 පූජ්‍ය ගලගොඩඅත්තේ ඥානසාර හිමියන්ට ජනාධිපති සමාව ලබාදීමේ තීරණය ගනු ලැබුවේ මහා සංඝරත්නය, අමාත්‍යවරුන් සහ එවකට ජනාධිපති මෛත්‍රීපාල සිරිසේන මහතා සමඟ පැවති පුළුල් සාකච්ඡාවලින් අනතුරුව බව හිටපු ජනාධිපති රනිල් වික්‍රමසිංහ මහතා ප්‍රකාශ කරයි.

කොළඹ පිහිටි එක්සත් ජාතික පක්ෂ දේශපාලන කාර්යාලයේදී පැවති පක්ෂ නීතිඥවරුන්ගේ හමුවක් අමතමින් හිටපු ජනාධිපතිවරයා සඳහන් කළේ, ඥානසාර හිමියන් සිරදඬුවම් විඳින කාලසීමාව තුළ උන්වහන්සේගේ සිවුර  හැරවීමේ බරපතළ අවදානමක් සම්බන්ධයෙන් එකල දැඩි අවධානයක් යොමුව තිබූ බවයි. හෝමාගම මහේස්ත්‍රාත් අධිකරණයේ කටයුතුවලට බාධා කිරීමේ සිදුවීමකට අදාළව අභියාචනාධිකරණය මගින් උන්වහන්සේට සිරදඬුවම් නියම කිරීමත් සමඟ මෙම ගැටලුව මතු වූ බව හෙතෙම පෙන්වා දුන්නේය.

එම අවස්ථාවේදී ඥානසාර හිමියන්ගේ සිවුර අහිමි නොවන බවට එවකට අධිකරණ අමාත්‍ය විජයදාස රාජපක්ෂ මහතා විසින් පූජ්‍ය කොටපිටියේ රාහුල හිමියන් වෙත යවන ලද සහතික කිරීමේ ලිපියක් ද තමන් සතුව තිබූ බව වික්‍රමසිංහ මහතා සිහිපත් කළේය.

අනතුරුව භික්ෂූන් වහන්සේලා කිහිප නමක් තමන් හමුවී සංඝ විනය සම්ප්‍රදායන් පැහැදිලි කළ බවත්, පාරාජිකා ගණයට අයත් නොවන වරදක් සම්බන්ධයෙන් භික්ෂුවකගේ සිවුරු හැරවීම බරපතළ ආගමික හා ආණ්ඩුක්‍රම ව්‍යවස්ථාමය ගැටලු නිර්මාණය කරනු ඇති බවට උන්වහන්සේලා පෙන්වා දුන් බවත් ඔහු පැවසීය.

අධිකරණයට අපහාස කිරීම හෝ බාධා කිරීම භික්ෂූන් වහන්සේ නමකට නොගැළපෙන හැසිරීමක් බව පෙන්වා දුන් එම මහා සංඝරත්නය, ඊට එරෙහි විනය පියවර අදාළ ශාසනික අධිකාරීන් හරහා ගත හැකි බව සඳහන් කළ බවද හිටපු ජනාධිපතිවරයා කියා සිටියේය.

ජනාධිපති සමාව ලබාදීමේ ව්‍යවස්ථාපිත බලය හිමිව තිබූ එවකට ජනාධිපති මෛත්‍රීපාල සිරිසේන මහතා සමඟ අනතුරුව මෙම කරුණ සාකච්ඡා කළ බව සඳහන් කළ වික්‍රමසිංහ මහතා, ඒ වන විටත් ඥානසාර හිමියන් වසරක සිරදඬුවම් කාලයක් ගෙවා අවසන් කර තිබීම සැලකිල්ලට ගනිමින් මෙම තීරණයට එළඹුණු බව සඳහන් කළේය. මෙම සමාව ලබාදීමට පෙර ඒ පිළිබඳව කැබිනට් මණ්ඩලය තුළ මෙන්ම අමාත්‍යවරුන් කිහිප දෙනෙකු සමඟ ද සාකච්ඡා පැවැත්වූ බව හෙතෙම වැඩිදුරටත් අනාවරණය කළේය.

ජනාධිපති සමාව ප්‍රදානය කරන සෑම අවස්ථාවකදීම ඊට අදාළ හේතු සාධක ලිඛිතව ඉදිරිපත් කිරීම සාමාන්‍ය සිරිත නොවන බවත්, නිදහස් දිනය හෝ වෙසක් පොහොය වැනි විශේෂ අවස්ථාවලදී ද සිරකරුවන්ගේ දඬුවම් ලිහිල් කර නිදහස් කරනු ලබන්නේ එවැනි සම්ප්‍රදායක් මත බවත් ඔහු පෙන්වා දුන්නේය.

ඥානසාර හිමියන් නිදහස් කිරීමේදී ද ක්‍රියාත්මක වූයේ එම ක්‍රමවේදයම බව සඳහන් කළ රනිල් වික්‍රමසිංහ මහතා, මෙම සමාව තමන් පෞද්ගලිකව ලබා දුන් එකක් නොවන බවත්, එය එවකට ජනාධිපතිවරයා ලෙස මෛත්‍රීපාල සිරිසේන මහතා විසින් ගන්නා ලද නිල තීරණයක් බවත් අවධාරණය කළේය.

Former President Ranil Wickremesinghe Discusses Presidential Pardon for Venerable Gnanasara Thera

The decision to grant a presidential pardon to Venerable Gnanasara Thera followed extensive discussions involving the Maha Sangha, cabinet ministers, and then-President Maithripala Sirisena, according to former President Ranil Wickremesinghe.

Addressing a gathering of party lawyers at the United National Party's political office in Colombo, Wickremesinghe revealed that there had been significant concerns regarding the risks associated with the potential loss of the monk's status during his incarceration. This issue arose in relation to a ruling by the Court of Appeal that imposed a prison sentence, which related to an incident obstructing the activities of the Homagama Magistrate's Court.

Wickremesinghe reminisced about receiving a letter from then-Minister of Justice Wijeyadasa Rajapakshe that assured the preservation of Gnanasara Thera's status as a monk. This correspondence had been directed to Venerable Rahula of Kotapitiya.

During this period, several monks clarified the nuances of monastic discipline, emphasizing that revoking a monk's status for actions not classified under certain offenses could lead to serious religious and constitutional challenges.

The Maha Sangha articulated that any conduct perceived as disrespecting the judiciary would not align with the expected behavior of a monk. They noted that disciplinary measures could be pursued through the relevant ecclesiastical authorities.

Wickremesinghe indicated that he later discussed the matter with then-President Maithripala Sirisena, who held constitutional authority to grant pardons. He considered the fact that Gnanasara Thera had already served a year in prison before making this decision.

Following consultations within the Cabinet and discussions with several ministers, Wickremesinghe revealed that it was understood that the practice of presenting written justifications for presidential pardons is not a standard protocol. He pointed out that leniency in sentencing is typically observed on special occasions, such as independence day or Vesak Poya. The same principles were applied in granting freedom to Gnanasara Thera.

Emphasizing that the pardon was not a personal act, Wickremesinghe clarified that it was an official decision made by then-President Maithripala Sirisena in his capacity as president at that time.
