වත්මන් ආණ්ඩුක්‍රම ව්‍යවස්ථාවට අනුව අධිකරණ බලය යනු ජනතාවගේ පරමාධිපත්‍යයේ කොටසක් බවත්, එවැනි වැදගත් ව්‍යුහයක වෙනසක් සිදු කරන්නේ නම් එය අනිවාර්යයෙන්ම ජනමත විචාරණයකට යොමු කළ යුතු බවත් ඒ මහතා පවසයි.

"විශ්‍රාම යන වයස තීරණය කර තිබෙන්නේ යම් ප්‍රතිපත්තියක් මතයි. 1978 ව්‍යවස්ථාව සකස් කළ අය ඉතා බුද්ධිමත් ලෙස අධිකරණයේ ස්වාධීනත්වය ආරක්ෂා වන පරිදි මෙම වගන්ති ඇතුළත් කර තිබෙනවා. දැන් සිදුවන්නේ එම ස්වාධීනත්වය දේශපාලන අවශ්‍යතා මත පාවා දීමක්," යැයි සරත් එන්. සිල්වා මහතා වැඩිදුරටත් ප්‍රකාශ කළේය.

විනිසුරුවරුන්ගේ වයස ඉහළ දැමීම හරහා අධිකරණ පද්ධතියේ කාර්යක්ෂමතාව අඩුවිය හැකි බව පෙන්වා දෙන ඒ මහතා, පැරණි විනිසුරුවරුන් දිගින් දිගටම සේවයේ රැඳී සිටීම නිසා තරුණ සහ දක්ෂ විනිසුරුවරුන්ට ඉහළ තනතුරුවලට පැමිණීමට ඇති අවස්ථාව ඇහිරී යන බව ද සඳහන් කළේය.

ඇමරිකාව හෝ බ්‍රිතාන්‍යය වැනි රටවල පවතින ක්‍රමවේද මෙරටට ආදේශ කිරීම ප්‍රායෝගික නොවන බවත්, ලංකාවේ ව්‍යවස්ථාව මෙරටට අනන්‍ය වූ බුද්ධිමය පදනමක් මත සකස් වී ඇති බවත් ඔහු පෙන්වා දෙයි.

අධිකරණයේ ස්වාධීනත්වය රැක ගැනීම වෙනුවෙන් මෙවැනි පැලැස්තර විසඳුම් යෙදීම වහාම නතර කළ යුතු බවත්, මෙම සංශෝධනය හරහා අධිකරණය කෙරෙහි පවතින මහජන විශ්වාසය පළුදු වන බවත් හිටපු අගවිනිසුරුවරයා මෙම සාකච්ඡාවේදී අවධාරණය කර සිටියේය.

Concerns Raised Over Government's Decision to Raise Retirement Age for Judges

Former Chief Justice Sarath N. Silva has condemned the government's decision to increase the retirement age of Supreme Court and Court of Appeal judges, describing it as a severe blow to the independence of the judiciary. His remarks came during a special interview with Hiru TV, where he emphasized the implications this move has on constitutional policies and the supremacy of the people’s power.

Silva expressed his staunch opposition to the decision, characterizing it as a "bribe" offered to judges by the government. He highlighted that the current constitution recognizes judicial authority as part of the people's sovereignty, arguing that any significant change to such a structure should undergo public scrutiny and consultation.

“The determination of retirement age is based on specific policies. The framers of the 1978 constitution prudently included provisions to safeguard the independence of the judiciary. What is happening now is a compromise of that independence to satisfy political necessities,” he stated.

He warned that raising the retirement age for judges could lead to inefficiencies in the judicial system, as older judges remaining in service would stifle opportunities for younger, competent attorneys to ascend to higher positions within the judiciary.

Silva noted that replicating judicial frameworks from countries like the United States or the United Kingdom is impractical, arguing that Sri Lanka's constitution is crafted on a distinct intellectual foundation unique to the country.

He stressed that such amendments undermining judicial independence must be halted immediately, as they could erode public trust in the judiciary, a point he reiterated during the discussion.
