Former Prison Commissioner Challenges Charges of Forging Presidential Pardons
In a striking development, Thushara Upuldeniya, the former Commissioner General of Prisons, has filed a preliminary objection in Colombo's Magistrate Court, asserting that there is insufficient evidence to sustain the allegations against him regarding the fabrication of documents related to presidential pardons for inmates. His legal representatives contend that neither the 'B' report nor any subsequent documentation has substantiated the claims made against him.
During the hearing presided over by Chief Magistrate Asanga Bodaragama, police representatives informed the court that two charges have been lodged against Upuldeniya in a complaint submitted by the Attorney General.
After the charges were read, senior lawyer Darshana Kuruppu presented this preliminary objection on behalf of Upuldeniya, emphasizing that the prosecution lacks credible evidence from the presented 'B' report and additional records to pursue the case further.
Citing a recent ruling from the Court of Appeal, Kuruppu noted that correspondence from Anuradhapura Prison Superintendent Mohan Karunarathna confirms that Upuldeniya had written to the Secretary of the Ministry of Prison Reforms regarding the matter, suggesting that his actions were sanctioned by the relevant prison authorities.
Furthermore, the attorney indicated that there was no direct link between the president and the decision made by the Anuradhapura Prison Superintendent to grant a release, highlighting that the investigation was initiated by the Criminal Investigations Department following multiple promotional campaigns on social media related to the case.
In a related stance, the Sri Lanka Human Rights Commission has also concluded that there were insufficient grounds for Upuldeniya’s arrest, which further underlines the lack of legal foundation for the charges. As such, the defense maintains that the evidence available in court does not justify proceeding with the accusations against the former commissioner.
In response to the defense’s preliminary objection, the police requested a postponement from the court, resulting in Magistrate Asanga Bodaragama scheduling the case for further examination on October 29, 2026.
