Court Declines to Issue Order on Monk's Robe Reinstatement
The Colombo High Court has ruled that it lacks the authority to issue directions regarding the reinstatement of the robe worn by Ven. Galagodaatte Gnanasara Thera, the General Secretary of the Bodhu Bala Sena organization, following its removal by prison officials. This statement was made by High Court Judge Buddika C. Ragala.
The Court convened to address a case filed against Ven. Gnanasara under the Penal Code by the Attorney General, concerning statements alleged to have insulted Islam and the sacred Quran. During the hearing, the judge noted the situation surrounding the monk's robe.
Senior Counsel Ashoka Weerasooriya, representing Ven. Gnanasara, indicated that prior to this incident, the Chief Prelate of the Kotte Sri Kalyani Samagri Dharma Maha Sangha Sabha had made a written request to prison authorities for the monk to be allowed to wear his robe in accordance with Buddhist traditions, in a manner that would not violate prison regulations.
However, the prison authorities had yet to respond to this request, Weerasooriya asserted in court.
“While I am not a Buddhist, from a Buddhist religious perspective, this is a very reasonable request. My client is not a member of an organized crime syndicate,” the senior lawyer emphasized.
This context highlights the ongoing tension both inside and outside the prison, which has raised concerns about potential conflicts. The prison authorities previously informed the court, via electronic communication, about the need for proper electronic technological arrangements for court proceedings, which led to Ven. Gnanasara being presented via a WhatsApp video call today due to these logistical challenges.
The judge pointed out that there were no legal provisions for the court to issue an order concerning the re-draping of the robe when questioned about the relief being sought by the plaintiff.
If such a request were to be considered a precedent, it could affect the conditions of all other monks currently detained for various offenses, the judge affirmed.
“There are numerous other monks incarcerated for different offenses. Should all of them have their robes restored by the Chief Prelate before being presented for court proceedings?” he queried.
The judge also instructed both parties to present details at the next hearing regarding the possibility of reaching a plea agreement under the Amendment Act No. 50 of 2024, which pertains to the Criminal Procedure Code, and set the next court date for January 29.
Senior Counsel Ashoka Weerasooriya was present in court alongside Attorneys Sanjaya Marambe and Pasan Karunaratne, while Government Counsel Supun Ranasinghe appeared on behalf of the Attorney General.
