වයසක අය පරිණතයි.. විනිසුරු වයස වැඩි කරන්නේ ඒනිසයි..

අධිකරණ පද්ධතියේ පවතින දැවැන්ත නඩු ප්‍රමාණය කඩිනමින් අවසන් කර ජනතාවට සහනයක් සැලසීමේ අරමුණින් විනිසුරුවරුන්ගේ විශ්‍රාම වයස වසර දෙකකින් දීර්ඝ කිරීමට රජය තීරණය කළ බව අධිකරණ සහ ජාතික ඒකාබද්ධතා අමාත්‍ය නීතිඥ හර්ෂණ නානායක්කාර මහතා පවසයි.

කැබිනට් තීරණ දැනුම්දීමේ මාධ්‍ය හමුවට එක්වෙමින් අමාත්‍යවරයා අවධාරණය කළේ, මෙම තීරණය හුදෙක් ශ්‍රේෂ්ඨාධිකරණයේ හෝ අභියාචනාධිකරණයේ විනිසුරුවරුන්ට පමණක් සීමා නොවන්නක් බවයි.

ඒ අනුව අධිකරණ සංවිධාන පනත සංශෝධනය කරමින් දිසා විනිසුරුවරුන් සහ මහේස්ත්‍රාත්වරුන් ඇතුළු සමස්ත විනිසුරු මඩුල්ලේම විශ්‍රාම වයස දීර්ඝ කිරීමට පියවර ගන්නා බව ඔහු සඳහන් කළේය.

"මේ වන විට මෙරට අධිකරණ පද්ධතිය තුළ නඩු ලක්ෂ 11ක් පමණ ගොඩගැසී තිබෙනවා. දියුණු රටවල ජනගහනයෙන් මිලියනයකට විනිසුරුවරුන් 40ත් 60ත් අතර ප්‍රමාණයක් සිටියත්, ලංකාවේ එම සංඛ්‍යාව 20ක් වැනි ඉතා අඩු මට්ටමක පවතින්නේ. වසර 10-15ක් තිස්සේ විනිසුරු සංඛ්‍යාව වැඩි කිරීමට නිසි පුරෝකථනයක් තිබුණේ නැහැ."

විනිසුරුවරුන්ගේ විශ්‍රාම වයස 1978 වසරෙන් පසු සංශෝධනය වී නොමැති බව පෙන්වා දුන් අමාත්‍යවරයා, නීතියේ වර්ධනයට සහ නඩු කටයුතු කාර්යක්ෂම කිරීමට පරිණත සහ අත්දැකීම් බහුල විනිසුරුවරුන්ගේ සේවය තවදුරටත් ලබා ගැනීම අත්‍යවශ්‍ය බව සඳහන් කළේය.

මෙම පියවර හරහා අධිකරණයේ ස්වාධීනත්වයට හානි වන බවට විපක්ෂය නගන චෝදනා අමාත්‍යවරයා ප්‍රතික්ෂේප කළේය.

"අපි මේ කරන්නේ එක් පුද්ගලයෙකු ඉලක්ක කරගෙන හෝ ශ්‍රේෂ්ඨාධිකරණයට පමණක් සීමා වූ දෙයක් නොවෙයි. මෙය සමස්ත පද්ධතියේම වෙනසක්. අධිකරණයට අපහාස කිරීමේ නඩු සහ විනිසුරුවරුන්ගේ බදු ප්‍රශ්න සම්බන්ධ නඩු පවා අධිකරණය විසින්ම ස්වාධීනව විභාග කරනවා. ඒ නිසා රජය අධිකරණයට අතපොවන බවට කරන ප්‍රකාශ පදනම් විරහිතයි," යැයි ඔහු පැවසීය.

ශ්‍රී ලංකා නීතිඥ සංගමය සහ විනිසුරුවරුන්ගේ සංගමය ඉදිරිපත් කර ඇති කරුණු ද සැලකිල්ලට ගනිමින්, අධිකරණ පද්ධතියේ කාර්යක්ෂමතාව ඉහළ නැංවීම සඳහා රජය මෙම ප්‍රතිපත්තිමය තීරණය ගත් බව අමාත්‍ය හර්ෂණ නානායක්කාර මහතා වැඩිදුරටත් ප්‍රකාශ කළේය.

Sri Lankan Government Extends Retirement Age for Judges to Alleviate Court Backlog

In a strategic move aimed at addressing the overwhelming backlog in the judicial system, the Sri Lankan government has decided to extend the retirement age for judges by two years, as revealed by Minister of Justice and National Unified Development, Harsha de Silva.

Speaking at a media briefing on the Cabinet decision, he emphasized that this policy change is not limited to just the Supreme Court or the Court of Appeal judges but will encompass all levels of the judiciary.

He outlined that amendments to the judicial organization act would allow for an increase in the retirement age of District judges and Magistrates, thereby retaining experienced legal practitioners within the judicial fold.

Currently, Sri Lanka faces a staggering caseload of approximately 1.1 million cases within its courts. While developed nations maintain a ratio of 40 to 60 judges per million citizens, Sri Lanka has a vastly inferior ratio of around 20 judges, highlighting a serious deficiency in judicial resources. De Silva noted the absence of a coherent plan for increasing the number of judges for the past 10 to 15 years.

Since 1978, the retirement age for judges has not been modified, he pointed out, stressing that it is essential to maintain the services of seasoned judges to enhance the legal development and operational efficiency of the judiciary.

Responding to opposition claims that this move could undermine judicial independence, the minister dismissed such notions. “Our objective is not to target individual judges or limit our focus solely to the Supreme Court. This is a systematic change across the entire judiciary. Cases involving judicial misconduct and issues related to judges will be examined independently by the court itself. Therefore, assertions that the government is interfering with the judiciary are unfounded,” he stated.

In conclusion, Minister Harsha de Silva noted that taking into account points raised by the Sri Lanka Bar Association and various judges' associations, the government’s decision is a step towards improving overall judicial efficiency.
