විනිසුරුවරුන්ගේ විශ්‍රාම වයස දීර්ඝ කිරීම සඳහා රජය ගෙන ඇති තීරණය, දූෂිතයන්ට එරෙහිව නීතිය ක්‍රියාත්මක කිරීමට සහ අධිකරණ පද්ධතියේ කාර්යක්ෂමතාව ඉහළ නැංවීමට ගත් වැදගත් පියවරක් බව 'ජනවරමේ නීතිඥයෝ' සංවිධානය පවසයි.

කොළඹ පැවැති මාධ්‍ය හමුවකට එක්වෙමින් එම සංවිධානයේ නියෝජිත නීතිඥ අකලංක උක්වත්ත මහතා සඳහන් කළේ, මෙම සංශෝධනය 2024 වසරේදී ජනතාව ලබාදුන් ජනවරමේ බලාපොරොත්තු ඉටුකිරීමක් බවයි.

"මහජනතාව බලාපොරොත්තු වන ප්‍රධාන අරමුණක් තමයි හොරු ඇල්ලීම සහ දූෂණය පිටුදැකීම. ඒ සඳහා අධිකරණ ක්‍රියාවලිය ඉතා සක්‍රීයව පවත්වාගෙන යා යුතුයි. පළපුරුදු සහ පරිණත විනිසුරුවරුන්ගේ සේවය තවදුරටත් ලබා ගැනීම හරහා අධිකරණ පද්ධතියේ පවතින බාධාවන් ඉවත් කරගත හැකියි.

ඕස්ට්‍රේලියාවේ සහ ඩෙන්මාර්කයේ විනිසුරුවන්ගේ විශ්‍රාම වයස අවුරුදු 70ක්. කැනඩාව සහ බ්‍රසීලය වැනි රටවල එය අවුරුදු 75ක් දක්වා දීර්ඝ කර තිබෙනවා. අමෙරිකාවේ විනිසුරුවරුන් සඳහා නිශ්චිත විශ්‍රාම වයසක් පවා නැහැ. ඒ නිසා මෙය ලංකාවට පමණක් සීමා වූ අමුතු දෙයක් නොවෙයි" යැයි ඔහු පැවසීය.

දිසා විනිසුරුවරුන් සහ මහේස්ත්‍රාත්වරුන් වයස අවුරුදු 60න් විශ්‍රාම යාම වෙනුවට තවත් වසර දෙකක කාලයක් සේවයේ රඳවා ගැනීම හරහා ඔවුන්ගේ අත්දැකීම්වලින් උපරිම ප්‍රයෝජන ගත හැකි බව ද උක්වත්ත මහතා පෙන්වා දුන්නේය. පහළ අධිකරණවල සිට ඉහළ අධිකරණ දක්වා විනිසුරුවරුන් පත්වීමේ ක්‍රියාවලිය විධිමත් කිරීමට ද මෙය ඉවහල් වන බව ඔහු සඳහන් කළේය.

මෙම සංශෝධනයට විරුද්ධ වන පාර්ශවයන්ගෙන් ප්‍රශ්න කර සිටි නීතිඥවරයා, ඔවුන් මෙම පියවරට අකමැති වන්නේ ඇයිද යන්න පිළිබඳව පැහැදිලි හේතු ඉදිරිපත් කළ යුතු බව ද අවධාරණය කළේය. සුළු පිරිසක් විසින් ජනතාව නොමග යැවීමට උත්සාහ කළ ද, අධිකරණයේ ස්වාධීනත්වය ආරක්ෂා කරමින් නඩු කටයුතු කඩිනම් කිරීම රජයේ මෙන්ම ජනතාවගේ ද අපේක්ෂාව බව ඔහු වැඩිදුරටත් ප්‍රකාශ කළේය.

Government's Decision to Raise Retirement Age for Judges Welcomed as a Critical Step

The decision by the Sri Lankan government to increase the retirement age for judges has been hailed as a significant move towards enforcing the law against corruption and enhancing the efficiency of the judicial system, according to the 'Janavarma Legal Association.'

At a recent press conference in Colombo, legal representative Akalanka Ukwatta emphasized that this amendment reflects the hopes of the public expressed during the 2024 elections.

"One of the main goals of the public is to combat theft and address corruption. For this, the judicial process must remain highly active. Extending the service of experienced and competent judges can help eliminate existing barriers within the judicial system," Ukwatta pointed out.

He further noted that in countries like Australia and Denmark, judges retire at the age of 70, while nations such as Canada and Brazil have extended it to 75. The United States does not even have a set retirement age for judges, indicating that this is not an unusual practice limited to Sri Lanka.

Ukwatta also highlighted that district judges and magistrates could continue serving for an additional two years beyond the age of 60. This extension would maximize their experience and contribute positively to the streamlined appointment process from lower to higher courts.

A lawyer opposing the amendment raised concerns, stressing that clear reasons should be presented regarding the reluctance towards this change. While a small faction attempts to mislead the public, Ukwatta reiterated that expediting court processes while safeguarding the independence of the judiciary aligns with both government and public expectations.
