Former Attorney General Criticizes Sentencing of Ven. Gnanasara Thera
The recent sentencing of Ven. Galagoda Aththe Gnanasara Thera for contempt of court has been deemed entirely unlawful by former Attorney General Sarath N. Silva. He made these remarks during a national conference organized by the All Ceylon Buddhist Congress in Colombo, which focused on the protection of the Buddhist faith and the preservation of Sinhala Buddhist heritage.
Silva pointed out that the maximum penalty established by law for contempt of court in a magistrate's court is only a fine of 1,500 Rupees and a prison term of 18 months. Given this context, he emphasized that the sentence of six years imposed on Gnanasara Thera by the Court of Appeal Chief Justice Priyantha Jayawardena following an appeal was legally unfounded.
He further highlighted that imposing such a severe sentence for an incident related to contempt of court in a different jurisdiction lacks any legal basis. As a result, Silva argued that the presidential pardon granted to Gnanasara Thera by former President Maithripala Sirisena was completely justified.
The former Attorney General also expressed concern over the alarming trend of filing contempt of court charges against national leaders and monks, describing it as a "virus" spreading through the legal system. He noted that this aggressive approach is being implemented with malice against both the Maha Sangha and Sinhala Buddhist leaders.
In conclusion, Silva insisted that the situation requires legal action to be taken to restore balance and prevent the escalation of such practices.
*Note: In case of any discrepancy between the Sinhala and English versions, the Sinhala version shall prevail.
