කෙසේ වෙතත්, විත්තිකරුවන් විසින් සිදුකර ඇති බව කියන වැරදිවල ස්වභාවය සලකා බැලීමේදී, ඔවුන්ට එරෙහිව දණ්ඩ නීති සංග්‍රහය යටතේ පවරා ඇති චෝදනා විභාග කිරීමට කිසිදු බාධාවක් නොමැති බවද විනිසුරුවරයා සිය තීන්දුවේ සඳහන් කළේය.

ඒ අනුව, අදාළ සිද්ධිය සම්බන්ධයෙන් දණ්ඩ නීති සංග්‍රහය යටතේ වන නඩු කටයුතු ඉදිරියටත් පවත්වාගෙන යාමට අධිකරණය අවසර ලබා දී ඇත.

Colombo High Court Dismisses Terrorism Charges Against Five Suspects, Rules on Criminal Liability Remains

The Colombo High Court has ruled that there is no legal basis for continuing terrorism charges against five suspects, including notable individual 'Harak Kata' (Nandun Chinthaka Vikramaratne), who allegedly plotted to escape from custody in the Criminal Investigation Department. This decision comes after the court evaluated the fundamental objections raised by the defendants’ legal representatives.

Justice Buddika C. Ragala acknowledged the defense's arguments, declaring that the initial allegations surrounding the suspects were insufficient to sustain charges under terrorism prevention law.

However, while dismissing the terrorism charges, the court emphasized that there are no impediments to examining any criminal offenses under the penal code related to the actions attributed to the suspects. The judicial ruling allows proceedings under the relevant provisions of criminal law to continue against them.
