වසර හතළිස් පහකට වැඩි කාලයක් මෙරට ක්රියාත්මක වූ 1979 අංක 48 දරන ත්රස්තවාදය වැළැක්වීමේ (තාවකාලික විධිවිධාන) පනත අහෝසි කර, ඒ වෙනුවට නව ප්රතිපාදන හඳුන්වා දෙමින් සකස් කරන ලද ‘ත්රස්තවාදයෙන් රාජ්යය ආරක්ෂා කිරීමේ පනත් කෙටුම්පත’ රජය විසින් අතිවිශේෂ ගැසට් පත්රයක් මඟින් ප්රකාශයට පත් කර තිබේ.
අධිකරණ සහ ජාතික ඒකාබද්ධතා අමාත්යවරයාගේ නියමය පරිදි ප්රකාශයට පත් කර ඇති මෙම නව පනත් කෙටුම්පත මඟින් ජාතික ආරක්ෂාව තහවුරු කරන අතරම, ජාත්යන්තර මානව හිමිකම් ප්රමිතීන් සහ ආණ්ඩුක්රම ව්යවස්ථාවෙන් සහතික කර ඇති මූලික අයිතිවාසිකම් ආරක්ෂා කිරීමට විශේෂ විධිවිධාන රැසක් ඇතුළත් කර ඇත.
මහජනතාව තුළ භීෂණයක් ඇති කිරීම හෝ රජයකට බලපෑම් කිරීමේ අරමුණින් සිදු කරන මිනීමැරුම්, බරපතළ තුවාල සිදුකිරීම්, ප්රාණඇපයට ගැනීම්, අත්යවශ්ය යටිතල පහසුකම් හා සයිබර් පද්ධති විනාශ කිරීම් ඇතුළු ක්රියා රැසක් මෙහිදී ත්රස්තවාදී වැරදි ලෙස නිර්වචනය කර තිබේ.
එහෙත්, හුදෙක් සාමකාමී විරෝධතාවල නිරතවීම, වැඩවර්ජන හෝ වෙනත් වෘත්තීය සමිති ක්රියාමාර්ගවල යෙදීම සහ මානුෂීය ආධාර සැපයීම පමණක් කිසිදු ලෙසකින් ත්රස්තවාදී වරදක් සේ නොසැලකිය යුතු බව පනත් කෙටුම්පතෙහි 4(4) වගන්තිය මඟින් දක්වා ඇත. එසේම මාධ්යවේදීන් විසින් සිදු කරනු ලබන සාධාරණ වාර්තාකරණය, විවේචන, දේශපාලන අදහස් පළකිරීම්, අධ්යයන හෝ පර්යේෂණ කටයුතු ත්රස්තවාදය ප්රවර්ධනය කිරීමක් ලෙස නොසැලකෙන බවටද විශේෂ ආරක්ෂණයක් සලසා තිබේ.
නව පනත් කෙටුම්පතට අනුව, යම් සැකකරුවකු අත්අඩංගුවට ගත් විට පැය 48ක් ඇතුළත ආසන්නතම මහෙස්ත්රාත්වරයා වෙත ඉදිරිපත් කළ යුතුය. ආරක්ෂක අමාත්යාංශයේ ලේකම්වරයා විසින් නිකුත් කරනු ලබන රැඳවුම් නියෝගයක් වරකට මාස දෙකකට නොවැඩි කාලසීමාවක් සඳහා වලංගු වන අතර, සමස්ත රඳවා තබා ගැනීමේ උපරිම කාලය වසරක් නොඉක්මවිය යුතුය. යම් සැකකරුවකු මාස දෙකකට වඩා රඳවා තැබීමට අවශ්ය නම් ඒ සඳහා මහාධිකරණයේ පූර්ව අනුමැතිය ලබාගැනීම අනිවාර්ය කර ඇත.
එසේම, අත්අඩංගුවට ගත් සැකකරු පිළිබඳ තොරතුරු පැය 24ක් ඇතුළත ඔහුගේ ළඟම ඥාතියාට මෙන්ම ශ්රී ලංකා මානව හිමිකම් කොමිෂන් සභාවට ලිඛිතව දැනුම් දිය යුතු අතර, මහෙස්ත්රාත්වරුන්ට පූර්ව දැනුම්දීමකින් තොරව සැකකරුවන් රඳවා සිටින ස්ථාන නිරීක්ෂණය කිරීමටද පූර්ණ බලතල හිමිවේ.
සැකකරුවන්ගෙන් ප්රශ්න කිරීම් ශ්රව්ය-දෘශ්ය (Audio-Visual) තාක්ෂණය ඔස්සේ පටිගත කළ යුතු බවට මෙහි නියම කර තිබේ. සැකකරුවකු මහෙස්ත්රාත්වරයකු හමුවේ ලබා දෙන ප්රකාශයක් සාක්ෂියක් ලෙස පිළිගැනීමට නම්, අදාළ ප්රකාශය ලබා ගැනීමට පෙර සහ පසු එම සැකකරු අධිකරණ වෛද්ය නිලධාරියකු වෙත ඉදිරිපත් කර පරීක්ෂාවට ලක් කිරීම අනිවාර්ය කර තිබීම විශේෂත්වයකි.
යම් සැකකරුවකු වධහිංසාවට හෝ අමානුෂික සැලකිල්ලට භාජනය වී ඇති බවට පෙනී යන්නේ නම්, ඔහු වහාම වෛද්ය ප්රතිකාර වෙත යොමු කිරීමටත්, රඳවා සිටින ස්ථානය වෙනස් කිරීමටත්, වගකිවයුත්තන්ට එරෙහිව විමර්ශන පවත්වන ලෙස පොලිස්පතිවරයාට නියෝග කිරීමටත් මහෙස්ත්රාත්වරයාට බලය පැවරේ.
රඳවා තැබීමේ නියෝගවල නීත්යනුකූලභාවය සහ සමානුපාතිකත්වය විමසා බැලීම සඳහා විශ්රාමික ශ්රේෂ්ඨාධිකරණ හෝ අභියාචනාධිකරණ විනිසුරුවරයකුගේ ප්රධානත්වයෙන් යුත් ‘ස්වාධීන සමාලෝචන කමිටුවක්’ පිහිටුවීමටද නව පනත මඟින් යෝජනා කර ඇත. අගතියට පත් ඕනෑම රැඳවියකුට මෙම කමිටුව වෙත සහන පතා ඉල්ලීම් ඉදිරිපත් කළ හැකිය.
ත්රස්තවාදී ක්රියාවක ප්රතිඵලයක් ලෙස මරණයක් සිදුවූ අවස්ථාවකදී ජීවිතාන්තය දක්වා සිරදඬුවම් නියම කළ හැකි අතර, සෙසු බරපතළ ත්රස්ත වැරදි සඳහා වසර විස්සක් නොඉක්මවන බරපතළ වැඩ සහිත සිරදඬුවම් සහ රුපියල් මිලියන විස්සක් දක්වා දඩ නියම කළ හැකිය.
එමෙන්ම, මරණ හෝ බරපතළ හානි සිදු නොවූ අවස්ථාවලදී නීතිපතිවරයාගේ එකඟතාව සහ මහාධිකරණයේ අවසරය මත ප්රසිද්ධියේ සමාව අයැදීම, පුනරුත්ථාපනයට යොමුවීම හෝ වින්දිතයන්ට වන්දි ගෙවීම වැනි කොන්දේසිවලට යටත්ව නඩු පැවරීම කල් තැබීමට හෝ අත්හිටුවීමටද නව පනත් කෙටුම්පත හරහා විධිවිධාන සලසා තිබේ.
මෙම පනත් කෙටුම්පත පාර්ලිමේන්තුවට ඉදිරිපත් කර සම්මත කරගැනීමෙන් අනතුරුව, ගැසට් පත්රයේ පළවන නියමිත දින සිට බලාත්මක වීමට නියමිතය.
Sri Lanka Introduces New Anti-Terrorism Bill to Replace 1979 Act
In a significant move, the Sri Lankan government has announced a new anti-terrorism framework titled the 'Anti-Terrorism Act to Safeguard the State', which will replace the longstanding Prevention of Terrorism Act of 1979. This new legislation was formalized through a special gazette notification, emphasizing enhanced provisions for national security.
Per the directions of the Minister of Justice and National Integration, the new bill focuses on securing national interests while incorporating measures to uphold international human rights standards and the fundamental rights guaranteed by the constitution.
Among the actions classified as terrorist offenses are acts intended to instill fear among the public or exert pressure on the government, including murder, serious injuries, hostage-taking, and the destruction of essential infrastructure and cyber systems.
However, the act clearly states that peaceful protests, work stoppages, and other legitimate union activities will not be categorized as terrorism. Clause 4(4) specifically protects journalists who engage in fair reporting, criticism, political expression, or research from being labeled as promoters of terrorism.
The bill mandates that any suspect arrested must be presented before the nearest magistrate within 48 hours. Detention orders issued by the Secretary of the Ministry of Defence will be valid for a maximum of two months at a time, with the total period of detention not exceeding one year. For detaining a suspect beyond two months, prior approval from the High Court is required.
Furthermore, details about the arrested individual must be communicated in writing to their nearest relative and the Sri Lanka Human Rights Commission within 24 hours. Magistrates will also retain the authority to inspect detention centers without prior notice.
The legislation stipulates that interrogations of suspects must be recorded using audio-visual technology. A unique aspect of the bill is that any statement given by a suspect in the presence of a magistrate must be preceded and followed by a medical examination conducted by a forensic officer.
In cases where a suspect exhibits signs of torture or inhumane treatment, the magistrate is empowered to order immediate medical care and changes in the location of detention, as well as instruct the police to conduct inquiries against those responsible.
To ensure the legality and proportionality of detention orders, the new law proposes the establishment of an 'Independent Review Committee', headed by a retired Supreme Court or Appellate Court judge. This committee will allow any detained individual to submit requests for relief.
In instances where a death occurs as a result of a terrorist act, life imprisonment will be mandatory. For other serious terrorist offenses, penalties may include lengthy prison terms not exceeding twenty years and fines up to one billion rupees.
Moreover, in cases where no fatalities or serious harm ensue, provisions for the suspension of legal proceedings, rehabilitation, or compensation for victims are included, contingent on the consent of the Attorney General and approval from the High Court.
This new legislation is set to take effect following its presentation and endorsement by Parliament, aligned with the specified date in the gazette notification.
