Transfer of Gampaha Magistrate Fuels Tensions Over Court Procedures
In a significant shift, Gampaha Magistrate Bandula Gunaratne has been abruptly reassigned to the Sri Lanka Judicial Training Institute. The decision, authorized by Secretary of the Judicial Service Commission Prasanna Alwis, comes amidst rising concerns over judicial integrity and protocol compliance.
Previously, the magistrate had issued directives to all police officers, urging them to refrain from presenting innocent citizens in court unnecessarily while overseeing investigatory processes. He had formally instructed the Inspector General of Police to establish a systematic protocol in response to these issues.
However, the magistrate expressed disappointment, noting that the Inspector General’s failure to implement these directives has undermined the respect and authority of the judiciary. This breakdown of communication and protocol has led to serious implications for the legal framework in the region.
In light of these developments, Magistrate Gunaratne has called upon the Chief Justice of the Appeals Court to take legal action against the police chief for contempt of court. He seeks accountability and effective measures to restore the integrity of judicial proceedings.
Compounding the situation, the police chief has lodged a complaint against Magistrate Gunaratne with the Judicial Service Commission, further inflaming tensions between law enforcement and the judiciary. The commission has instructed the magistrate to promptly provide his account and observations regarding these allegations.
