 රාජ්‍ය බුද්ධි සේවයේ සහ යුද හමුදා බුද්ධි බලකායේ හිටපු අධ්‍යක්ෂ ජනරාල්, විශ්‍රාමික මේජර් ජෙනරාල් සුරේෂ් සලේ මහතා ත්‍රස්තවාදය වැළැක්වීමේ පනත (PTA) යටතේ අත්තනෝමතික ලෙස රඳවා තබා ගැනීම, ඔහුට එරෙහිව එල්ල වී ඇතැයි පැවසෙන අමානුෂික වධහිංසා සහ ඔහුගේ බරපතළ සෞඛ්‍ය තත්ත්වය පිළිබඳව එක්සත් ජාතීන්ගේ මානව හිමිකම් විශේෂඥ කමිටු කිහිපයක් එක්ව ශ්‍රී ලංකා රජය වෙත සිය දැඩි කනස්සල්ල පළ කරමින් විශේෂ නිවේදනයක් නිකුත් කර තිබේ.

ත්‍රස්තවාදයට එරෙහිව සටන් කිරීමේදී මානව හිමිකම් සුරැකීම පිළිබඳ විශේෂ වාර්තාකරු, අත්තනෝමතික ලෙස රඳවා තබා ගැනීම් පිළිබඳ ක්‍රියාකාරී කණ්ඩායම, සෞඛ්‍ය අයිතිවාසිකම් පිළිබඳ විශේෂ වාර්තාකරු සහ විනිසුරුවරුන්ගේ හා නීතිඥවරුන්ගේ ස්වාධීනත්වය පිළිබඳ විශේෂ වාර්තාකරු විසින් ඒකාබද්ධව මෙම ලිපිය රජය වෙත යොමු කර ඇත.

2019 පාස්කු ඉරිදා ත්‍රස්ත ප්‍රහාරය සම්බන්ධ විමර්ශනවලට අදාළව 2026 පෙබරවාරි 25 වන දින රාජකාරිය සඳහා යමින් සිටියදී අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුව (CID) මඟින් සුරේෂ් සලේ මහතා අත්අඩංගුවට ගෙන තිබේ. අනතුරුව ආරක්ෂක අමාත්‍යාංශය මඟින් දින 90 ක රැඳවුම් නියෝගයක් නිකුත් කර ඇති අතර, පසුව එය තවත් දින 90 කින් දීර්ඝ කර ඇත. පාස්කු ප්‍රහාරය පිළිබඳ පූර්ව තොරතුරු දැන සිටියදීත් ඒවා හිතාමතා වසන් කිරීම, කුමන්ත්‍රණය කිරීම සහ ආධාර අනුබල දීම ඔහුට එල්ල කර ඇති චෝදනා වේ.

කෙසේ වෙතත්, අත්අඩංගුවට ගෙන දින 103 කට අධික කාලයක් ගතවන තුරුත් ඔහුගෙන් ප්‍රශ්න කර ඇත්තේ අවස්ථා කිහිපයකදී පමණක් බවත්, අප්‍රේල් සහ ජුනි මාස අතර කාලයේදී ප්‍රශ්න කර ඇත්තේ කෙටි කාලසීමාවන් දෙකකදී පමණක් බවත් එක්සත් ජාතීන්ගේ වාර්තාව පෙන්වා දෙයි. එසේම, ඔහු අත්අඩංගුවට ගෙන සතියකට වැඩි කාලයක් ගතවන තුරුත් ඔහු සැකකරුවකු කරන්නේ කවර නඩුව යටතේද යන්න පිළිබඳව හෝ අධිකරණය නිල වශයෙන් දැනුවත් කර නොතිබූ බවටද කරුණු අනාවරණය වී ඇත.

තවද, සුරේෂ් සලේ මහතාට එරෙහි පරීක්ෂණ මෙහෙයවන ප්‍රධාන නිලධාරීන් දෙදෙනෙකු, පාස්කු ප්‍රහාරය පිළිබඳ සොයා බැලූ ජනාධිපති පරීක්ෂණ කොමිෂන් සභාව මඟින් චෝදනාවලට ලක්ව නඩු පැවරීමට නිර්දේශ වූ පුද්ගලයන් බවත්, පෞද්ගලික පලිගැනීම් මත මෙම පරීක්ෂණ සිදු කෙරෙන බවටත් බරපතළ සැකයක් පවතින බව එම වාර්තාවේ සඳහන් වේ.

සුරේෂ් සලේ මහතා අඩි 6.5 x 4.4 ක ඉතා කුඩා සිරමැදිරියක රඳවා සිට ඇති අතර, එම කුටිය මීයන්ගෙන් පිරී පැවති බවත්, දිවා රෑ නොබලා දැල්වෙන විදුලි බුබුළු හේතුවෙන් ඔහු දැඩි නින්ද නොයාමේ රෝගී තත්ත්වයකට සහ ඉරුවාරදයට ගොදුරු වූ බවත් පැවසේ.

අත්අඩංගුවට ගෙන දින කිහිපයකට පසු, නිලධාරීන් පිරිසක් සිරමැදිරියට ඇතුළු වී අනෙකුත් රැඳවියන් සහ නිලධාරීන් ඉදිරියේ ඔහුගේ ඇඳුම් සම්පූර්ණයෙන්ම උනා දමා, මාංචු දමා, බලහත්කාරයෙන් පාපොච්චාරණයක් ලබා ගැනීමට උත්සාහ කරමින් දැඩි අවමන් සහගත සැලකිල්ලකට ලක් කළ බවට තොරතුරු ලැබී ඇත. මේ සම්බන්ධයෙන් ඔහුගේ බිරිඳ විසින් පොලිස්පතිවරයා වෙත පැමිණිල්ලක් ඉදිරිපත් කර ඇති අතර, රැඳවුම් මධ්‍යස්ථානයේ සීසීටීවී (CCTV) දර්ශන සංස්කරණය කිරීමට හෝ මකා දැමීමට CID ස්ථානාධිපතිවරයා උත්සාහ කර ඇති බවටද චෝදනා එල්ල වී තිබේ.

අධිකරණ නියෝග මත සිදුකළ වෛද්‍ය පරීක්ෂණවලදී, සලේ මහතා පශ්චාත්-කම්පන ආතති තත්ත්වයෙන් (PTSD) පෙළෙන බවත්, ඔහු වධහිංසාවට සහ අමානුෂික සැලකිල්ලට ලක්ව ඇති බව සනාථ වන සාක්ෂි පවතින බවත් අධිකරණ වෛද්‍ය වාර්තා මඟින් තහවුරු කර ඇත. නීතිඥවරුන්ට ඔහු හමුවීමට අවහිර කිරීම සම්බන්ධයෙන් කොටුව මහේස්ත්‍රාත්වරයා CID අධ්‍යක්ෂවරයාට අනතුරු ඇඟවීමෙන් අනතුරුව, එම මහේස්ත්‍රාත්වරයාවද හදිසියේ ස්ථාන මාරු කර ඇති බව එක්සත් ජාතීන් සිය වාර්තාවෙන් පෙන්වා දෙයි.

පවතින අසාධාරණ තත්ත්වයන්ට එරෙහිව ජුනි 6 වන දින ඔහු ආරම්භ කළ උපවාසය හේතුවෙන් සෞඛ්‍ය තත්ත්වය ශීඝ්‍රයෙන් පිරිහී ගොස් කොළඹ ජාතික රෝහලට ඇතුළත් කෙරිණි. පසුව ඇති වූ දැඩි පපුවේ වේදනාවක් හේතුවෙන් ඔහු ජාතික රෝහලේ හෘද දැඩි සත්කාර ඒකකයට (CCU) මාරු කර යවා ඇති අතර, ඔහු අධි-අවදානම් සහිත හෘද රෝගියෙකු ලෙස නම් කර ඇත. ඔහුගේ ජීවිතය බේරා ගැනීම සඳහා හෘද සැත්කමක් සහ බද්ධ කිරීමක් (cardiac implant) අත්‍යවශ්‍ය විය හැකි බවත්, ඔහුගේ වර්තමාන තත්ත්වය තවදුරටත් රැඳවුම් භාරයේ තැබීමට නුසුදුසු බවත් හෘද රෝග විශේෂඥ වෛද්‍යවරුන් පවුලේ සාමාජිකයන්ට දැනුම් දී තිබේ. එහෙත්, මෙම රෝහල් වෛද්‍ය වාර්තා අධිකරණයට ඉදිරිපත් කිරීමට CID ය අපොහොසත් වී ඇති බවද වාර්තා වේ.

සුරේෂ් සලේ මහතා නැවත CID භාරයට පත් කළහොත් ඔහුගෙන් තවදුරටත් පළිගැනීම් සහ වධහිංසා සිදුවීමේ දැඩි අවදානමක් පවතින බව පෙන්වා දෙන එක්සත් ජාතීන්ගේ නියෝජිතයෝ, ශ්‍රී ලංකා රජය සිවිල් හා දේශපාලන අයිතිවාසිකම් පිළිබඳ ජාත්‍යන්තර සම්මුතිය (ICCPR) සහ වධහිංසාවට එරෙහි සම්මුතිය (CAT) උල්ලංඝනය කර ඇත්දැයි බරපතළ සැකයක් මතු කරති.

මේ සම්බන්ධයෙන් කරුණු පැහැදිලි කරමින් දින 60ක් ඇතුළත පිළිතුරු ලබා දෙන ලෙස දන්වමින් ප්‍රධාන කරුණු 8ක් ඔස්සේ රජයෙන් තොරතුරු විමසා ඇත.

    1. මෙම චෝදනා සම්බන්ධයෙන් රජයේ ස්ථාවරය සහ අමතර කරුණු.

    2. ත්‍රස්තවාදය වැළැක්වීමේ පනත යටතේ සිදුකළ අත්අඩංගුවට ගැනීමේ නීතිමය පදනම සහ පරීක්ෂණ අත්තනෝමතික බව තහවුරු වුවහොත් ඔහු වහා නිදහස් කරන්නේද යන්න.

    3. නීතිඥ සහාය ලබාගැනීමට ඇති අයිතිය සුරක්ෂිත කිරීම සහ විමර්ශනය මෙහෙයවන නිලධාරීන්ගේ අපක්ෂපාතීත්වය පිළිබඳ පැහැදිලි කිරීම.

    4. සබඳතා රහිතව හුදකලාව රඳවා තැබීමට (incommunicado detention) හේතු වූ කරුණු.

    5. ඔහුගේ වත්මන් සෞඛ්‍ය තත්ත්වය, වෛද්‍ය ප්‍රතිකාර සහ විශේෂඥ නිර්දේශ ක්‍රියාත්මක කර තිබේද යන්න.

    6. අමානුෂික වධහිංසා පැමිණවීම සහ නින්දාවට පත්කිරීම සම්බන්ධයෙන් ගෙන ඇති පියවර.

    7. වධහිංසා චෝදනා සම්බන්ධයෙන් ස්වාධීන හා අපක්ෂපාතී පරීක්ෂණයක් ආරම්භ කර තිබේද යන්න.

    8. සී.අයි.ඩී. නිලධාරීන්ගෙන් එල්ල විය හැකි පළිගැනීම්වලින් ඔහුව ආරක්ෂා කර ගැනීමට ගෙන ඇති පියවර කවරේද යන්න.

UN Human Rights Experts Urge Sri Lanka to Address Concerns Over Detention of Former Military Official

In a significant statement, multiple United Nations human rights special rapporteurs have expressed grave concerns regarding the arbitrary detention of retired Major General Suresh Saleh, a former Director General of the State Intelligence Service and the Army Intelligence Corps, under the Prevention of Terrorism Act (PTA). They highlighted issues related to alleged inhumane treatment and his severe medical condition, urging the Sri Lankan government to take immediate action.

Addressing the preservation of human rights in counter-terrorism efforts, the unified message from the special rapporteurs on arbitrary detention, health rights, and the independence of judges and lawyers emphasized the need for the government to respond comprehensively.

Suresh Saleh was taken into custody by the Criminal Investigation Department (CID) on February 25, 2026, in connection with investigations into the 2019 Easter Sunday bombings. Following his arrest, the Ministry of Defence issued a 90-day detention order, which was subsequently extended by another 90 days. He faces accusations of withholding intelligence regarding the attacks, as well as complicity in their execution.

However, reports indicate he has only been questioned a few times during his over 103-day detention. The UN report reveals that he faced interrogations only briefly during April and June, raising serious concerns about the legality of his detention. Moreover, it has been uncovered that he was not formally informed about the charges against him for more than a week following his arrest.

The report also raises alarms about two key officials overseeing the investigation into Suresh Saleh, suggesting they are under scrutiny for potential involvement in cases referred to the presidential commission investigating the Easter attacks. The inquiry is reportedly plagued by allegations of conflicts of interest.

Currently held in a cramped cell measuring just 6.5 by 4.4 feet, Saleh is reportedly subjected to unsanitary conditions, with the cell often infested with insects. The conditions have contributed to deteriorating health issues, as he cannot sleep properly due to constant exposure to bright lights.

Reports have emerged that shortly after his detention, groups of officials entered his cell to strip him of his clothing, subjecting him to humiliation and coercive treatment in front of other detainees and officers. This led his wife to lodge a formal complaint with the Inspector General of Police, alleging attempts to tamper with CCTV footage from the detention facility.

Medical examinations mandated by a court reveal that Saleh is enduring post-traumatic stress disorder (PTSD) and bears evidence of inhumane treatment. Following alerts from legal representatives about preventing access to him, the magistrate overseeing his case has suddenly been reassigned, exacerbating fears regarding his treatment.

The deteriorating situation led Saleh to initiate a hunger strike on June 6, pushing his health to crisis levels, necessitating his transfer to the National Hospital in Colombo. Due to severe abdominal pain, he was later moved to the Coronary Care Unit (CCU), categorized as a high-risk cardiac patient. Medical specialists suggest that a heart surgery and the implantation of a device could become essential, highlighting the inappropriateness of his continued detention given his serious condition.

Representatives from the UN have indicated that should Saleh be returned to CID custody, he faces a substantial risk of further reprisals and torture. They have raised concerns about possible violations of international covenants, including the International Covenant on Civil and Political Rights (ICCPR) and the Convention Against Torture (CAT).

In light of these serious allegations, officials have requested responses from the Sri Lankan government within 60 days, addressing critical points such as the charges against Saleh, legal justifications for his detention, compliance with international rights standards, and the current state of his health care and legal representation.

Prompt action is urged by the UN experts to prevent further harm to Saleh's physical and mental well-being and to immediately halt the arbitrary application of the Prevention of Terrorism Act.
