වත්කම් ප‍්‍රකාශවල පුද්ගලික දත්ත රකින්න නීති තද කරයි.. වෙනත් වැඩවලට ගන්න බැරි කරයි..


 2023 අංක 9 දරන දූෂණ විරෝධී පනත සඳහා රජය විසින් හඳුන්වා දෙන ලද නව සංශෝධන මාලාවක් ගැසට් පත්‍රයක් මගින් ප්‍රකාශයට පත් කර තිබේ.

මෙම නව සංශෝධන මගින් දූෂණ ක්‍රියා හරහා උපයා ගන්නා දේපළ සම්බන්ධයෙන් පනවන දඩ මුදල් ඉහළ නැංවීම සහ ඇප ලබාදීමේ කොන්දේසි දැඩි කිරීම කෙරෙහි විශේෂ අවධානයක් යොමු කර ඇත.

නව සංශෝධනයට අනුව, යම් පුද්ගලයෙකු දූෂණ ක්‍රියාවක් මගින් දේපළක් අත්පත් කරගෙන හෝ පරිවර්තනය කර ඇති බවට අධිකරණය හමුවේ වරදකරු වුවහොත්, එම දේපළේ වටිනාකම මෙන් තුන් ගුණයකට නොඅඩු අතිරේක දඩයක් පැනවීම අධිකරණයට අනිවාර්ය වේ.

මීට පෙර පැවති පනත යටතේ දූෂණ වරදකට උපරිම දඬුවම වූයේ වසර 10 නොඉක්මවන බරපතල වැඩ සහිත සිරදඬුවමක් සහ රුපියල් මිලියනයක දඩයකි. එසේම, දූෂණ ක්‍රියාවක් හේතුවෙන් රජයට මූල්‍යමය අලාභයක් සිදුව ඇත්නම්, එම සම්පූර්ණ අලාභයට සමාන මුදලක් අතිරේක දඩයක් ලෙස අය කර ගැනීමට ද නව සංශෝධනය මගින් ප්‍රතිපාදන සලසා ඇත.

බරපතල දූෂණ චෝදනා සම්බන්ධයෙන් ඇප ලබාදීමේ ක්‍රියාවලිය ද නව සංශෝධනය මගින් දැඩි කර තිබේ. රුපියල් ලක්ෂයකට නොඅඩු අල්ලසක් ලබා ගැනීම, දීම හෝ ඉල්ලා සිටීම සහ රුපියල් ලක්ෂ පහකට නොඅඩු රජයේ පාඩුවක් සිදු කිරීම වැනි චෝදනා සම්බන්ධයෙන් සැකකරුවන්ට ඇප ලබා දිය හැක්කේ මහාධිකරණයට පමණි. ඒ ද සුවිශේෂී කරුණු මත පදනම්ව පමණක් වන අතර, මහේස්ත්‍රාත් අධිකරණයට එවැනි සැකකරුවන්ට ඇප ලබා දීමේ බලය මෙමගින් සීමා වේ.

වත්කම් ප්‍රකාශන ප්‍රසිද්ධ කිරීමේදී පුද්ගලික දත්ත ආරක්ෂා කිරීම සම්බන්ධයෙන් ද නව නීති හඳුන්වා දී ඇත. ප්‍රසිද්ධ කරන ලද වත්කම් ප්‍රකාශනයක් බලයලත් නිලධාරියෙකුට හෝ ආයතනයකට ඉදිරිපත් කිරීම හැර වෙනත් ඕනෑම කාර්යයක් සඳහා භාවිත කිරීම වරදක් ලෙස නම් කර තිබේ. එවැනි වරදකට රුපියල් ලක්ෂයක දඩයක් හෝ වසරක සිරදඬුවමක් හෝ එම දඬුවම් දෙකම පැනවිය හැකිය.

තවද, මීට පෙර පැවති පනත අනුව වත්කම් ප්‍රකාශකයා සමඟ මාස හයකට වඩා වැඩි කාලයක් එකට වාසය කරන පුද්ගලයන්ගේ වත්කම් ද හෙළි කළ යුතු වුවත්, පුද්ගලිකත්වය ආරක්ෂා කිරීමේ අරමුණින් එම අවශ්‍යතාව නව සංශෝධනය මගින් ඉවත් කර ඇත.

මෙම සංශෝධනයේ ඇති තවත් සුවිශේෂී කරුණක් වන්නේ නියමිත ආයතන ලෙස සැලකෙන ආයතනවල රජයේ කොටස් ප්‍රතිශතය වෙනස් කිරීමයි. මීට පෙර රජයට 25% ක කොටස් හිමිකමක් ඇති සමාගම් ද මෙම පනතට යටත් වූ අතර, නව සංශෝධනය මගින් එම සීමාව 50% දක්වා ඉහළ නංවා ඇත. මේ අනුව, රජයට 50% ට අඩු කොටස් හිමිකමක් ඇති සමාගම්වල අධ්‍යක්ෂවරුන් හෝ සේවකයන් මින් ඉදිරියට "රාජ්‍ය නිලධාරීන්" ලෙස මෙම පනත යටතේ සලකනු නොලැබේ.

වත්කම් ප්‍රකාශනවලින් ඉවත් කළ යුතු පෞද්ගලික දත්ත ගණයට ජාතික හැඳුනුම්පත් අංකය සහ විදේශ ගමන් බලපත්‍ර අංකය වැනි හඳුනාගැනීමේ අංකවලට අමතරව, අදාළ බලධාරීන් විසින් හඳුනාගැනීම සඳහා භාවිත කරන වෙනත් ඕනෑම අංකයක් ද ඇතුළත් කරමින් පෞද්ගලික දත්ත ආරක්ෂාව තවදුරටත් පුළුල් කර ඇත.





New Amendments to Anti-Corruption Legislation Introduced by Government

In a significant move against corruption, the government has announced a series of new amendments to the Anti-Corruption Act, released via a gazette notification. These amendments specifically aim to enhance penalties related to assets acquired through corrupt practices and tighten the conditions surrounding bail provisions.

The latest changes stipulate that if an individual is found guilty of obtaining or converting property through corrupt activities, the court is mandated to impose an additional fine amounting to no less than three times the value of that property.

Previously, under existing legislation, the maximum penalty for corruption-related offenses included a heavy imprisonment term not exceeding ten years coupled with a fine of one million rupees. The new amendments also introduce provisions allowing for an additional fine equivalent to the total financial loss incurred by the government due to corrupt actions.

The bail process for serious corruption charges has been significantly fortified by the new amendments. Individuals facing charges related to bribes of one hundred thousand rupees or more, or causing a governmental loss of five hundred thousand rupees or more, can only receive bail from the Supreme Court. This restriction places further limitations on the powers of Magistrate Courts concerning such suspects.

Additionally, new regulations concerning the protection of personal data in asset declarations have been introduced. Any use of a publicly disclosed asset declaration for purposes other than presenting it to an authorized official or institution is now classified as an offence, punishable by a fine of one hundred thousand rupees or a one-year imprisonment sentence, or both.

Moreover, while the previous law required individuals living with the asset declarant for more than six months to disclose their assets, this obligation has been removed under the latest amendments in the interest of protecting privacy.

Another noteworthy feature of this amendment is the adjustment of the government's shareholding threshold in entities deemed as prescribed organizations. Previously, companies with a minimum of 25% government ownership fell under this jurisdiction, but the new flip has raised this limit to 50%. Consequently, individuals associated with companies holding less than 50% government stake will no longer be classified as “state officials” under this legislation.

The amendments further reinforce the protection of personal data by expanding the types of identifying numbers that must be excluded from asset declarations, including national ID numbers and passport numbers, along with any other identifiers utilized by relevant authorities.
