2019 පාස්කු ඉරිදා ෂැංග්රිලා හෝටලයේ සිදුවූ මරාගෙන මැරෙන බෝම්බ ප්රහාරයෙන් තුවාල ලැබූ නීතිඥවරයෙකු විසින් ගොනු කරන ලද සිවිල් වන්දි නඩුවක විත්තිකරුවන් ලෙස නම් කර සිටි හිටපු ආරක්ෂක ලේකම් හේමසිරි ප්රනාන්දු සහ හිටපු පොලිස්පති පූජිත් ජයසුන්දර එම නඩුවෙන් ඉවත් කිරීමට කොළඹ දිස්ත්රික් අධිකරණය (06) අවසර ලබා දුන්නේය.
මෙම නඩුව පවරා තිබුණේ ප්රහාරයෙන් බරපතල තුවාල ලබා ස්ථිර ආබාධිත තත්ත්වයට පත්වූ නීතිඥ මෝදිත ටී.බී. ඒකනායක මහතා විසිනි. තමන්ට සිදුවූ බරපතල තුවාල, ආබාධිත තත්ත්වය සහ වෛද්ය වියදම් වෙනුවෙන් රුපියල් මිලියන 500ක වන්දියක් ඔහු මෙමගින් ඉල්ලා තිබේ.
හිටපු ජනාධිපතිවරුන් වන මෛත්රීපාල සිරිසේන සහ රනිල් වික්රමසිංහ, හිටපු ආරක්ෂක ලේකම් හේමසිරි ප්රනාන්දු, හිටපු පොලිස්පති පූජිත් ජයසුන්දර සහ නීතිපතිවරයා ඇතුළු විත්තිකරුවන් 12 දෙනෙකුට එරෙහිව මෙම නඩුව මුලින් ගොනු කර තිබුණි.
ප්රහාරය වැළැක්වීමට විත්තිකරුවන් නිසි පියවර නොගත් බවට පැමිණිලිකරු චෝදනා කර ඇති අතර, රජයේ නිලධාරීන්ගේ නොසලකා හැරීම සම්බන්ධයෙන් රජයට ඇති වගකීම මත නීතිපතිවරයා ද මෙහි විත්තිකරුවෙකු කර ඇත.
නඩුව කැඳවූ අවස්ථාවේදී පැමිණිලිකාර ඒකනායක මහතා අධිකරණයට දන්වා සිටියේ 3 වන සහ 4 වන විත්තිකරුවන් ලෙස නම් කර සිටි හේමසිරි ප්රනාන්දු සහ පූජිත් ජයසුන්දර යන මහත්වරුන්ට එරෙහිව නඩුව ඉදිරියට ගෙන යාමට තමන් අදහස් නොකරන බවයි.
පාස්කු ප්රහාරය සම්බන්ධයෙන් කොළඹ මහාධිකරණයේ ත්රිපුද්ගල විනිසුරු මඩුල්ලක් හමුවේ පැවති නඩුවකින් ඔවුන් දෙදෙනාට දැනටමත් මරණ දඬුවම නියම වී ඇති බැවින් මෙම තීරණය ගත් බව ඔහු සඳහන් කළේය.
සෙසු විත්තිකරුවන්ගේ නීතිඥවරුන් මීට විරෝධය පළ නොකළ අතර, ඒ අනුව ඔවුන් දෙදෙනා නඩුවෙන් ඉවත් කිරීමට අධිකරණය අවසර දුන්නේය. මීට පෙර අවස්ථාවකදී පැමිණිලිකරුගේ ඉල්ලීම මත හිටපු ජනාධිපති රනිල් වික්රමසිංහ මහතා ද මෙම නඩුවෙන් නිදහස් කර තිබුණි.
මේ අතර, හිටපු ජනාධිපති මෛත්රීපාල සිරිසේන මහතා වෙනුවෙන් පෙනී සිටි නීතිඥ පුලස්ති රූපසිංහ මහතා අධිකරණයට දන්වා සිටියේ තම සේවාදායකයාට එරෙහිව මෙම නඩුව පවත්වාගෙන යාමට ඇති නීතිමය හැකියාව තමන් අභියෝගයට ලක් කරන බවයි.
ඒ අනුව, අදාළ මූලික විරෝධතාවයට අදාළ ලිඛිත දේශන ඉදිරිපත් කරන ලෙස සෙසු විත්තිකරුවන්ට නියෝග කළ දිස්ත්රික් අධිකරණය, නඩුව ඔක්තෝබර් 19 වනදා දක්වා කල් තැබීය.
Colombo Court Releases Former Officials from Easter Bombing Civil Case
A Colombo District Court has permitted the removal of former Secretary of Defence Hemasiri Fernando and former Inspector General of Police Pujith Jayasundara from a civil compensation case, which was initiated by an attorney injured in the devastating 2019 Easter Sunday bomb attacks at the Shangri-La Hotel.
The suit was filed by lawyer Moditha T.B. Ekanayake, who sustained severe injuries that have left him in a permanent disablement. He is claiming a compensation amounting to 500 million rupees for the serious injuries, resulting disabilities, and medical expenses he incurred.
Initially, the case was brought against 12 defendants, including former Presidents Maithripala Sirisena and Ranil Wickremesinghe, as well as Fernando and Jayasundara, along with the Attorney General. Ekanayake alleged that the defendants failed to take necessary measures to prevent the attack, thereby increasing governmental accountability concerning the negligence of state officials.
During the hearing, Ekanayake informed the court that he does not wish to proceed with the case against the two prominent defendants, Fernando and Jayasundara, who were specifically mentioned as the third and fourth respondents in the suit.
He pointed out that both had already been sentenced to death in a separate case related to the Easter attacks, which influenced his decision to withdraw the case against them.
No objections were raised by the legal representatives of the other defendants, leading the court to grant the removal of Fernando and Jayasundara from the proceedings. Previously, former President Ranil Wickremesinghe had also been released from the case at Ekanayake's request.
Meanwhile, attorney Pulasti Rupasinghe, representing former President Maithripala Sirisena, challenged the legal capability to proceed against his client. The District Court then mandated the remaining defendants to submit written objections concerning the fundamental challenge by October 19.
