Police Chief Faces Legal Action for Contempt of Court

The Chief Magistrate of Gampaha, Bandula Gunaratne, has ordered the immediate submission of a case file to the President of the Court of Appeal regarding allegations of "contempt of court" against the Police Chief. This action stems from failures to properly implement judicial orders and attempts to mislead the judiciary.

In previous instances, the courts had directed the Police Chief to issue a specific circular signed by him to prevent the wrongful targeting of innocent civilians in drug-related cases. The directive was intended to ensure that police officers across the country are held accountable for their actions.

However, it has come to light that the Police Department attempted to undermine this order by presenting misleading guidelines from the Deputy Inspector General of Police for the Western Province. This initiative aimed to challenge the integrity of the courts and has drawn sharp criticism from the magistrate.

Among the cases directly impacted is that of Chamara Chaturanga Marasinghe, a resident of Makandana in Gampaha, who was charged by the Gampaha Anti-Narcotics Division with possession of narcotics under two case numbers on the same day. Following his admission of guilt in one case, the police hastily initiated a second case related to the same incident.

The magistrate criticized this as an unfounded and oppressive tactic for filing charges, imposing a fine of 200,000 Sri Lankan Rupees on the accused, along with orders for the implicated police officers to provide the necessary funds. He also expressed serious dissatisfaction with the police's attempt to withdraw the fraudulent case, reinforcing the court's disapproval of their conduct.

While reviewing procedures within the police department, the magistrate highlighted the troubling trend of an increasing number of cases being filed, contradicting instructions meant to manage case loads effectively. He noted the risk that if this trend continues, the country would soon face a shortage of cases to assign, given the burgeoning population.

"For crime and drug suppression to be effective, the number of cases should decrease month by month. An increase indicates inefficiency within the police force. If cases continue to multiply at this rate, it could take another five years before the population even receives adequate attention in court," the magistrate stated in an open court session. Additionally, he pointed out discrepancies between the quantities of drugs presented in court and the official reports from forensic experts, revealing instances where case items allegedly did not contain any drugs at all.

The magistrate questioned police officials present regarding the directive issued to the Police Chief, emphasizing that he had intended for a nationwide directive to be applicable, rather than the circumventing communique submitted by the Deputy Inspector General. He condemned this attempt as a disgraceful effort to undermine the judiciary.

"In a country where even dreams are overturned by circulars, the inability to issue a circular within five months in response to a court order highlights a blatant disregard for judicial directives by police," the magistrate concluded, affirming that the case file would be forwarded to the Court of Appeal for legal proceedings against the Police Chief for contempt of court.
