Minister Clarifies Definition of Terrorism in New Legislation

In a recent discussion on the developments surrounding the new anti-terrorism legislation, Justice Minister Harshana Rajakaruna emphasized that the mere expression of political opinions, such as calls for a separate state or a federal system, does not constitute a terrorist act. His remarks were made during a politically themed program aired on an independent television network.

When asked by a journalist how the new law would address information exchanges related to banned organizations, Rajakaruna highlighted the importance of the legal definition of what constitutes a ‘terrorist act’ within the framework of the fresh legislation.

He pointed out that the Liberation Tigers of Tamil Eelam (LTTE) is one such organization currently banned in the country but clarified that the application of the law hinges on the specific legal definitions laid out regarding terrorist activities.

Using a hypothetical example, the Minister explained, “Let’s assume a new organization named ‘X’ emerges and expresses a desire for a separate state or a federal arrangement. This is simply their political stance. Under the new law, such a demand would not be classified as terrorism. The right to express a viewpoint, belief, criticism, or dissent is protected within the bounds of lawful political discourse.” He continued, “While there may be regulations concerning the LTTE, merely holding a political opinion similar to that of another faction should not be interpreted as a terrorist act.”
