පාර්ලිමේන්තුවට ඉදිරිපත් කිරීමට නියමිත වරලත් මාධ්යවේදීන්ගේ ආයතනය පිහිටුවීම සඳහා වන පනත් කෙටුම්පතට එරෙහිව නිදහස් මාධ්ය ව්යාපාරය මූලික අයිතිවාසිකම් පෙත්සමක් ගොනු කොට තිබේ.
එහි සාමාජිකයන් වන උදය කළුපතිරණ සහ සුනිල් ජයසේකර පෙත්සම්කරුවන් ලෙස පෙනී සිටින අතර නීතිඥ ලක්ෂාන් ඩයස් මගින් පෙත්සම ගොනුකොට ඇත.
පෙත්සම මගින් වග උත්තරකරුවන් ලෙස නම් කොට ඇත්තේ නීතිපතිවරයා, ජනමාධ්ය අමාත්යවරයා සහ එම අමාත්යංශයේ ලේකම්වරයාය.
අද එම පෙත්සම සළකා බැලූ ශ්රේෂ්ඨාධිකරණය නියම කළේ අගෝස්තු 11 වන දිනට ලිඛිතව කරුණු දක්වන ලෙසයි.
අදාළ පනත් කෙටුම්පත සම්මත වී, යෝජිත ආයතනය ස්ථාපිත කරනු ලැබුවහොත්, ආණ්ඩුක්රම ව්යවස්ථාවෙහි සඳහන් මූලික අයිතිවාසිකමක් වන භාෂණයේ සහ ප්රකාශනයේ නිදහසට සීමා පැනවෙනු ඇතැයි යන්න පෙත්සම්කරුවෝ කියා සිටිති.
එසේම යෝජිත පනත් කෙටුම්පතෙහි ඇතැම් නිර්වචන සහ අර්ථ දැක්වීම් මගින් පොදු පුරවැසියාගේ මෙන්ම ඔන්ලයින් අන්තර්ගත ඉදිරිපත් කරන්නන්ගේද අයිතිවාසිකම් සීමා කළ හැකි බව ඔවුන්ගේ තර්කයයි.
එසේම අදාළ ආයතනය පිහිටු වීමේ පළමු පියවර වන අතුරු කමිටුව පත් කිරීම රාජ්ය යාන්ත්රණයේ අභිලාෂය මත පමණක් පදනම් වන අතර එමගින් නිර්මාණය වන රීති ඔස්සේ දැඩි ලෙස පාලනයට නතු වූ ආයතනයක් බිහිවනු ඇත.
පෙත්සම්කරුවන් අධිකරණයෙන් ඉල්ලා සිටින්නේ යෝජිත පනත් කෙටුම්පත සංශෝධනවලින් තොරව සම්මත වීමට නම් පාර්ලිමේන්තුවේ විශේෂ බහුතරයකින් මෙන්ම ජනමත විචාරණයකින්ද සම්මත විය යුතු බවයි.
Media Freedom Advocates Challenge Proposed Legislation for Media Agency
A petition against a proposed bill to establish a regulatory agency for media personnel has been filed by advocates for press freedom. This initiative aims to protect fundamental rights related to media operations in Sri Lanka.
Among the petitioners are prominent figures Uday Kalupahana and Sunil Jayasekara, with the legal document submitted by attorney Lakshan Dias.
The respondents listed in the petition include the Attorney General, the Minister of Media, and the Secretary of the Ministry, indicating a significant contention regarding the bill.
Today, the Supreme Court took up the petition and has ordered a written response by August 11.
The petitioners argue that if the proposed bill is enacted and the agency is established, it would impose restrictions on the fundamental rights of freedom of speech and expression as outlined in the Constitution.
Furthermore, they contend that certain definitions and interpretations within the draft legislation could limit the rights of not just ordinary citizens but also online content creators.
The initial step toward the establishment of this agency, the appointment of an interim committee, appears to be based solely on political aspirations, which could lead to the creation of a heavily governed institution.
The petitioners are urging the court to ensure that if the proposed legislation is to be approved, it must receive a special majority in Parliament as well as a public referendum, free from any amendments.
