කතානායක හුටපටේ ජාත්‍යත්තරයෙත් දිගහැරේ..

 කථානායක ජගත් වික්‍රමරත්න මහතාට එරෙහිව අල්ලස් හෝ දූෂණ චෝදනා විමර්ශන කොමිෂන් සභාව මගින් පරීක්ෂණයක් පවත්වන පසුබිමක, ඒ සම්බන්ධයෙන් තමන් පාර්ලිමේන්තුවට ඉදිරිපත් කිරීමට උත්සාහ කළ වරප්‍රසාද ප්‍රශ්නය යටපත් කරමින් කථානායකවරයා සිය භාෂණයේ නිදහස සහ පාර්ලිමේන්තු වරප්‍රසාද උල්ලංඝනය කර ඇතැයි චෝදනා කරමින් පාර්ලිමේන්තු මන්ත්‍රී දයාසිරි ජයසේකර මහතා පොදුරාජ්‍ය මණ්ඩලීය පාර්ලිමේන්තු සංගමය වෙත නිල වශයෙන් පැමිණිලි කර තිබේ.

පොදුරාජ්‍ය මණ්ඩලීය පාර්ලිමේන්තු සංගමයේ සභාපතිනී රෙෆිල්වේ ට්ෂ්වේනි-ත්සිපානේ  සහ එහි මහලේකම් ස්ටීවන් ට්විග් යන මහත්ම මහත්මීන් වෙත ලිපියක් යොමු කරමින් කුරුණෑගල දිස්ත්‍රික් පාර්ලිමේන්තු මන්ත්‍රී දයාසිරි ජයසේකර මහතා මේ බව දැනුම් දී ඇත.

ශ්‍රී ලංකා පාර්ලිමේන්තුවේ ආයතනික අපක්ෂපාතීත්වය, මන්ත්‍රීවරුන්ගේ වරප්‍රසාද සහ භාෂණයේ නිදහස ආරක්ෂා කර ගැනීම සඳහා වහා මැදිහත් වන ලෙස ඉල්ලා සිටින මන්ත්‍රීවරයා, එම ලිපිය මගින් කරුණු කිහිපයක් අනාවරණය කර තිබේ.

කථානායකවරයාගේ නිල රාජකාරීවලට අදාළ කාරණයක් සම්බන්ධයෙන් අල්ලස් කොමිසම මගින් විමර්ශනයක් සිදු කෙරෙමින් පවතින අවස්ථාවක, ඔහු තවදුරටත් කථානායක ධුරයේ කටයුතු කිරීම සම්බන්ධයෙන් තමන් විසින් පසුගිය සැප්තැම්බර් 10 වන දින වරප්‍රසාද ප්‍රශ්නයක් යොමු කළ බව මන්ත්‍රීවරයා පෙන්වා දෙයි.

මෙම වරප්‍රසාද ගැටලුව පාර්ලිමේන්තු ආචාර ධර්ම සහ වරප්‍රසාද පිළිබඳ කාරක සභාව වෙත යොමු කිරීමට අපේක්ෂා කළද, ඒ පිළිබඳව තමන් විසින්ම අධ්‍යයනය කළ යුතු බව පවසමින් කථානායකවරයා ඊට අවසර දීම ප්‍රතික්ෂේප කළ බව හෙතෙම සඳහන් කරයි.

චෝදනාවට ලක්ව ඇති පුද්ගලයාම තමන්ට අදාළ පැමිණිල්ල විභාග කරන්නේද නැද්ද යන්න තීරණය කිරීම ස්වාභාවික යුක්තියේ මූලධර්මවලට පටහැනි මෙන්ම ආයතනික අපක්ෂපාතීත්වය බරපතළ ලෙස ප්‍රශ්න කෙරෙන්නක් බව දයාසිරි ජයසේකර මහතා පෙන්වා දෙයි.

එසේම වෙනත් විවාදයකදී මේ පිළිබඳව කරුණු දැක්වීමට උත්සාහ කළ අවස්ථාවේදී කථානායකවරයා සිය කතාව නතර කළ බවත්, එමගින් 1953 අංක 21 දරන පාර්ලිමේන්තු (බලතල සහ වරප්‍රසාද) පනත යටතේ හිමිවන භාෂණයේ නිදහස උල්ලංඝනය කර ඇති බවත් ඔහු චෝදනා කරයි.

මෙම තත්ත්වය සැලකිල්ලට ගෙන

    1. පාර්ලිමේන්තු ප්‍රජාතන්ත්‍රවාදය සහ මන්ත්‍රී වරප්‍රසාද ආරක්ෂා කිරීම උදෙසා මේ පිළිබඳව අවධානය යොමු කරන ලෙසත්,

    2. කථානායකවරයාගේ ක්‍රියාකලාපය පිළිගත් පාර්ලිමේන්තු සම්ප්‍රදායන් සහ අපක්ෂපාතීත්වයට අනුකූලදැයි සොයා බලන ලෙසත්,

    3. අදාළ වරප්‍රසාද ප්‍රශ්නය පාර්ලිමේන්තු ආචාර ධර්ම සහ වරප්‍රසාද පිළිබඳ කාරක සභාව හමුවට යොමු කිරීමට ශ්‍රී ලංකා පාර්ලිමේන්තුව උනන්දු කරවන ලෙසත්,

    4. මෙම වරප්‍රසාද ප්‍රශ්නය මතු කිරීමට අවසර නොදීම පිළිබඳව ස්වාධීන හා අපක්ෂපාතී පරීක්ෂණයක් පවත්වන ලෙසත්,

    5. පොදුරාජ්‍ය මණ්ඩලීය පාර්ලිමේන්තු සංගමයේ විෂය පථය යටතේ පාර්ලිමේන්තු මන්ත්‍රීවරුන්ගේ අයිතිවාසිකම් සහ භාෂණයේ නිදහස සුරැකීමට අවශ්‍ය පියවර ගන්නා ලෙසත් 

       මන්ත්‍රීවරයා සිය ලිපිය මගින් ඉල්ලා ඇත.

Formal Complaint Filed Against Speaker Over Alleged Breach of Parliamentary Privilege

The Speaker of Parliament, Jagath Wijekrama, finds himself in the spotlight as allegations of corruption and misconduct are currently under investigation by the Commission to Investigate Allegations of Bribery or Corruption. Member of Parliament Dayasiri Jayasekara has lodged a formal complaint with the All-Party Parliamentary Group, accusing the Speaker of undermining parliamentary privilege and freedom of speech during a recent incident.

In a letter addressed to the Chairperson of the All-Party Parliamentary Group, Referee Thweini-Tsipane, and its Secretary, Steven Twig, Jayasekara, representing the Kurunegala District, detailed the specifics of his complaint.

He emphasized the urgent need for intervention to protect institutional neutrality within the Sri Lankan Parliament and to uphold the privileges of MPs, as well as their freedom to express themselves. Jayasekara claims that several pertinent issues are revealed in his correspondence.

While an investigation by the bribery commission into matters related to the Speaker's official duties is ongoing, the MP pointed out that he raised a query regarding the privileges of the Speaker on September 10, seeking clarity on the ongoing responsibilities attached to the role.

He intended to submit this inquiry regarding the privileges to the Committee on Parliamentary Ethics and Privileges but claims that the Speaker rejected his request, insisting that the matter should be examined by the Speaker himself.

Jayasekara highlighted a crucial principle of natural justice and institutional neutrality, questioning the integrity of the process surrounding whether the accused individual would objectively assess the complaint against him.

In his attempts to discuss the issue further, the Speaker reportedly interrupted Jayasekara, which he argues constitutes a violation of the freedom of speech guaranteed under the Parliamentary Privileges Act No. 21 of 1953.

In light of this situation, Dayasiri Jayasekara called for actions to address the following:

1. Immediate attention to safeguard parliamentary democracy and the privileges of MPs.

2. An inquiry into whether the Speaker’s actions are consistent with parliamentary traditions and impartiality.

3. A prompt referral of the privileges issue to the Committee on Parliamentary Ethics and Privileges.

4. An independent and impartial investigation into the refusal to allow the privileges question to be raised.

5. Necessary measures to protect MPs' rights and freedom of speech in accordance with the framework of the All-Party Parliamentary Group.

Through his letter, the MP has made a compelling case for these measures to be adopted and addressed urgently.
