සංවිධානාත්මක අපරාධ මැඬලීමට නව පනත් කෙටුම්පතක් ගැසට් කෙරේ.. පොලිසියට පුළුල් බලතල..


ජාතික ආරක්ෂාව, ආර්ථිකය මෙන්ම නීතියේ ආධිපත්‍යය සුරක්ෂිත කරමින් දේශීය හා ජාත්‍යන්තර මට්ටමින් ක්‍රියාත්මක වන සංවිධානාත්මක අපරාධ කල්ලි මර්දනය කිරීම ඉලක්ක කරගත් නව ‘සංවිධානාත්මක අපරාධ වැළැක්වීමේ පනත් කෙටුම්පත’ රජය විසින් අතිවිශේෂ ගැසට් පත්‍රයක් මගින් ප්‍රකාශයට පත් කර තිබේ.

අධිකරණ සහ ජාතික ඒකාබද්ධතා අමාත්‍යවරයාගේ නියමය පරිදි නිකුත් කර ඇති මෙම පනත් කෙටුම්පත මගින් ජාතික සීමා ඉක්මවූ සංවිධානාත්මක අපරාධවලට එරෙහි එක්සත් ජාතීන්ගේ සම්මුතියේ විධිවිධාන මෙරට තුළ ක්‍රියාත්මක කිරීමට මෙන්ම පාතාල සහ සංවිධානාත්මක අපරාධකරුවන්ට එරෙහිව දැඩි නීතිමය ක්‍රියාමාර්ග ගැනීමට අවශ්‍ය ප්‍රතිපාදන සලසා ඇත.

යෝජිත පනත් කෙටුම්පතට අනුව, සංවිධානාත්මක අපරාධ කණ්ඩායමක සාමාජිකයකු වීම හෝ එවැනි කණ්ඩායමක සාමාජිකයකු ලෙස ක්‍රියා කරමින් බරපතළ අපරාධයක් සිදු කිරීම සම්බන්ධයෙන් වරදකරු වන අයෙකුට මහාධිකරණය මගින් වසර 5කට නොඅඩු සහ වසර 20කට නොවැඩි කාලයක් සඳහා බන්ධනාගාරගත කිරීමේ දණ්ඩනයක් මෙන්ම රුපියල් මිලියනයක් දක්වා දඩ මුදලක් නියම කළ හැකිය.

මීට අමතරව පහත සඳහන් වැරදි සම්බන්ධයෙන් ද දැඩි සිරදඬුවම් යෝජනා කර ඇත.

  • සංවිධානාත්මක අපරාධ කණ්ඩායම් සඳහා සාමාජිකයන් බඳවා ගැනීම හෝ ඊට සහභාගී වීම.
  • අපරාධ කල්ලි සඳහා නවාතැන්, ගොඩනැගිලි හෝ පරිශ්‍ර ලබා දීම සහ අපරාධකරුවන් සඟවා තබා ගනිමින් රැකවරණය සැපයීම (වසර 10ක් දක්වා සිරදඬුවම්).
  • විමර්ශන නිලධාරීන්ට, සාක්ෂිකරුවන්ට හෝ අධිකරණ නිලධාරීන්ට තර්ජනය කිරීම සහ බලපෑම් එල්ල කිරීම (වසර 15ක් දක්වා සිරදඬුවම්).
  • සංවිධානාත්මක අපරාධ සිදු කිරීම සඳහා ව්‍යාපාරික ආයතන, සමාගම් හෝ මූල්‍ය ආයතන නීති විරෝධී ලෙස යොදා ගැනීම සම්බන්ධයෙන් සමාගම් අධ්‍යක්ෂවරුන්ට හා ව්‍යාපාරික ආයතනවලට එරෙහිව පියවර ගැනීම.

සංවිධානාත්මක අපරාධ වැළැක්වීම සහ විමර්ශනය කිරීම සඳහා පොලිස් නිලධාරීන්ට සුවිශේෂී බලතල රැසක් හිමි වේ.

  • වරෙන්තුවක් නොමැතිව සැකකරුවන්, වාහන, යාත්‍රා හෝ ගුවන් යානා නැවැත්වීම, පරීක්ෂා කිරීම සහ අත්අඩංගුවට ගැනීම.
  • උප පොලිස් පරීක්ෂක නිලයට නොඅඩු නිලධාරියකුට මහේස්ත්‍රාත් අධිකරණ අවසරය මත ඩිජිටල් සන්නිවේදන අවහිර කිරීම් (Interception), සවන්දීම්, දුරකථන සහ පරිගණක දත්ත පරීක්ෂා කිරීම් සිදු කිරීම.
  • අපරාධ මැඬලීම සඳහා රහස්‍ය ආවරණ මෙහෙයුම් (Undercover Operations) සහ උපායදූත මෙහෙයුම් දියත් කිරීම.
  • සැකකරුවන්ගේ බැංකු ගිණුම්, මූල්‍ය ගනුදෙනු වාර්තා සහ විදුලි සංදේශ සේවා සපයන්නන් සතු සන්නිවේදන දත්ත අධිකරණ නියෝග මත ලබා ගැනීම.

පොලිස්පතිවරයාගේ හෝ නියෝජ්‍ය පොලිස්පතිවරයකුගේ ඉල්ලීම මත, විෂයභාර අමාත්‍යාංශ ලේකම්වරයා විසින් වරකට මාස දෙකක් නොඉක්මවන කාලයක් සඳහා සැකකරුවකු පොලිස් භාරයේ රඳවා තබාගැනීමේ නියෝග නිකුත් කළ හැකි අතර, එම සමස්ත කාලය වසරක් නොඉක්මවිය යුතුය. එසේම, නඩු විභාගය අවසන් වන තෙක් සැකකරුවන් රක්ෂිත බන්ධනාගාරගත කිරීම හෝ විශේෂ රැඳවුම් භාරයේ තැබීම සම්බන්ධයෙන් මහාධිකරණයට නියෝග නිකුත් කිරීමේ බලය හිමි වේ.

මෙම පනත යටතේ සිදුකරන විමර්ශනවලදී සැකකරුවන්ගෙන් ප්‍රකාශ සටහන් කර ගැනීමේදී ඒවා ශ්‍රව්‍ය-දෘශ්‍ය (Audio-Visual) තාක්ෂණය ඔස්සේ පටිගත කිරීම අනිවාර්ය කර ඇති අතර, නීතිඥ සහාය ලබා ගැනීමට සැකකරුට ඇති අයිතිය සහතික කර ඇත. සැකකරුවකු අත්අඩංගුවට ගත් වහාම ඒ පිළිබඳව පැය 24ක් ඇතුළත ඔහුගේ ළඟම ඥාතීන්ට සහ ශ්‍රී ලංකා මානව හිමිකම් කොමිෂන් සභාවට දැනුම් දිය යුතු වේ. තවද, අපරාධ සම්බන්ධයෙන් තොරතුරු ලබා දෙන තොරතුරුකරුවන්ගේ අනන්‍යතාව සහ ආරක්ෂාව තහවුරු කිරීමට ද විශේෂ නීතිමය ආවරණයක් සලසා දී තිබේ.

මෙම පනත මගින් 1977 අංක 8 දරන උදර්පන පනත ද සංශෝධනය වන අතර, විදේශයන්හි සැඟව සිටින සංවිධානාත්මක අපරාධකරුවන් මෙරටට ගෙන්වා ගැනීමට සහ මෙරටින් පලායන අපරාධකරුවන් අදාළ රටවලට භාරදීමට ජාත්‍යන්තර නීති රාමුව ශක්තිමත් කිරීමට නියමිතය.





Government Unveils Comprehensive Bill to Combat Organised Crime

A proactive step to tackle organised crime on both local and international fronts has been initiated by the Sri Lankan government with the introduction of a new legislation, the 'Organised Crime Prevention Bill', designed to strengthen national security, economic stability, and the rule of law.

Issued through a special gazette at the directive of the Minister of Justice and National Integration, this bill aims to implement the relevant provisions of United Nations conventions addressing transnational organised crime within the country, while facilitating stringent legal measures against both underground and organised crime syndicates.

Under the proposed bill, individuals found guilty of participating in or committing serious crimes as members of an organised crime group could face imprisonment ranging from five to twenty years. Additionally, fines of up to one million rupees may be imposed for such offences.

The legislation also proposes severe penalties for a variety of other serious crimes:

  • Recruitment or participation in organised crime groups.
  • Providing shelter, buildings, or premises for criminal activities, or protecting offenders (with potential jail time of up to ten years).
  • Threatening or exerting influence over investigative officers, witnesses, or judicial officials (with maximum sentences of up to fifteen years).
  • Utilising business entities, companies, or financial institutions for illegal activities linked to organised crime, subjecting directors and businesses to legal action.

To enhance the efforts in preventing and investigating organised crime, police officers will be granted a suite of significant powers, including:

  • The ability to stop and search suspects, vehicles, or aircraft without a warrant.
  • Authority for senior police officers to carry out digital communication interception, listen in on communications, and search electronic data based on Magistrate Court approval.
  • Initiating undercover operations and covert operations for crime detection.
  • Accessing data from bank accounts, financial transactions, and communication data from providers through court orders.

At the request of the Inspector General of Police or Deputy Inspector General, the Secretary of the relevant ministry may authorise the detention of a suspect for no more than two months at a time, with the total duration not exceeding one year. Additionally, the High Court will have the authority to issue orders for the custody of suspects until the conclusion of their trials.

Surveillance of suspects will be mandated to be recorded in audio-visual formats during investigations, ensuring the accused's right to legal representation is maintained. Furthermore, detainees must be notified within 24 hours of their arrest to their closest relatives and the Sri Lanka Human Rights Commission. Special legal protections will also be provided to ensure the identity and safety of informants providing information related to crimes.

This bill will amend the 1977 Anti-Organised Crime Act, strengthening international legal frameworks to facilitate the extradition of organised criminals hiding abroad and the deportation of offenders fleeing the country.
