කතානායක ඉල්ලා අස්වෙයි..?


 පාර්ලිමේන්තු කථානායක වෛද්‍ය ජගත් වික්‍රමරත්න මහතා නුදුරේදීම සිය ධුරයෙන් ඉල්ලා අස්වීමට බොහෝ දුරට ඉඩ ඇති බවට දේශපාලන හා සමාජ මාධ්‍ය ක්ෂේත්‍රයේ දැඩි කතාබහක් නිර්මාණය වී තිබේ.

ටැන්සානියාවේ පැවැත්යෙන අන්තර් පාර්ලිමේන්තු කමිටු රැස්වීමට සහභාගී වීමෙන් අනතුරුව ඒ මහතා මෙම තීරණය ගනු ඇති බවට වාර්තා පළ වේ.

ඔහුට එරෙහිව උද්ගතව ඇති බරපතළ නෛතික බාධා මෙන්ම, ඔහු ඉලක්ක කරගනිමින් කරළියට පැමිණ ඇති විශ්වාසභංග යෝජනාව ද මෙම තත්ත්වයට ප්‍රධාන හේතුව වී ඇති බව අනාවරණය වේ.

කථානායක ජගත් වික්‍රමරත්න මහතාට එරෙහිව කරුණු 50කින් සමන්විත විශ්වාසභංග යෝජනාවක් ද ඉදිරිපත් වී තිබේ. 

ආණ්ඩුක්‍රම ව්‍යවස්ථාව, දූෂණ විරෝධී පනත, රාජ්‍ය දේපළ පනත, තොරතුරු දැනගැනීමේ අයිතිය පිළිබඳ පනත මෙන්ම පාර්ලිමේන්තු ස්ථාවර නියෝග හිතාමතා උල්ලංඝනය කරමින් කටයුතු කර ඇතැයි එමඟින් ඔහුට එරෙහිව චෝදනා එල්ල කර ඇත.

එම විශ්වාසභංග යෝජනාව මඟින් මතු කර ඇති ප්‍රධාන චෝදනා -

    • බත්තරමුල්ල රාජමල්වත්ත නිල නිවස භාවිත කරමින් සිටියදී, ආයතන සංග්‍රහය උල්ලංඝනය කරමින් කොළඹ 04 ලෝරීස් පටුමගේ පිහිටි නිල නිවාස සංකීර්ණයෙන් ද නිල නිවසක් ලබාගෙන අයථා ලෙස පරිහරණය කිරීම.

    • රාජමල්වත්ත නිල නිවස වෙනුවෙන් පුද්ගලික කාර්ය මණ්ඩලයේ අටදෙනෙකු යොදවා පාර්ලිමේන්තු අරමුදලින් මසකට රුපියල් 760,000කට අධික වැටුප් හා දීමනා ගෙවමින් රාජ්‍ය මුදල් නාස්ති කිරීම සහ ඔහුගේ පුද්ගලික ලේකම්වරයාට ද නිල නිවසක් ලබා දීමට මැදිහත් වීම.

    • නිල නිවසේ ඉන්වෙන්ටරි ලේඛන අතුරුදන් වීම සහ අල්ලස් කොමිසම සිදුකරන විමර්ශනවලට බලපෑම් සහගත ලෙස මැදිහත් වීම.

    • කැබිනට් අනුමැතියකින් තොරව අනීතික ලෙස "කථානායක මාධ්‍ය ඒකකයක්" පවත්වාගෙන යමින් පාර්ලිමේන්තු දේපළ අවභාවිත කිරීම.

    • හිමිව ඇති වාහන සහ ඉන්ධන සීමාවන් ඉක්මවා යමින් පාර්ලිමේන්තුව සතු වෙනත් වාහන සහ ඉන්ධන අනීතිකව පරිහරණය කිරීම.

    • තොරතුරු දැනගැනීමේ පනත යටතේ ක්‍රියාකාරිකයන් ඉල්ලා සිටි තොරතුරු ලබා නොදෙන ලෙස පාර්ලිමේන්තු නිලධාරීන්ට ලිඛිත නියෝග නිකුත් කරමින් නීතිය උල්ලංඝනය කිරීම.

    • විපක්ෂයේ මන්ත්‍රීවරුන්ට පාර්ලිමේන්තුව තුළ අදහස් දැක්වීමට ඇති වරප්‍රසාද සීමා කිරීම, පාස්කු ඉරිදා ප්‍රහාරය පිළිබඳ විශ්වාසභංග යෝජනා සහ කොවිඩ් මෘතදේහ පිළිබඳ තේරීම් කාරක සභා යෝජනා අත්තනෝමතික ලෙස යටපත් කිරීම ඇතුළු පක්ෂග්‍රාහී ක්‍රියාකලාපයන් අනුගමනය කිරීම.

කථානායකවරයාට එරෙහිව මේ වන විටත් අල්ලස් හෝ දූෂණ විමර්ශන කොමිෂන් සභාව මඟින් විශේෂ පරීක්ෂණයක් ආරම්භ කර තිබේ. මෙවන් පසුබිමක, අල්ලස් කොමිසමේ කොමසාරිස් ධුරයක නිල කාලය එළඹෙන දෙසැම්බර් මාසයෙන් අවසන් වීමට නියමිත අතර, ඒ සඳහා නව කොමසාරිස්වරයෙකු පත් කිරීමට ආණ්ඩුක්‍රම ව්‍යවස්ථා සභාව මඟින් අයදුම්පත් කැඳවීමට තීරණය කර ඇත.

ආණ්ඩුක්‍රම ව්‍යවස්ථා සභාවේ සභාපතිත්වය නිල බලයෙන් හිමිවන්නේ කථානායකවරයාටය. තමන්ට එරෙහිව පරීක්ෂණයක් පවත්වන ආයතනයකට තීරණ ගන්නා කොමසාරිස්වරයෙකු පත් කිරීමේ ක්‍රියාවලියට කථානායකවරයා සම්බන්ධ වීම 2023 අංක 09 දරන දූෂණ විරෝධී පනතේ 107 (1) සහ (2) වගන්ති අනුව බරපතළ ‘ලබැඳියාවන් අතර ගැටුමක්’  නිර්මාණය කරයි.

 එවැනි ගැටුමක් පවතින අවස්ථාවක අදාළ නිල කටයුතුවලින් බැහැර විය යුතු බවට නීතියෙන් නියම කර ඇති අතර, ඊට පටහැනිව කටයුතු කිරීම වසර හතකට නොවැඩි සිරදඬුවමක් හෝ රුපියල් ලක්ෂයක දඩයක් හිමිවිය හැකි වරදකි. මෙම නීතිමය සංකූලතාව හමුවේ කථානායක ධුරයේ තවදුරටත් රැඳී සිටීම නීතිමය අවදානමක් වී ඇත.

අල්ලස් කොමිසමේ පරීක්ෂණ හමුවේ ආණ්ඩුක්‍රම ව්‍යවස්ථා සභාවේ කටයුතුවලට මැදිහත් වීමේ නීතිමය නොහැකියාවත්, කරළියට පැමිණ ඇති දැවැන්ත දූෂණ හා විෂමාචාර චෝදනා හමුවේ පාර්ලිමේන්තුවේ ගෞරවය රැකගැනීමේ අර්බුදයත් හේතුවෙන්, කථානායකවරයා ඉදිරි විදෙස් සංචාරය නිමවා පැමිණීමෙන් පසු සිය ධුරය අත්හැරීමට වැඩි ඉඩක් පවතින බව දේශපාලන ආරංචි මාර්ග තහවුරු කරයි.





Political Turmoil Surrounds Speaker Mahinda Yapa Abeywardena Amid Trust Vote Allegations

The political landscape in Sri Lanka is abuzz with speculation regarding the potential resignation of Speaker Mahinda Yapa Abeywardena. His decision has become a topic of intense debate following his participation in an inter-parliamentary committee meeting in Tanzania, where reports suggest he might step down from his position.

Abeywardena finds himself at the center of serious ethical concerns, particularly in light of a scandal involving a motion of no confidence that has surfaced, pointing to significant ramifications for his political future.

A no-confidence motion consisting of 50 allegations has been filed against the Speaker. These allegations cite violations of the constitution, the anti-corruption act, the public property act, and the right to information legislation, all asserting that he has acted in defiance of parliamentary norms.

Central to the allegations are claims that he misappropriated state resources, including:

    • Illegally occupying an official residence in Colombo while also using state funds for another, in violation of public asset guidelines.

    • Employing eight personal staff members through parliamentary funds, leading to substantial financial losses to the state, and intervening to provide an official residence to his personal secretary.

    • The disappearance of official inventory records and interference with investigations conducted by the Commission to Investigate Allegations of Bribery or Corruption.

    • Operating an unauthorized "Speaker's Media Unit" without cabinet approval, misusing parliamentary assets.

    • Illegally using other parliamentary vehicles and exceeding fuel limits assigned to him.

    • Violating the right to information law by instructing parliamentary officials to withhold requested information in writing.

    • Limiting opposition members' opportunities to express their views in parliament, suppressing discussions related to the Easter Sunday attacks and COVID-19-related matters through partisan measures.

An investigation into allegations of corruption and malfeasance against Abeywardena has already been initiated by the Commission to Investigate Allegations of Bribery or Corruption. With the term of the current commissioner set to conclude in December, the Constitutional Council has decided to call for applications to appoint a new commissioner.

The Speaker holds a significant role in the Constitutional Council, which raises concerns about the fairness and integrity of any appointments made within an institution investigating him. This situation potentially creates a serious ‘conflict of interest’, as defined by Article 107(1) and (2) of the anti-corruption act.

Engaging in actions while such a conflict exists could result in a maximum punishment of seven years in prison or a fine of up to one million rupees. Faced with this legal predicament, Abeywardena's continued tenure as Speaker appears increasingly precarious.

In light of the ongoing bribery commission investigation and growing allegations of corruption, sources suggest he is likely to resign upon returning from an upcoming foreign trip. The gravity of the allegations and the need to preserve the dignity of the parliament further suggest that he may opt to step down to navigate this political crisis.
