ලීසිං ඇරියස් කියා සමාගම්වලට මහ මග වාහන පැහැරගනීම තහනම්..- පොලිසියෙන් නිවේදනයක්..

කල්බදු සහ මූල්‍ය සමාගම් මඟින් වාහන අත්පත් කරගැනීමේ ක්‍රියාවලියේදී නීතිවිරෝධී ලෙස කටයුතු කරන පුද්ගලයින්ට එරෙහිව නීතිය තදින්ම ක්‍රියාත්මක කරන බව ශ්‍රී ලංකා පොලිසිය අවධාරණය කරයි. බදු ගැණුම්කරුගේ විරෝධතාවක් පවතින අවස්ථාවකදී අදාළ වාහන හෝ උපකරණ අත්පත් කරගත හැක්කේ දිසා අධිකරණයේ නඩු පැවරීමෙන් පසුව පමණක් බව ද පොලිසිය පෙන්වා දෙයි.

පොලිස් මාධ්‍ය කොට්ඨාසය විසින් නිකුත් කරන ලද නිවේදනයකට අනුව, 2000 අංක 56 දරන කල්බදු මූල්‍යකරණ පනතට අනුකූලව කල්බදු සහ මූල්‍ය සමාගම් කටයුතු කළ යුතු ආකාරය පිළිබඳව සහ ඊට අදාළ නෛතික විධිවිධාන සම්බන්ධයෙන් මේ වන විටත් සියලුම පොලිස් නිලධාරීන් දැනුවත් කර ඇත.

එම නිවේදනයේ වැඩිදුරටත් දැක්වෙන්නේ, බදු දීමනාකරු හෝ ඔහුගේ බලයලත් නියෝජිතයකු විසින් පූර්ව දැනුම්දීමක් සිදු කර පොලිස් ආරක්ෂාව ඉල්ලා සිටින අවස්ථාවලදී පොලිසිය මැදිහත් වන්නේ සාමය ආරක්ෂා කිරීම සඳහා පමණක් බවයි.

කිසිදු අවස්ථාවක වාහන හෝ උපකරණ අත්පත් කරගැනීමේ කාර්යය සඳහා පොලිස් නිලධාරීන් සෘජුව මැදිහත් නොවන බව ද එහි සඳහන් වේ.

අදාළ දේපළෙහි සන්තකය ලබාගැනීමට බදු දීමනාකරුට හැකියාව ලැබෙන්නේ බදු ගැණුම්කරුගේ කිසිදු විරෝධතාවක් නොමැති විට පමණි.

යම් හෙයකින් ඊට විරෝධතාවක් එල්ල වන්නේ නම්, බලහත්කාරයෙන් දේපළ අත්පත් කරගැනීමට උත්සාහ නොකර අදාළ පනතේ ප්‍රතිපාදන ප්‍රකාරව දිසා අධිකරණය හමුවේ නඩු පැවරිය යුතුය.

මෙම නීතිමය ක්‍රමවේදයට පටහැනිව කටයුතු කිරීම බදු දීමනාකරු හෝ ඔහුගේ නියෝජිතයන් විසින් සිදු කරනු ලබන වරදක් බව පොලිසිය පෙන්වා දෙයි.

මෙම ක්‍රමවේදය උල්ලංඝනය කරමින් බලහත්කාරයෙන් කටයුතු කිරීම සම්බන්ධයෙන් බදු ගැණුම්කරුවන් ඉදිරිපත් කරන පැමිණිලි විභාග කිරීමට සියලුම පොලිස් ස්ථාන වෙත උපදෙස් දී තිබේ. එම විමර්ශනවලදී කොල්ලකෑම, සොරකම හෝ අයුතු ඇතුළුවීම වැනි අපරාධ වැරදි අනාවරණය වුවහොත් ඊට එරෙහිව දැඩි නීතිමය පියවර ගන්නා බව ද පොලිසිය අනතුරු අඟවයි.

මේ අතර, 2000 අංක 56 දරන කල්බදු මූල්‍යකරණ පනත යටතේ වන ගිවිසුම්වලදී සාමය ආරක්ෂා කිරීමට පමණක් පොලිස් නිලධාරීන්ට මැදිහත් විය හැකි වුවද, 1982 අංක 29 දරන පාරිභෝගික ණය පනත යටතේ ගැනෙන කුලී සින්නක්කර ගිවිසුම්වලට (Hire Purchase) එලෙස මැදිහත් වීමට කිසිදු නෛතික ප්‍රතිපාදනයක් නොමැති බව ද පොලිසිය විශේෂයෙන් පෙන්වා දෙයි.

එබැවින්, මූල්‍ය සහ කල්බදු සමාගම් හරහා ඇති කරගත් එකඟතාවලට හා නීතිමය රාමුවට ගරු කරමින්, සාමය ආරක්ෂා වන අයුරින් කටයුතු කරන ලෙස ශ්‍රී ලංකා පොලිසිය සියලු පාර්ශවයන්ගෙන් ඉල්ලා සිටියි.

Police Reinforces Legal Protocols for Vehicle Repossession in Sri Lanka

The Sri Lanka Police has emphasized its commitment to rigorously enforce the law against individuals engaging in illegal practices during the vehicle repossession process conducted by hire purchase and financial firms. As highlighted by the authorities, vehicles or equipment can only be seized after the issuance of a court order from the district court in instances where disputes arise about the hire purchase agreement.

A statement released by the Police Media Division affirms that all police officers have been duly informed about the operational protocols stipulated under the Hire Purchase Finance Act, No. 56 of 2000, alongside the relevant legal procedures that govern these transactions.

Furthermore, the statement clarifies that police intervention is solely aimed at maintaining peace when a debtor or their authorized representative requests police security prior to seizing any property.

It is explicitly noted that police officers will not directly engage in any activities related to the seizure of vehicles or equipment under any circumstances.

The right to reclaim the relevant property is granted to the creditor only when there are no disputes raised by the debtor concerning the hire purchase agreement.

If any opposition arises, the creditor is advised not to resort to forceful possession but instead to seek legal recourse through the relevant district court, as per the provisions of the law.

The police highlights that undertaking these legal processes improperly by the creditor or their representatives would be considered an offence.

All police stations have been instructed to investigate complaints raised by debtors concerning forceful actions that violate this protocol. Should evidence of crimes such as robbery or unlawful entry be uncovered during these investigations, stringent legal measures will be imposed against the offenders.

Additionally, the police has specifically pointed out that while officers may intervene to maintain peace under the provisions of the Hire Purchase Finance Act, No. 56 of 2000, there are no legal provisions allowing such intervention concerning rent-to-own agreements under the Consumer Credit Act, No. 29 of 1982.

Consequently, the Sri Lanka Police urges all parties involved to adhere to legal frameworks and conduct themselves in a manner that preserves peace during these transactions.
