පූජ්‍ය ගලගොඩඅත්තේ ඥානසාර හිමියන්ට ලබාදුන් ජනාධිපති සමාව අහෝසි වී උන්වහන්සේ යළි සිරගත වීමට හේතුවූයේ, සිය ධුර කාලය තුළ ජනාධිපති ලේකම් කාර්යාලයේ නීති අංශය භාරව කටයුතු කළ අතිරේක ලේකම්වරිය විසින් සිදුකරන ලද තාක්ෂණික දෝෂයක් සහ තමන්ව නොමඟ යැවීමක් නිසා බව හිටපු ජනාධිපති මෛත්‍රීපාල සිරිසේන මහතා විශේෂ ප්‍රවෘත්ති නිවේදනයක් නිකුත් කරමින් පවසයි.

අධිකරණය ලබාදුන් තීන්දුව මුළුමනින්ම නිවැරදි බවත්, තමන් ඊට හිස නමා ගරු කරන බවත් පවසන හිටපු ජනාධිපතිවරයා, සිය නිලධාරීන් අතින් සිදුවූ එම වරද සම්බන්ධයෙන් සමස්ත මහා සංඝරත්නයෙන් සමාව අයැද සිටින බවද අවධාරණය කරයි.

හිටපු ජනාධිපතිවරයා පෙන්වා දෙන්නේ හෝමාගම මහේස්ත්‍රාත් අධිකරණයේ විභාග වූ B 7417/10 (අධිකරණයට බාධා කිරීම සහ ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 105 වගන්තිය යටතේ අධිකරණයට අපහාස කිරීම) සහ අංක 40042 දරන නඩු දෙකට අදාළව ඥානසාර හිමියන්ට සමාව ලබාදීමේදී මෙම ගැටලුව මතු වී ඇති බවයි.

අදාළ නඩු දෙකටම සමාව ලබාදීම සඳහා අධිකරණ හා බන්ධනාගාර අමාත්‍යාංශය වෙත ලිපි යොමු කර අනුමැතිය ලබාගත යුතු බවට සිය කාර්යාලයේ නීති අංශය භාර ජ්‍යෙෂ්ඨ අතිරේක ලේකම්වරිය තමන් දැනුවත් කළද, ඇය එම ඉල්ලීම අදාළ අමාත්‍යාංශය වෙත යොමු කර නොතිබූ බව හිටපු ජනාධිපතිවරයා හෙළි කරයි. 

ඒ අනුව විෂයභාර අමාත්‍යාංශයේ අනුමැතියකින් තොරව සිය අත්සන පමණක් ලබාගෙන ඇත්තේ තමන්ව මුළාවට ලක්කරමින් බවත්, එම ක්‍රියාපටිපාටික දෝෂය පදනම් කරගනිමින් ආචාර්ය පාක්‍යසෝති සරවනමුත්තු මහතාගේ රාජ්‍ය නොවන සංවිධානය හරහා සන්ධ්‍යා එක්නැලිගොඩ මහත්මිය අධිකරණය හමුවේ ගොනු කළ නඩුවකින් මෙම තීන්දුව ලැබී ඇති බවත් ඔහු සඳහන් කරයි.

තමන් එකල දරන ලද විධායක ජනාධිපති ධුරය යටතේ සේවය කළ නිලධාරිනියගේ නොසැලකිල්ල හමුවේ ඥානසාර හිමියන්ට මෙලෙස නැවත වරක් සිරගත වීමට සිදුවීම පිළිබඳව තමන් බලවත් කනගාටුව පළකරන බව පවසන සිරිසේන මහතා, අධිකරණ තීන්දුව අධ්‍යයනය කිරීමෙන් පසු මහා සංඝරත්නයට සහ මහජනතාවට සත්‍ය පැහැදිලි කරදීම සඳහා මෙම නිවේදනය නිකුත් කළ බව වැඩිදුරටත් කියා සිටියි.

Former President Sirisena Addresses Controversy Surrounding Gnanasara Thero's Reincarceration

The recent reincarceration of Ven. Gnanasara Thero has been attributed to a technical error by a senior staff member in the legal division of the President's Office, as disclosed by former President Maithripala Sirisena. In a formal statement, Sirisena articulated that this misunderstanding was not only a mistake by the staff but also a misdirection that led to Thero being remanded in custody once again.

Sirisena affirmed the accuracy of the court's ruling and expressed his deep respect for the judiciary, acknowledging the unfortunate miscommunication that resulted in an appeal for forgiveness from the entire Buddhist clergy due to this blunder by his officials.

Highlighting the specific cases involved, Sirisena referred to the judgments from the Homagama Magistrate's Court pertaining to case numbers B 7417/10 and 40042, which involve contempt of court and insults to the court under Article 105 of the Constitution. He pointed out that the question of granting amnesty to Gnanasara arose during the process of addressing these cases.

It was revealed that Sirisena's legal team was informed that approvals from the Ministry of Justice and the Department of Prisons were required to grant amnesty for the two cases. However, the responsible senior additional secretary did not submit the request to the relevant ministry, leading to confusion regarding the amnesty process.

The former President emphasized that he only signed the documents without the necessary ministry approval, which he considers a significant oversight. He further mentioned that this decision stemmed from a case filed by an NGO linked to Dr. Pakiyasothy Saravanamuttu, where a court ruling was issued without proper protocol.

Expressing his strong discontent over the re-imprisonment of Gnanasara Thero, which occurred under the negligence of an official who served during his presidency, Sirisena conveyed that issuing this statement was essential to clarify the truth to the Buddhist community and the general public following a thorough review of the court's decision.
