Former Minister Basil Rajapaksa Denied Permission for Court Absence in Land Purchase Case
The Matare Magistrate's Court has rejected a request from former Minister Basil Rajapaksa to allow a legal representative to appear on his behalf, thus excusing him from personal attendance in a case concerning the purchase of property known as 'Browns Hill' in the Elikanda area. Magistrate Chathura Disanayake ruled that the provided reasons for the request were insufficient and that accepting it was not justified.
In a courtroom statement delivered through an attorney, Rajapaksa cited health issues that prevent him from undertaking long-distance travel. He expressed his readiness to submit evidence via video technology in light of his condition.
However, the government attorney representing the Financial Crimes Investigation Division vehemently opposed this request. He highlighted the absence of any evidence that would validate Rajapaksa's claim of being in a substantially serious condition that warrants such accommodations. The magistrate supported this argument, leading to the dismissal of Rajapaksa's request.
This case revolves around allegations related to the acquisition of a property valued at approximately 50 million rupees, under the Prevention of Money Laundering Act. The Attorney General's Department has informed the court that the ownership of the property is recorded in the name of Ayoma Galappaththi.
During the proceedings, co-defendants Mudit Jayakodi and Thissa Galappaththi were present in court, but both Basil Rajapaksa and Ayoma Galappaththi have yet to appear before the magistrate.
Reports indicate that Rajapaksa is currently residing in the United States, while Ayoma Galappaththi resides in Canada. The magistrate has mandated both parties to report to court on April 27, through notifications issued by the Ministry of Foreign Affairs and the Ministry of Justice.
