warrant for the respondent or to compel him to attend court today.
After considering the arguments from both sides, the Appeal Court responded by instructing President's Counsel Anura Madhdigoda to advise his client to appear before the court without delay.
