ශ්රේෂ්ඨාධිකරණ සහ අභියාචනාධිකරණ විනිසුරුවරුන්ගේ විශ්රාම වයස දීර්ඝ කිරීම සඳහා රජය විසින් ඉදිරිපත් කර ඇති ආණ්ඩුක්රම ව්යවස්ථා සංශෝධන යෝජනාවට ශ්රී ලංකා නීතීඥ සංගමය සිය දැඩි විරෝධය පළ කර සිටියි.
2026 ජූලි මස 29 වන දින පැවැති එම සංගමයේ සාමාජික රැස්වීමේදී මේ පිළිබඳ විශේෂ යෝජනාවලියක් ඒකමතිකව සම්මත කර ගෙන තිබේ.
නීතීඥ සංගමය පෙන්වා දෙන්නේ මෙම යෝජනාව අධිකරණයේ ස්වාධීනත්වයට සහ නීතියේ ආධිපත්යයට සෘජු බලපෑමක් එල්ල කරන බවයි. එම යෝජනාවලිය මගින් අවධාරණය කර ඇති ප්රධාන කරුණු කිහිපයක් පහත දැක්වේ.
විනිසුරුවරුන්ගේ විශ්රාම වයස දීර්ඝ කිරීම සඳහා පවතින ආයතනික අවශ්යතාවය හෝ ඒ සඳහා පදනම් කරගත් විෂය මූලික සාක්ෂි රජය විසින් මෙතෙක් ඉදිරිපත් කර නොමැති බව නීතීඥ සංගමය පවසයි.
එසේම මෙම තීරණය ගැනීමට පෙර අධිකරණ ක්ෂේත්රය, නීති වෘත්තිය හෝ විද්වත් ප්රජාව සමඟ කිසිදු පුළුල් සාකච්ඡාවක් පවත්වා නොමැති බව ද එම සංගමය චෝදනා කරයි.
අධිකරණ පද්ධතිය දැනට මුහුණ දී ඇති ප්රධාන ගැටලු වන්නේ විනිසුරු පුරප්පාඩු, නඩු ප්රමාදය සහ තාක්ෂණික පහසුකම්වල පවතින හිඟයයි.
රජය විසින් මීට පෙර සකස් කරන ලද "ශ්රී ලංකාවේ අධිකරණ ක්ෂේත්රය පිළිබඳ තක්සේරු සහ උපායමාර්ගික ක්රියාකාරී සැලැස්ම" තුළ ද විනිසුරුවරුන්ගේ විශ්රාම වයස දීර්ඝ කිරීම පිළිබඳ කිසිදු නිර්දේශයක් ඉදිරිපත් කර නොමැති බව නීතීඥ සංගමය පෙන්වා දෙයි.
එක්සත් ජාතීන්ගේ අධිකරණ ස්වාධීනත්වය පිළිබඳ මූලධර්ම, බැංගලෝර් අධිකරණ ආචාරධර්ම සහ ලැටිමර් හවුස් මූලධර්ම උපුටා දක්වමින් නීතීඥ සංගමය අවධාරණය කරන්නේ, විනිසුරුවරුන්ගේ ධුර කාලය පිළිබඳ තීරණ ගැනීමේදී උපරිම විනිවිදභාවයකින් සහ ව්යවස්ථානුකූලව කටයුතු කළ යුතු බවයි.
දැනට සේවයේ නියුතු විනිසුරුවරුන් ඉලක්ක කර ගනිමින් මෙවැනි සංශෝධන සිදු කිරීම අධිකරණයේ ස්වාධීනත්වය කෙරෙහි මහජන විශ්වාසය බිඳ වැටීමට හේතු වන බව ද එහි සඳහන් වේ.
ඕනෑම පනත් කෙටුම්පතක ව්යවස්ථානුකූලභාවය පරීක්ෂා කිරීමේ බලය පැවරී ඇත්තේ ශ්රේෂ්ඨාධිකරණයටයි. එහෙත් මෙම සංශෝධනය මගින් සෘජුවම ප්රතිලාභ ලබන්නේ එම විනිසුරුවරුන්ම බැවින්, මෙවැනි පනතක් විභාග කිරීමේදී බරපතල පරස්පර විරෝධී තත්ත්වයක් නිර්මාණය වන බව නීතීඥ සංගමය පෙන්වා දෙයි.
අදාළ ව්යවස්ථා සංශෝධන යෝජනාව වහාම හකුළා ගන්නා ලෙසත්, දැනට පවතින විනිසුරු පුරප්පාඩු ව්යවස්ථානුකූලව කඩිනමින් පිරවීමට පියවර ගන්නා ලෙසත් නීතීඥ සංගමය රජයෙන් ඉල්ලා සිටියි. අධිකරණයේ ස්වාධීනත්වය ආරක්ෂා කිරීම වෙනුවෙන් ජනාධිපතිවරයා ඇතුළු පාර්ලිමේන්තුවේ සියලු මන්ත්රීවරුන් වගකීමෙන් කටයුතු කළ යුතු බව ද එම සංගමය වැඩිදුරටත් අවධාරණය කරයි.
Lawyers' Association Rallies Against Proposed Constitutional Amendments to Extend Judicial Retirement Age
The Sri Lanka Bar Association has voiced strong opposition to government-proposed constitutional amendments aimed at extending the retirement age for judges of the Supreme Court and the Court of Appeal. This dissent was expressed during a members' meeting held on July 29, 2026, where the association unanimously adopted a special resolution against the proposal.
Concerns have been raised about the proposed amendment's direct impact on judicial independence and the rule of law. The Bar Association highlighted several key points that underscore their objections. Notably, they argued that the government has yet to provide substantial institutional justification or any foundational evidence for the necessity of such an extension.
Furthermore, the Bar Association criticized the lack of extensive discussions with stakeholders in the judicial sector, legal profession, or academic community prior to making this decision.
Among the pressing issues currently facing the judiciary are vacant judicial posts, delays in case proceedings, and a significant shortfall in technological resources. The Bar Association also pointed out that the government’s previous strategy, titled "Evaluation and Strategic Action Plan for the Judiciary of Sri Lanka," made no recommendations regarding the extension of judges' retirement age.
Referencing fundamental principles concerning judicial independence from the United Nations, as well as the Bangalore Principles of Judicial Conduct and the Latimer House Principles, the Bar Association emphasized the need for utmost transparency and constitutional adherence in determining judges' terms of service.
The amendment, targeting currently serving judges for reform, could undermine public confidence in the judiciary's independence, the association warned.
It is also noted that the power to assess the constitutionality of any legislation rests with the Supreme Court. However, since the judges themselves would benefit directly from this amendment, the Bar Association expressed concerns about potential conflicts of interest that could arise during its examination.
The Bar Association has urged the government to immediately withdraw the proposed constitutional amendments and take swift action to fill existing judicial vacancies constitutionally. They further stressed that all parliamentarians, including the President, must act responsibly to uphold judicial independence.
