ත්‍රස්තවාදය වැළැක්වීමේ තාවකාලික විධිවිධාන පනත (PTA) අහෝසි කර ඒ වෙනුවට රජය විසින් අලුතින් ගැසට් කර ඇති ‘ත්‍රස්තවාදයෙන් රාජ්‍යය ආරක්ෂා කිරීමේ පනත් කෙටුම්පත’ (PSTA) හරහා මෙරට ජනතා විරෝධතා, වෘත්තීය සමිති ක්‍රියාමාර්ග සහ වැඩ වර්ජන පවා ‘ත්‍රස්තවාදී ක්‍රියා’ ලෙස අර්ථකථනය කර මර්දනය කිරීමට සූදානම් වන බව ජන අරගල සන්ධානය පවසයි.

කොළඹදී පැවති ප්‍රවෘත්ති සාකච්ඡාවකට එක්වෙමින් එම සන්ධානය මෙම කරුණු අනාවරණය කළහ.

එහිදී අදහස් දැක්වූ ජන අරගල සන්ධානයේ විධායක සභික ලහිරු වීරසේකර මහතා පෙන්වා දුන්නේ, මෙම නව පනත් කෙටුම්පත මඟින් ‘ත්‍රස්තවාදය’ සම්බන්ධයෙන් ලබා දී ඇති නිර්වචනය පැවති ත්‍රස්තවාදය වැළැක්වීමේ පනතටත් වඩා අතිශය පුළුල් කර ඇති බවයි.

"යම් ක්‍රියාවක් කිරීමට හෝ නොකිරීමට ආණ්ඩුවකට හෝ ජාත්‍යන්තර සංවිධානයකට බලකිරීම ත්‍රස්තවාදී ක්‍රියාවක් ලෙස මෙහි දක්වා තිබෙනවා. ඒ අනුව 2022 වසරේ අරගල සමයේදී ජනතාව කළ සියලු දේ මෙම පනත යටතේ ත්‍රස්තවාදී ක්‍රියා බවට පත්වෙනවා. මහාමාර්ගයක් අවහිර කිරීම, රාජ්‍ය ආයතනයකට ඇතුළු වීම, ජනාධිපතිවරයාට ගමන් කිරීමට නොහැකි වන සේ මඟ අවහිර කිරීම පවා ත්‍රස්තවාදී ක්‍රියා බවට පත් කරලා. දුම්රිය සේවකයන් වැනි වෘත්තීය සමිතියක් තම අයිතිවාසිකම් වෙනුවෙන් වැඩ වර්ජනයක් කළත්, එයද ත්‍රස්තවාදී ක්‍රියාවක් ලෙස අර්ථකථනය කළ හැකියි," යනුවෙන් ඔහු පැවසීය.

තවදුරටත් අදහස් දැක්වූ ඒ මහතා සඳහන් කළේ, උද්ඝෝෂණයක් කළ පමණින් වැරදිකරුවන් නොවන බවට වගන්තියක් ඇතුළත් කර තිබුණ ද, නිහඬව පාර අයිනේ සිටීමට පරිබාහිරව කිසියම් හෝ කාර්යාලයකට හෝ ගේට්ටුවකින් ඇතුළට පැමිණියහොත් එය ත්‍රස්තවාදයක් ලෙස සලකන බවයි. එසේම අධිකරණ ක්‍රියාවලියකින් වරදකරුවෙකු නොවූ අයෙකුට වුවද වරද භාරගෙන පුනරුත්ථාපනයට යාමට නීතිපතිවරයාට බලකළ හැකි ප්‍රතිපාදන මෙන්ම, සංවිධාන තහනම් කිරීමට ජනාධිපතිවරයාට පවරා ඇති අසීමිත බලතල ඔස්සේ එම සංවිධානවලට පත්‍රිකා ගැසීම, සමාජ මාධ්‍ය ඔස්සේ අදහස් පළ කිරීම පවා ත්‍රස්තවාදී ක්‍රියා ගණයට ඇතුළත් කර ඇති බවට හෙතෙම චෝදනා කළේය.

මාධ්‍ය හමුව අමතමින් දුමින්ද නාගමුව මහතා අවධාරණය කළේ, මීට පෙර රජයට එරෙහි සන්නද්ධ ක්‍රියාකාරකම් පමණක් ත්‍රස්තවාදය ලෙස සැලකුවද, නව පනත මඟින් වෘත්තීය සමිති අරගල, පත්‍රිකා බෙදීම, මාධ්‍ය භාවිතය සහ උද්ඝෝෂණ ආවරණය වන පරිදි රාමුව වෙනස් කර ඇති බවයි. මෙය ගොවි සහ කම්කරු ජනතා සටන් මර්දනය කිරීමේ බරපතළ පියවරක් බව ඔහු කියා සිටියේය.

"මේ පනතෙන් කෙළින්ම ත්‍රිවිධ හමුදාවට පොලිස් බලතල ලබා දෙනවා. හමුදාවට පුළුවන් සෝදිසි කිරීම් කරන්න, වරෙන්තු නැතිව අත්අඩංගුවට ගන්න, ගෙවල්වලට පනින්න. සිවිල් කටයුතු සම්බන්ධයෙන් පුහුණුවක් නැති හමුදාවට මෙවැනි බලතල පැවරීම අතිශය භයානකයි. මෙය මෙරට ඉතිහාසයේ ගෙනාපු අතිශය ප්‍රතිගාමී පනතක්," යැයි නාගමුව මහතා පෙන්වා දුන්නේය.

හිටපු ජනාධිපති රනිල් වික්‍රමසිංහ මහතාට පවා සම්මත කර ගැනීමට නොහැකි වූ මෙම මර්දනකාරී පනත සම්මත කිරීමට වත්මන් ආණ්ඩුව කටයුතු කරන්නේ කාගේ කොන්ත්‍රාත්තුවක් ඉටු කිරීමට දැයි ප්‍රශ්න කළ ඔහු, මෙම පනත කියවන විට රනිල් වික්‍රමසිංහ මහතා සතුටින් සිනාසෙනු ඇති බව ද සඳහන් කළේය.

2023 මැයි මාසයේ මෙම පනත ගෙන එද්දී ජාතික ජන බලවේගයේ විජිත හේරත් මහතා මෙම පනතට විරුද්දව උසාවි ගොස් ඇති බවත් 2024 වසරේදී මෙම පනත නැවත වතාවක් ගෙන එද්දී ජාතික ජන බලවේගය වෙනුවෙන් හරිනි අමරසූරිය විජිත හේරත් හා එරංග ගුණසේකර තිදෙනාම අධිකරණයට ගොස් ඇති බවත් ඔහු එහිදී තව දුරටත් කියා සිටියේය.





New Anti-Terror Law Raises Concerns Over Civil Liberties in Sri Lanka

The recently enacted 'Prevention of Terrorism (Temporary Provisions) Act' (PTA) has been abolished, replaced by a controversial new legislation known as the 'Protection of the State from Terrorism Act' (PSTA). This new law is raising alarms, with claims that it may criminalize public protests, trade union actions, and even strikes as "terrorist acts," as warned by the People's Resistance Alliance.

During a press conference held in Colombo, members of the Alliance disclosed the implications of the newly gazetted statute. Lahiru Weerasekara, an executive member of the group, highlighted that the definition of "terrorism" provided in this new legislation is significantly broader than that in the previous PTA.

He emphasized that the law has been crafted in a manner that allows any action intended to pressure the government or international organizations to be construed as terrorism. Accordingly, various activities staged during the protests of 2022 could now be categorized as terrorist actions under this law. Things like blocking highways, entering state institutions, or obstructing the President's passage are now classified as terrorism. Even professionals such as railway workers could find their right to protest labeled as terrorist acts.

Further discussion unveiled concerning provisions within the act, as Weerasekara pointed out that despite guarantees against wrongful accusations for merely participating in demonstrations, the law enables officials to treat entry into any government office or premises as a terrorist activity. Additionally, he criticized provisions that may compel individuals who have not been convicted to admit wrongdoing under the influence of the legal authorities, and the powers vested in the President to ban organizations could potentially classify actions like distributing pamphlets or expressing views on social media as terrorism.

Addressing the media, Duminda Nagamuwa emphasized that while previously only armed activities against the government were viewed as terrorism, the new law casts a far wider net. It targets trade union protests, distribution of literature, media usage, and public demonstrations, marking a drastic shift in how civil dissent may be suppressed.

"This law directly empowers the military with police authority, allowing them to conduct searches, arrest without warrants, and invade homes. Handing such powers to a military not trained in civil affairs is alarmingly dangerous and represents a profoundly regressive step in our nation's history," Nagamuwa stated.

He expressed concerns regarding whether the current government is enacting this oppressive law to fulfill commitments to external entities, suggesting that the mere thought of former President Ranil Wickremesinghe approving it may evoke a smirk from him.

When this legislation was introduced in May 2023, Vijitha Herath of the National People’s Power voiced strong opposition, and there are plans to reintroduce this legislation in 2024. Furthermore, he noted that representatives from the National People's Power, including Heenathi Amarasinghe, Vijitha Herath, and Eranga Gunasekara, had already approached the courts against the law.
