චක්‍රලේඛ මඟින් පාලනය කරන්න ගියොත් අල්ලස් කොමිසමේ ස්වාධීනත්වය ඉවරයි..- රංග දිසානායක


 පාර්ලිමේන්තුව විසින් අනුමත කරනු ලබන අල්ලස් කොමිසමේ වාර්ෂික අයවැය ප්‍රතිපාදන, මුදල් අමාත්‍යාංශයේ සාමාන්‍ය චක්‍රලේඛ මඟින් පාලනය කිරීමට උත්සාහ කිරීම හේතුවෙන් කොමිෂන් සභාවේ ස්වාධීනත්වය අඩපණ වන බව අල්ලස් හෝ දූෂණ චෝදනා විමර්ශන කොමිෂන් සභාවේ අධ්‍යක්ෂ ජනරාල් රංග දිසානායක මහතා අනාවරණය කළේය.

පාර්ලිමේන්තුවේ රජයේ මුදල් පිළිබඳ කාරක සභාව හමුවේ පෙනී සිටිමින් අධ්‍යක්ෂ ජනරාල්වරයා මේ බව අවධාරණය කළේය.

නව දූෂණ විරෝධී පනතේ 31(1) වගන්තිය ප්‍රකාරව අල්ලස් කොමිසමේ වාර්ෂික අයවැය ඇස්තමේන්තුව ඉදිරිපත් කළ යුත්තේ මුදල් අමාත්‍යාංශයට නොව සෘජුවම පාර්ලිමේන්තුව වෙත බව පෙන්වා දුන් දිසානායක මහතා, පාර්ලිමේන්තුව සුදුසු පරිදි සිදුකරන සංශෝධන සහිතව එය ජාතික අයවැය ලේඛනයට ඇතුළත් කළ යුතු බව සඳහන් කළේය.

කෙසේ වෙතත්, පසුගිය කාලය පුරාම මුදල් අමාත්‍යාංශය විසින් එම ඇස්තමේන්තුව අමාත්‍යාංශ පද්ධතිය හරහා එවන ලෙස කොමිසමට දන්වා ඇති බවත්, එය නීතිමය ප්‍රතිපාදනවලට පටහැනි බවත් හෙතෙම පෙන්වා දුන්නේය.

"පාර්ලිමේන්තුව අනුමත කළ මුදල් නැවතත් මුදල් අමාත්‍යාංශයේ චක්‍රලේඛ මඟින් පාලනය වෙනවා නම්, කොමිසමට හිමිවිය යුතු ස්වාධීනත්වය ලැබෙන්නේ නැහැ" යැයි පැවසූ අධ්‍යක්ෂ ජනරාල්වරයා, විමර්ශන සඳහා අවශ්‍යතාවක් පැවතියද කොමිෂන් සභාවේ අරමුදලේ මේ වන තෙක් සත පහක්වත් නොමැති වීම හේතුවෙන් කොන්ත්‍රාත් පදනම මත හෝ අත්‍යවශ්‍ය සේවකයන් බඳවා ගැනීමට මුදල් නොමැති බවද කමිටුව හමුවේ අනාවරණය කළේය.

එසේම, නීතිපති දෙපාර්තමේන්තුව, රස පරීක්ෂක දෙපාර්තමේන්තුව සහ අල්ලස් කොමිසම වැනි ආයතනවල නිලධාරීන්ට දේශීය වශයෙන් ලබාගත නොහැකි විශේෂිත විමර්ශන පුහුණුවීම් සඳහා විදේශගත වීමේදී, ජනාධිපති ලේකම් කාර්යාලයෙන් හෝ භාණ්ඩාගාරයෙන් විශේෂ අවසර සහ මුදල් ඉල්ලා සිටීමට සිදුවීම ස්වාධීනත්වයට බාධාවක් බවද මෙහිදී සාකච්ඡා විය.

නීතියෙන්ම ස්වාධීනත්වය හිමි ආයතනයක් එලෙස අවසර ඉල්ලා යෑමට සිදුවීම ගැටලු සහගත බව කොමිසමේ නිලධාරීහු පෙන්වා දුන්හ.

මෙහිදී අදහස් දැක්වූ රජයේ මුදල් පිළිබඳ කාරක සභාවේ සභාපති ආචාර්ය හර්ෂ ද සිල්වා මහතා සඳහන් කළේ, විගණකාධිපති දෙපාර්තමේන්තුව සහ අල්ලස් කොමිසම වැනි ආයතන අනෙකුත් සාමාන්‍ය රාජ්‍ය ආයතන මෙන් නොව ආණ්ඩුක්‍රම ව්‍යවස්ථාවෙන්ම ස්වාධීනත්වය හිමි ආයතන බැවින්, ඒවායේ ස්වාධීනත්වය ප්‍රායෝගිකව රැකෙන පරිදි කටයුතු කිරීම අත්‍යවශ්‍ය කරුණක් බවයි.





Concerns Raised Over Independence of Anti-Corruption Commission Budgetary Control

Concerns regarding the erosion of the independence of the Anti-Corruption Commission were brought to light by its Director General, Ranga Disanayake. This revelation stems from the Parliament's attempts to control the commission’s annual budget through the Finance Ministry's standard procedures.

Speaking at a meeting of the Parliamentary Committee on Government Finance, Disanayake emphasized the stipulation in Section 31(1) of the new Anti-Corruption Act, which mandates that the annual budget estimate be submitted directly to Parliament rather than through the Finance Ministry. He stressed that Parliament should appropriately integrate this into the national budget documentation, reflecting necessary amendments.

Despite this legal requirement, Disanayake noted that the Finance Ministry has historically insisted that the commission submit its budget through the ministry's system, which he argued violates the mandated legal framework.

“If Parliament continues to approve the funding under the Finance Ministry’s control, the commission will not achieve the independence it deserves,” Disanayake cautioned. He also highlighted the severe limitations placed on the commission due to a lack of funds, revealing that, to date, the commission has received no funds, hindering its ability to recruit essential personnel on a contract basis.

The discussion turned to the challenges faced by officials in governmental institutions, including the Attorney General's Department and the Department of Customs, who may require specific overseas training for investigations. Disanayake raised concerns about the necessity for special permissions and funding from the President's Secretariat or Treasury, which, in turn, compromises their independence.

The implications of a legally independent institution being required to seek permission for resources were described as problematic by commission officials.

Chairman of the Parliamentary Committee on Government Finance, Dr. Harsha de Silva, echoed these concerns, asserting that institutions like the Department of Audit and the Anti-Corruption Commission, as constitutionally independent entities, must operate in a manner that preserves their autonomy practically and effectively.
